Mayor H.S. Hughes assumed the Chair, called the meeting to order at 5:32 p.m. and explained the public meeting is being held in accordance with the provisions of the Planning Act to obtain public comments with respect to the proposed Application by Eagles Rest Estates Inc on the lands located at 1552 Bass Lake Sideroad West. The following correspondence was received: Township of Oro-Medonte, Building Division dated December 10, 2019; Township of Oro-Medonte, Manager, Development Engineering dated December 11, 2019; Enbridge Gas Inc. dated December 12, 2019; Peter Osachuk dated December 27, 2019; Darryl Tuominen dated January 7, 2020; Simcoe County District School Board dated January 7, 2020; Andy Campbell dated January 7, 2020; Horseshoe Valley Property Owners Association (HVPOA) dated January 8, 2020; Michael and Linda Stringer dated January 8, 2020; Sheila Smith dated January 8, 2020; Nottawasaga Valley Conservation Authority dated January 8, 2020; Deb de Pass dated January 8, 2020; County of Simcoe, Planning Dept. dated January 8, 2020. Todd Weatherell, Intermediate Planner, explained the purpose and effect of the proposed amendment. A PowerPoint presentation was presented. Greg Barker, Innovative Planning Solutions (IPS) and Jeff McCuaig, Gerrits Engineering, on behalf of the applicant, were present. The following provided public comments: Guenther Wellnhofer provided concerns regarding the aquifer, the drying up of wells, the affluents, traffic/entrance, speed, the effect on the Moraine and concerns regarding the giving of the notice. Cameron Stevens (submitted correspondence) and provided comments and concerns to meeting objectives of the Oro-Medonte Strategic Plan/planning vision, listed objectives and values of water, sewer, roads, garbage, natural heritage features, environment, Lake Simcoe Protection Act, school, school transportation, taxes, economic, people, carbon footprint to build homes, and carbon footprint created by the average person. Peter Osachuk provided comments that the first proposal seemed appropriate and provided concerns/comments regarding traffic, speed limits, school roads are on sideroads vs. a County Road and health & safety concerns. Brenda Campbell provided comments of the enjoyment of the rural environment and application is not in keeping with the rural environment, plans are more appropriate for a city, concerns regarding traffic, water/aquifer level, the previous use of the property and the water went through a series of pumping stations, water shortages (there are deep wells in their area) and requested consideration of what Oro-Medonte is now and what it should be in the future e.g., is nice to have Burl's Creek and Horseshoe Valley in the community but feels this application is not appropriate. Michael Stringer provided comments he has the same concerns as previously noted, concerns about the density of the application and the potential water supply, damage to aquifer, sewage and disposal of sewage, traffic, property entrances, road improvements and speed limits. That DS2019-160, Todd Weatherell, Intermediate Planner re: Minor Variance Application 2019-A-67 by Jodie Financial Ltd., 74 Line 3 North be received and adopted. 2. That Minor Variance Application 2019-A-67 by Jodie Financial Ltd., specifically for permission to permit the reduction in loading space requirements from a minimum of two (2) loading spaces to 1 loading space, reduction in parking standards for industrial use from 106 spaces to 37 spaces, and a reduction in barrier free requirements for industrial use from 2 barrier free spaces to 1 barrier free parking space, on lands municipally known as 74 Line 3 North, Township of Oro-Medonte, be deferred pending further review of the Site Plan Approval application and septic design approval. 3. That DS2019-161, Catherine McLean, Planner re: Minor Variance Application 2019- A-68, Ivanka Welykanycz, 34 Myrtle Avenue be received. 2. That Minor Variance Application 2019-A-68 by Ivanka Welykanycz specifically to permit the reconstruction of a non -complying dwelling to be enlarged by way of a second storey addition, with a 1.14 metres (3.7 feet) interior side yard setback, a new porch roof and second floor balcony with a 0.05 metres (0.16 feet) front yard setback and the reconstruction of a detached accessory building with a rear yard setback of 1.2 metres (3.9 feet) and a lot coverage for all detached accessory buildings of 7.9% on lands known as 34 Myrtle Avenue, be approved. 3. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Section 5.1.3 (b) & 5.1.5, 5.16.1 (a)(b) of Zoning By-law 97- 95, the proposed detached accessory building and dwelling shall otherwise comply with all other applicable provisions of the Zoning By-law; b) That the proposed detached accessory building and dwelling be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; c) That an Ontario Land Surveyor (OLS), Professional Engineer (P. That DS2019-157, Derek Witlib, Manager, Planning Services re: Consent 2018-13-13 and Minor Variance 2019-A-64, Paul and Slawomira Weber, 3325 Line 4 North be received. 2. That the Development Services Committee grant provisional consent to Application 2018-B-13 to permit a boundary adjustment having an area of approximately 1.5 hectares (3.7 acres) to be added to a landlocked parcel to the east and identified by Roll No. 4346-010-002-29850, together with an access easement over an area of approximately 0.72 hectares (1.77 acres) over the parcel identified by Roll No. 4346- 010-002-29800, all located in Part of Lot 1 Concession 5 (Oro), Township of Oro- Medonte, subject to the following conditions: Page 10 of 12 Development Services Committee Meeting Minutes — Wednesday, January 8, 2020. a) That the severed lands be consolidated with the abutting property to the east and that the provisions of Section 50(3) and 50(5) of the Planning Act apply to any subsequent conveyance of, or other transaction involving, the identical subject parcel of land. Therefore, once the subject parcel of land has been conveyed to the owner of the abutting parcel to the east, the subject parcel and the said abutting parcel shall be consolidated and become one parcel of land. A solicitor's written undertaking shall be provided to the Secretary -Treasurer indicating that the necessary steps will be taken to implement the conveyance and to consolidate the parcels to one Property Identifier Number; b) That one copy of a Registered Reference Plan of the subject lands and easement be prepared by an Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer; c) That the applicant's solicitor prepare and submit a copies of the proposed conveyances for the parcel severed and for the easement, for review by the Municipality; d) That the applicant apply for and obtain final approval of all necessary Minor Variances to the satisfaction of the Township of Oro-Medonte; e) That the applicant apply for and obtain site plan approval; f) That all municipal taxes be paid to the Township of Oro-Medonte; g) That the Certificate of Consent be issued utilizing Form 4, Section 53 (42) of the Planning Act, R.S.O. 1990, to merge the parcels; and, h) That the conditions of consent imposed by the Committee be fulfilled within one year from the date of the giving of the notice of decision (Approval shall lapse where the conditions have not been fulfilled within one year of being imposed and/or two years from the date of the certificate if the transaction has not been finalized). Warning: Failing to fulfil the conditions within the above -noted statutory periods (Sections 53(41) & 53(43), the Planning Act R.S.O. 1990) shall cause the application to lapse and render this Decision null and void. 3. That the applicant be advised of the Development Services Committee's decision under the Secretary -Treasurer's signature. Carried. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Table B-4B and Section 5.10 of Zoning By-law 97-95, as amended, the lands and proposed dwelling shall otherwise comply with all other applicable provisions of the Zoning By-law; b) The applicant apply and obtain an entrance permit from the Township; and, c) That the appropriate Zoning Certificate and Building Permit be obtained only after the Committee's decision becomes final and binding, as provided for within the Planning Act R.S.O. 1990, c.P. 13. 3.
