A By-law to Appoint a Closed Meeting Investigator
and Repeal By -Law No. 2017-013
Whereas by its adoption of By-law No. 2017-162 on December 13, 2017, the
Corporation of the Township of Oro-Medonte appointed Principles Integrity as the
Township's Integrity Commissioner effective January 1, 2018; and
Whereas the Council of the Township of Oro-Medonte, per Motion No. SC191218-9
of its December 18, 2019 Special Council meeting, approved, in addition, to appoint
Principles Integrity through its principals Jeffrey A. Abrams and Janice Atwood-
Petkovski, as the Township of Oro-Medonte's Closed Meeting Investigator, to
perform the functions, powers and duties recited below and as may be set out in the
Municipal Act from time to time; and
Whereas the Municipal Act provides that a municipality may appoint a closed
meeting investigator who has the function to investigate in an independent manner,
on a complaint made to him or her by any person, whether the municipality or a
local board has complied with Section 239 of the Municipal Act or a procedural by-
law under Section 238(2) of the Municipal Act in respect of a meeting or part of a
meeting that was closed to the public, and to report on the investigation; and
Now Therefore be it resolved that:
That Principles Integrity, through its principals Jeffrey A. Abrams and Janice
Atwood-Petkovski, is hereby appointed as the Township of Oro-Medonte's
Integrity Commissioner pursuant to Part V.1, Accountability and Transparency,
of the Municipal Act.
2. That upon appointment Principles Integrity will have all the functions, powers
and duties of an integrity commissioner as set out in Part V.1, Accountability
and Transparency, of the Municipal Act.
3. That upon appointment Principles Integrity will have all the functions, powers
and duties of a closed meeting investigator as set out in 239.2 of the Municipal
Act.
4. That in addition Principles Integrity will have such functions, powers and duties
as may be assigned by Council from time to time.
5. That the Township of Oro-Medonte hereby indemnifies and save harmless the
Integrity Commissioner or any person acting under the instructions of the
Integrity Commissioner for costs reasonably incurred in connection with the
defence of a proceeding if the proceeding relates to an act done in good faith
in the performance or intended performance of a function, duty or authority
under Part V.1 of the Municipal Act, or a by-law passed thereunder, or with
respect to the Integrity Commissioner's duties as a closed meeting
investigator, or an alleged neglect or default in the performance in good faith of
the function, duty or authority.
6. That all actions taken and required to be taken by the Mayor and Deputy Clerk
on behalf of the Corporation of the Township of Oro-Medonte to complete this
matter including the execution of the Agreement and any other associated
documentation are hereby authorized, confirmed and ratified.
7. That By-law No. 2017-013 is hereby repealed in its entirety
S. That this By-law shall come into force and take effect as of January 1, 2020.
