Call to Order - Moment of Reflection: Mayor H.S. Hughes assumed the Chair and called. the meeting to order. 2. Adoption of Agenda: a) Motion to Adopt the Agenda. Public Meetings: a) Notice of Public Meeting for Proposed Amendment to the Zoning By-law of the Township of Oro-Medonte re: 2019-ZBA-01 (Township of Oro-Medonte Cannabis Production and Processing Facilities). Mayor H.S. Hughes assumed the Chair, called the meeting to order at 7:02 p.m. and explained the public meeting is being held in accordance with the provisions of the Planning Act to obtain public comments with respect to a proposed Zoning By -Law Amendment initiated by the Township of Oro-Medonte on the various lands within the Township. Derek Witlib, Manager, Planning Services explained the purpose and effect of the proposed application. A PowerPoint presentation was presented. The following provided public comments: Greg Burton provided comments with respect to the by-law as wide open except to residential areas, the lack of restrictions where applications can be located and how it is going to be controlled, in favour of the application being in industrial use locations, concerns of the definition of agricultural use and normal farm practice, industrial use control of odour, outside controls to ensure odour and water use and potential property value loss protection, economic benefit and concessions and accountability of tax load. to the applicants. Fred Stott provided comments on the companies capability to control the air quality, e.g, changing the air filters regularly, the three (3) km distance is not enough, sound control comments to monitor the system before implementation to ensure the sound levels are not increased, cost of generators, by-law mechanism to control the sound, Township implementing standards to control the sound and odour, the barb wire on top of the fence concerns and the building department requirements with respect to the application. William Friedman questioned the prohibition of cannabis and hemp outdoor growth, if there were options to control the odor would the prohibition be applicable, growing hemp / cannabis and license requirement comments. Kelly Larmand provided comments about location of applications, agricultural definition/uses, cultivation, odour, security, traffic, noise, unique features of cannabis cultivation, impact beside large residential areas, location comments, status of other municipality comments, federal/provincial/municipal jurisdictions and approvals. Eileen Beer provided comments on light, odour, noise issues, decrease of property values, what and where are the health studies that are being done, distance of odour travelling and receiving notification of applications being submitted. Lisa De Zoete provided comments on brightness and effect of continuous light on abutting/area properties, distance of odour, noise, current and future by-law and effect of the current application and would not have brought property in area if application had been known. Lindsay Boyd provided questions if the current application would be grandfathered, noise, lights and will current application be required to adhere to the new by-law. Bob Vakili provided comments on the understanding of the number of concerns and complaints received and questioned if site plan control was in place. Bart Adams provided comments regarding Health Canada process, gaps in the system, visual and odour complaints, no need to have greenhouses, area is a farming community, the right to make the rules, the decrease in the property value of homes, and specific applications submitted and/or in process. Richard Fotherby questioned a specific application submitted and property value concerns. Jim Partridge questioned the application as an agricultural operation vs. a farming operation and the applicable operations should be in an industrial location. Dean Taylor provided comments of the public enjoying their property and privacy in the Township, applicants should be good neighbours, e.g., there should be no generators consistently running, lighting concerns, options to solve the odour/lighting issues, e.g., burying the generator / adding shields, the need to resolve the issues for future applications, the constant and level of generators running, location of a hemp facility with other types of operations, the location of the application not appropriate for the area, and the difference between a residence and bed and breakfast site. Wayne Lintack requested confirmation of an application being in place before the interim control by-law, confirmation of site plan control for specific applications, number of other applications in place before the by-law was in place, use should not be allowed on A/RU / farmland in the Township.
