TAKE NOTICE that the Council of the Corporation of the Township of Oro-Medonte will
hold a Public Meeting on Tuesday, December 17, 2019 at 7:00 p.m. in the Municipal
Council Chambers. The purpose of the Public Meeting is to obtain public comments on a
proposed Amendment to the Zoning By-law, under Section 34 of the Planning Act, R.S.O.
1990 c. P. 13.
The purpose and effect of the Zoning By-law Amendment is to permit and establish
standards for Cannabis Production and Processing Facilities in the following zones: Rural
Industrial (IR), Economic Development (ED), and Agricultural/Rural (A/RU) Zones.
A draft by-law is available for review on the Township website (oro-medonte.ca). Based
on the public consultation, the final by-law may be amended following the public meeting
prior to Council's final consideration.
A key map illustrating the location of the subject lands is not provided as the proposed
amendments to By-law 97-95 would apply to various lands within the geographic
boundaries of the Township of Oro-Medonte.
And take further notice that pursuant to Section 34 (10.7) of the Planning Act, the
Application/Draft Zoning By-law Amendment is part of the public record and is available to
the public for viewing/inspection between 8:30 a.m. and 4:30 p.m. at the Township of
Oro-Medonte Administration Building. Any person wishing further information or
clarification with regard to the application or to arrange to inspect the application should
contact the Planning Division at 705-487-2171. If you are submitting letters, faxes, emails,
presentations or other communications with the Township concerning this application,
you should be aware that your name and the fact that you communicated with the
Township will become part of the public record. The Township will also make your
communication and any personal information in it available to the public, unless you
expressly request the Township to remove it.
Any person may attend the public meeting and/or make written or verbal representation
either in support of, or in opposition to, the proposed Amendment. If a person or public
body that files an appeal of a decision of the Township of Oro-Medonte in respect of the
proposed Amendment does not make oral submission at the Public Meeting, or make
written submissions to the Township before the proposed Amendment is adopted, the
Local Planning Appeals Tribunal (LPAT) may dismiss all or part of the appeal.
If you wish to be notified of the decision of the Township of Oro-Medonte in respect to the
proposed Zoning By-law Amendment, you must make a written request.

Whereas the Council of the Corporation of the Township of Oro-Medonte is empowered
to pass By-laws to regulate the use of land pursuant to Section 34 of the Planning Act,
R.S.O. 1990, c.P.13.
And Whereas Council deems it appropriate to amend the zoning provisions of By-law
97-95, in accordance with the policies of the Official Plan;

1. That a new Section 5.40 be added into the General provisions of Zoning By-law 97-
95, as amended as follows:
5.40 Cannabis Production and Processing Facility
5.40.1 Any cannabis production and processing facility shall be subject to the
following provisions:
a) a cannabis production and processing facility shall be permitted in the following
zones: IR, ED and A/RU.
b) a cannabis production and processing facility will be subject to site plan control
pursuant to Section 41 of the Planning Act, including the requirement for:
i. Odour impact analysis;
ii. Installation and operation of odour and light mitigation systems;
iii. Odour and light control maintenance and monitoring plans; and
iv. Waste management plan.
c) in addition to the requirements of this Section, a cannabis production and
processing facility shall comply with all zone provisions of the zone it is located
within;

e) outdoor storage is prohibited on a property on which a cannabis production and
processing facility is located;
f) no outdoor signage or advertising shall be permitted;
g) a building or structure used for security purposes for a cannabis production and
processing facility may be located within the front yard with a minimum front yard
setback of 7.5 metres. Maximum gross floor permitted for security structure that
is to be located in the front yard is 46.45 square metres.
2. That Section 6.0 — DEFINITIONS - is hereby amended by:
a) Adding the following new definitions:
"Cannabis Production and Processing Facility" shall mean any building or
structure licensed and authorized by Health Canada to ship, deliver,
transport, destroy, grow, dry, process, export and/or import cannabis or hemp
for medical or non-medical purposes, including related research as defined an
applicable Federal Regulation, as amended from time to time."
"Sensitive Land Use" means an existing residential building, existing place of
worship building or lands containing or zoned to permit a public or private
school, day nursery, public park or community centre."
b) Adding the following sentence at the end of the definition of "Agricultural Use":
"Agricultural Use includes a Cannabis Production and Processing Facility but
does not include outdoor growing of cannabis or hemp."
c) Adding the following sentence at the end of the definition of "Industrial Use":
"Industrial Use includes a Cannabis Production and Processing Facility but
does not include outdoor growing of cannabis or hemp."
3. This By-law shall take effect on the final passing thereof, subject to the provisions of
the Planning Act, as amended.

Council passed Interim Control By-law (ICBL) No. 2018-109 on the 12th day 61
December, 2018 and it has been extended to June 4, 2020.

Interim Control By -Law (ICBL) applies to all lands within the Township of Oro-�
Medonte which are zoned Agricultural/Rural (A/RU).
Purpose of ICBL was to permit the Township to undertake the necessary revi&vv

On August 14, 2019 Township Council directed staff to Amend Zoning By -

law 97-95 to define and identify "cannabis production and processing
facility" as a permitted use in specific zones and establish specific 3
performance standards such as provisions for minimum setbacks from lot o
lines, minimum separation from sensitive land uses and provisions for

By -Law No. 2019-126
Being a By -Law to Confirm the Proceedings of the Special Council Meeting held on
Tuesday, December 17, 2019
Whereas Section 5 of the Municipal Act, 2001, S.O. 2001, C. 25, as amended provides that the
powers of the Municipal Council shall be exercised by By -Law, unless the municipality is specifically
authorized to do otherwise;
And Whereas The Council of The Corporation of the Township of Oro-Medonte deems it expedient
that the proceedings at this Special Council Meeting be confirmed and adopted by By -Law;
Now Therefore the Council of The Corporation of the Township of Oro-Medonte hereby enacts as
follows..
That the actions of the Council at its Council Meeting held on Tuesday, December 17, 2019, and
in respect to each Motion, Resolution and other actions passed and taken by the Council at its
said Meeting is, except where prior approval of the Ontario Municipal Board is required, hereby
adopted, ratified and confirmed.
2. That the Mayor and the proper Officials of the Township are hereby authorized and directed to do
all things necessary to give effect to the said action or to obtain approvals where required and to
execute all documents as may be necessary on behalf of the Council of the Corporation of the
Township of Oro-Medonte.
3. That the Mayor/Chair and Clerk/Designate are hereby authorized and directed to execute and affix
the corporate seal to all necessary documents.
4. And That this by-law shall come into force and take effect on the final passing thereof.
