Page 2 of 23 Development Services Committee Meeting Minutes — Wednesday, September 4, 2019. Todd Weatherell, Intermediate Planner explained the purpose and effect of the proposed amendment. A PowerPoint presentation was presented. Vanessa Simpson, Innovative Planning Solutions (IPS), on behalf of the applicant was present. A PowerPoint presentation was presented. The following provided public comments Rob Ferguson provided comments regarding the permit process, distance of agricultural buildings between each other, storage and use of agricultural land, operating before the permit is in place, truck use leaving the yard, health & safety concerns with respect to sight lines, traffic issues, hours of operation, number of trucks being used, quality of life concerns. Tom Lawlor opposed the official plan and zoning applications, provided comments regarding safety/traffic concerns, operating before permit in place, shop built before permits in place, property should be farmed, hours the trucks are entering the property. Si Lowry provided comments on the use of road, official plan and zoning by-law should be upheld, safety concerns, disruption of rural/agricultural life, Line 10 is used for official cycling, unsafe entrance and allowing to operate before application was processed. Denise Parliament provided comments regarding potential future zoning/use on adjacent properties if the application is approved. Lisa Ferguson provided comments on the storage and the number of trucks allowed on the property, if operation is in Stroud, how is business operating, is there a limit of the number of trucks allowed on the property. Elizabeth Botman provided concerns about the noise/beeping when the trucks back up, preference of rural environment, the curve/safety of the road, property value concerns, environmental concerns for what material was used for the berm. Rob Pilon provided opposition comments to the amendments, sight line road concerns, dealing in bad faith, questions of road use for the business, increased traffic, hopes due diligence will be exercised for future use. Courtney Juneau provided concerns with the safety of children, the steep hill and the four (4) bus routes that use the road, road construction maintenance e.g., potholes etc. Christopher Juneau provided concerns regarding the rural/agricultural farm community and does not want the use/community to change. Britany Beard spoke in support of the application, a family trying to run a small business, no driveway/visibility concerns, traffic comments, drivers are adhering to the 60 km/hr speed limit and are being respectful, berms were placed to help with noise, trying to appease the neighbour and not everyone is against the application. Johannes Botman provided comments with respect to increased taxes and usage/damage with the additional truck traffic, environmentally concerns, potentially oil spillage/leakage, water and land damage concerns, visibility and safety concerns with the trucks. John Greenwood addressed the clean up of the property and the number of trucks and operating hours. That the Development Services Committee grant provisional consent to Application 2019-B-15 to permit a boundary adjustment consisting of two (2) severed parcels. Parcel one (1) having an area of approximately 0.45 hectares (1.11 acres) and a frontage of approximately 63.9 metres (209.6 feet), and Parcel two (2) having a lot area of approximately 1.45 hectares (3.58 acres) that is to be merged with an abutting parcel to the east; and a retained parcel consisting of a lot area of approximately 1.02 hectares (2.54 acres), a lot frontage of 76.2 metres (250.0 feet), and a depth of approximately 221.4 metres (726.5 feet), subject to the following conditions: a) That the severed lands that being parcel one (1) having an area of approximately 0.45 hectares (1.11 acres) and a frontage of approximately 63.9 metres (209.6 feet), and parcel two (2) having a lot area of approximately 1.45 hectares (3.58 acres) with no municipal address be merged in title with the abutting property to the east, municipally known as 410 Ingram Road, and that the provisions of Sections 50(3) and 50(5) of the Planning Act apply to any subsequent conveyance of, or other transaction involving, the identical subject parcel of land. Therefore, once the subject parcel of land has been conveyed to the owner of the abutting parcel, the subject parcel and the said abutting parcel shall merge in title and become one parcel of land. A Solicitor's written undertaking shall be provided to the Secretary -Treasurer indicating that the necessary steps to Page 5 of 23 Development Services Committee Meeting Minutes — Wednesday, September 4, 2019. implement the conveyance will be taken to implement the conveyance and to consolidate the parcels to one Property Identification Number. b) That one copy of a Registered Reference Plan of the severed lands prepared by an Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer. c) That the applicant's solicitor prepare and submit a copy of the proposed conveyance for the parcel severed, for review by the Municipality. d) That the applicant applies for and obtains approval of a Minor Variance to permit a minimum lot area of 1.02 hectare (2.54 acres) for a hobby farm on the retained parcel; and e) That all municipal taxes be paid to the Township of Oro-Medonte. f) That a Certificate of Consent be issued with respect to the severed parcels utilizing Form 4, Section 53 (42) of the Planning Act, R.S.O. 1990, to merge the severed parcel with the abutting parcel to the west. g) That the conditions of consent imposed by the Committee be fulfilled within one year from the date of the giving of the notice of decision (Approval shall lapse where the conditions have not been fulfilled within one year of being imposed and/or two years from the date of the certificate if the transaction has not been finalized.). That Minor Variance Application 2019-A-39 by Magaly Marsh specifically to permit the two existing detached accessory buildings on the severed lands prior to the construction of the dwelling and to recognize the existing detached accessory building with an increased floor area of 82.6 square metres (889.2 square feet) on the lands known as 279 Lakeshore Road West, be approved. 3. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Sections 5.1.2 and 5.1.6, the detached accessory buildings shall otherwise comply with all other applicable provisions of the Zoning By-law; b) That the detached accessory buildings be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; c) That the detached accessory buildings are not used for human habitation; d) That the third shed, which is less than 10 square metres, is deteriorating and was not included in the application, be demolished; and, e) That, if required, the owner demolishes or relocates the existing 11.4 sq.m. (122.7 sq.ft) detached accessory building when the dwelling is built so that it complies with Section 5.1.3 (a) of the Township's Zoning By-law and is not located in front of the dwelling. 4. The following provided public comments: Janet Bumstead provided opposition comments with respect to environmental reasons and the building was built without a permit. Comments included concerns regarding the amount of setback to protect Lake Simcoe, wildlife, septic tank concerns, shoreline violations, variance is not minor, tree concerns, intent of zoning and tour tests, view from her property and maintaining a community to respect the water for future generations. Ms. Bumstead submitted petition correspondence to the Committee members and staff. Picture correspondence, similar to the similar to the "side view" of the slide deck presented by staff, was circulated to the Committee. Svetlana Robu, the applicant, provided comments with respect to adhering to the rules, timing of when the property was bought/sold and the use of the buildings.
