Whereas the Council of the Corporation of the Township of Oro-Medonte is
empowered to pass By-laws to regulate the use of land pursuant to Section 34 of
the Planning Act, R.S.O 1990, c.P.13, as amended;
And Whereas the Council of the Corporation of the Township of Oro Medonte has
determined a need to rezone the lands described above;
And Whereas the Council of the Corporation of the Township of Oro Medonte
deems the said application to be in conformity with the Official Plan of the
Township of Oro Medonte, as amended, and deems it advisable to amend By- law
97-95.
Now Therefore the Council of the Township of Oro-Medonte hereby enacts as
follows:
That the Zoning By -Law Map, is hereby further amended by rezoning those
lands described as Part of Lots 11, 18, 19 and Lots 20, 21, 22, 23, 24, 25,
28, 31, 32, 33, 34 and Part of Craig Street and Part of First Street
Registered Plan 91 and Part of Lots 41 and Part of the Northeast and South
Halves of Lot 42, Concession 1 (Geographic Township of Medonte)
Township of Oro-Medonte, County of Simcoe from Agricultural/Rural (A/RU)
and Agricultural/Rural with Exception (A/RU*15) to Residential One with
Exceptions (R1*301)/(R1*301)(H-XXX), Institutional (1), Environmental
Protection with Exceptions (EP*302/303) and Open Space (OS)/(OS)(H-
YYY) as depicted on Schedule A attached hereto and Schedule A attached
hereto forms part of By -Law 97-95 as amended. That the exceptions shall

hereto identifies a Holding Zone pursuant to Section 36 of the
Planning Act, R.S.O. 1990, c. P.13. This indicates that the lands so
zoned cannot be used for a purpose permitted by Residential One
(R1*301) until the (H-XXX) symbol is lifted pursuant to Section 36 of
the Planning Act. The (H-XXX) provision shall be lifted by the
Township of Oro-Medonte upon completion of the following matter to
the satisfaction of the Township of Oro-Medonte and the Nottawasaga
Valley Conservation Authority:
That a detailed delineation of the Regulatory Floodplain be
completed to the satisfaction of the Nottawasaga Valley

purpose permitted by Open Space (OS) until the (H-YYY) symbol is lifted
pursuant to section 36 of the Planning Act. The (H-YYY) provision shall be
lifted by the Township of Oro-Medonte upon completion of the following
matter to the satisfaction of the Township of Oro-Medonte and the
Nottawasaga Valley Conservation Authority:

INTRODUCTION
[1] Craighurst Land Corp. appealed against the failure of Council for the Township of
Oro Medonte (`Township") to make decisions with respect to applications to amend the
Official Plan and Zoning By-law and to grant draft plan of subdivision to permit lands
east of Penetanguishene Road and north of Horseshoe Valley Road to be developed for
single detached residential uses in conjunction with a school and park on either side of
a natural area bifurcating the 76.7 hectare parcel.
[2] The applications preceded the adoption and approval of the Craighurst
Secondary Plan, and the Tribunal was advised that the appeal seeking a site specific
Official Plan amendment is no longer necessary and that file is therefore closed.
[3] At the outset of the hearing, the Tribunal was also advised that the Parties were
seeking to convert the scheduled prehearing conference and request the Tribunal to
consider a settlement amongst the Parties on the zoning amendment and the draft plan
and recommended conditions of the plan of subdivision.
[4] There were no other persons seeking standing in the matter. The Tribunal heard
evidence from Matthew Cory who was qualified to give expert opinion testimony in
areas of land use planning.
[5] The proposed plan of subdivision is laid out on the 54 hectares ("ha") of the total
76.7 ha holding which are located within the Craighurst settlement area. The site
currently accommodates two detached dwellings and is bifurcated from the north west
at Penetanguishene Road, the western limits of the draft plan and the main street of the
hamlet of Craighurst, to the south east corner of the parcel fronting onto the southerly
limit, Horseshoe Valley Road.
[6] In August of 2019, Council for the Township approved the recommendation of
staff in support of the proposed zoning amendment and draft plan as being in conformity

with the Craighurst Secondary Plan and the 2019, A Place to Grow: Growth Plan for the
Greater Golden Horseshoe (Growth Plan) targets for the Craighurst designated Living
Area.
ANALYSIS AND FINDINGS
[7] The draft plan as recommended protects the identified watercourse, wetlands
and woodlot, together with appropriate buffers on the site which will come under the
stewardship of the Nottawasaga Valley Conservation Authority subject to the conditions
of draft plan approval, and the holding provisions of the proposed zoning amendment
which stipulate the terms related to the finalization of regulatory flood lines.
[8] The draft plan also incorporates appropriately located blocks for a school, a park
adjacent, which is also adjacent to the protected environmentally sensitive area,
communal septic areas, storm water management ponds, well, pumping station and
servicing areas. Development is organized on two principal public roads while protecting
the environmentally sensitive areas.
[9] The Tribunal is persuaded by the uncontroverted evidence of the land use
planner that the proposal provides an appropriate form of housing in a designated
growth area, and is a logical extension of development within the Craighurst settlement
area. The urban form is efficient and slightly more compact, yet compatible with the
historical pattern of development in the community.
[10] The Tribunal finds that the draft plan and conditions satisfy the criteria of
s. 51(24) of the Planning Act ("Act") and will result in development which is consistent
with the Provincial Policy Statement and conforms to the Growth Plan, and the Official
Plans of the County of Simcoe and Township of Oro Medonte.
[11] The proposed zoning amendment is in conformity with the Official Plan and
appropriately utilizes Hold provisions which work in conjunction with the conditions of
draft plan approval to in particular protect the identified environmentally sensitive and
culturally significant features of the subject lands.

[12] The Tribunal allows the appeal in part and approves the zoning amendment to
amend By-law No. 97-75 of the Township of Oro Medonte in accordance with
Attachment 1 hereto, forming part of this Order.
[13] The Tribunal also allows in part the appeal of the Plan of Subdivision and the
draft plan prepared by C.P. Edwards O.L.S. dated November 3, 2017, appended hereto
as Attachment 2 is approved subject to the fulfillment of the conditions set out in
Attachment 3 to this Order.
[14] Pursuant to s. 51(56.1) of the Planning Act, the Township of Oro-Medonte shall
have the authority to clear the conditions of draft approval and administer final approval
of the plan of subdivision for the purposes of s. 51(58). In the event there are any
difficulties implementing any of the conditions of draft plan approval, or if any changes
are required to be made to the draft plan, the Tribunal may be spoken to.

6. That the Owner shall enter into a subdivision agreement with the Township of
Oro-Medonte, agreeing to satisfy all conditions, financial and otherwise, of the
Township of Oro-Medonte.
7. That the subdivision agreement between the Owner and the Township of Oro-
Medonte be registered by the Municipality against the lands to which it applies,
pursuant to the provisions of the Planning Act.

42. Prior to any grading, stripping or servicing of the lands included within the draft
plan, the Owner shall provide a detailed Functional Servicing Report. This report

a) stormwater management retention and conveyance methods, low impact
development and end -of pipe practices to be implemented within and
external to the draft plan to address water quantity, water quality and
erosion control;
b) the protection of groundwater quality and quantity;

maintenance procedures and associated costs; and,
d) erosion and sediment control measures to be implemented before
stripping and grading of the subject lands to protect downstream

43. The Owner shall agree in the subdivision agreement to be wholly responsible for
the actual cost related to the design and construction of upgrades (potable water
supply, fire water demands and pumping storage) to the Craighurst municipal
water system.

distribution system for this plan shall be looped within this draft Plan of
Subdivision and that allowance shall be made for the future servicing of parcels of

Block 320 (Park Block) for parkland purposes in accordance with the Planning
and/or Municipal Act without monetary consideration free and clear of all
encumbrances and/or encroachments otherwise directed in writing by the
Director, Operations and Community Services.
48. That the Owner agree to either dedicate to the Township land to be subdivided as
public parkland or pay cash -in -lieu of parkland in accordancewith the Planning Act
and/or the Municipal Act to the satisfaction of Council.
49. Prior to final approval, the Owner shall prepare a park master plan to the satisfaction
of the Township in accordance with Township of Oro-Medonte Development
Engineering Policies, Process and Design Standards identifying the parkland
development, the location of walking trails, and the sidewalk connections within the
development and to the surrounding community.
50. Prior to execution of the Subdivision Agreement, the Owner shall prepare and

plantings in accordance with the policies of the Township of Oro-Medonte
Development Engineering Policies, Process and Design Standards. Note that the
required Utility Coordination Plan must demonstrate that there is adequate space
within the boulevard and lots for planting trees consistent with Township
Standards.
53. The Owner shall agree in the Subdivision Agreement that warning clauses will be
included in all agreements of purchase and sale, and that information will be
provided on all community information maps and promotional sales materials,
providing notice as follows:
a) That any encroachments of any kind are not permitted in environmental
protection blocks, stormwater management blocks or park lands; and,
b) That Block 320 is intended to include a park block and that such use may
result in increased vehicular and pedestrian traffic on the street and
adjacent to or in the vicinity of the property. Purchasers are further
advised that properties adjacent to such Block may be affected by noise
and lighting from such uses.

75. That prior to final approval, an updated Traffic Impact Report addressing the County
of Simcoe comments dated May 23, 2018, shall be prepared to the satisfaction of
the County of Simcoe.
76. That prior to final approval, the Owner shall enter into a legal agreement with the
County of Simcoe with respect to the financial and other responsibilities for the
design and construction of road improvements as recommended in a final
approved Traffic Impact Report.
77. Based on preliminary designs, the County has confirmed that County waste
collection services are feasible for this development. The County is not required to
provide waste collection services along unassumed roads until such time they are
assumed by the municipality. The County may, however, commence waste

conveyed to the Nottawasaga Valley Conservation Authority or other public body
satisfactory to the Township of Oro-Medonte, free and clear of all encumbrances and

road construction, parked vehicles, insufficient snow removal, etc., or should any
temporary turnarounds not be constructed to the County's standard, service
disruptions will occur. The Owner/Developer is responsible for providing waste
collection services until such time as the County has confirmed that the access

78. That prior to final approval or registration of any phase(s), the Owner/Developer

document. Furthermore, the Owner/Developer shall submit all engineering drawings
to the County of Simcoe to demonstrate that the design and construction of all roads
complies with the Waste Collection Technical Design Standards. Failure to construct
municipal roads in accordance with County's standards may result in waste collection
services being withheld or suspended, and may require reconstruction to
accommodate waste collection service vehicles.
79. That prior to final registration of each phase, the proposed M-plan for each phase of
the subdivision, or a reference plan that is prepared based on the proposed M-
Plan, shall identify temporary turning circles or hammer -head turnarounds at all
dead -ends and cul-de-sacs on municipal roads to facilitate the safe turnaround of
vehicles, including County of Simcoe waste collection vehicles and emergency

If the agency conditions concern conditions in the Subdivision Agreement, a
copy of the relevant section of the agreement should be sent to them. This will
expedite clearance of the final Plan.
14. Please note that an updated review of the plan, and revisions to the conditions of
approval, may be necessary if an extension is to be granted.
15. When the Zoning By-law is being prepared, reference to this subdivision
application OM -file number should be included in the explanatory note. This will
expedite the Township's and other agencies' consideration of the by-law.
16. Please be advised that the approval of this draft plan will lapse on August 6,
2022. This approval may be extended pursuant to subsection 51(33) of the
Planning Act, but no extension can be granted once the approval has lapsed.
17. Draft approval shall automatically and irrevocably lapse if final Plan approval is
not given to this plan within three (3) years of the approval date and no
extensions have been granted. If the Owner wishes to request an extension to
the draft approval period, a written explanation shall be submitted to the
Township of Oro-Medonte at least ninety (90) days prior to the lapsing with
reasons why the extension is required. A resolution from Township Council must
also be obtained prior to the lapsing date.
Subject to the conditions set forth above, this Draft Plan is approved under
Section 51 of the Planning Act R.S.O. 1990, Chapter 13, as amended.
