A By-law to Enter into a Wildland Firefighting Agreement with
The Corporation of the County of Simcoe and
The Corporation of the Township of Oro-Medonte
and to repeal By -Law No. 1999-108
Whereas the Municipal Act, 2001, as amended, permits municipalities to enter into
agreements for the joint administration of firefighting;
And Whereas the Participating Municipality provides fire services within its geographic
boundaries;
And Whereas the County is the owner of certain tracts of land that form part of the
Simcoe County forest system (the "County Forest") that are located within the
Participating Municipality's geographic boundaries;
And Whereas the parties entered into an agreement dated November 1, 1999 which
details the terms by which the Participating Municipality will provide wildland firefighting
services for the County Forest(s) located within Participating Municipality's geographic
boundaries (the "Original Agreement");
And Whereas the parties wish to terminate the Original Agreement and set out new
terms and conditions under which the Participating Municipality will provide fire services
for the County Forest;
Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows:
That the Mayor and Clerk are hereby authorized to execute the Wildland
Firefighting Agreement between The Corporation of the Township of Oro-
Medonte and The Corporation of the County of Simcoe attached hereto as
Schedule "A" and forming part of this by-law.
2. That By-law No. 1999-108 is hereby repealed.
3. And That this by-law shall take effect on the final passing thereof.

WILDLAND FIREFIGHTING AGREEMENT
FOR SIMCOE COUNTY FORESTS
Dated the V) day of ` 2019 (the "Effective Date")
BETWEEN:
THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE
(the "Participating Municipality")
and
THE CORPORATION OF THE COUNTY OF SIMCOE
(the "County")
WHEREAS:
A. The Municipal Act, 2001, as amended, permits municipalities to enter into
agreements for the joint administration of firefighting;
B. The Participating Municipality provides fire services within its geographic
boundaries;
C. The County is the owner of certain tracts of land that form part of the Simcoe
County forest system (the "County Forest") that are located within the
Participating Municipality's geographic boundaries;
D. The parties entered into an agreement dated November 1, 1999 which details the
terms by which the Participating Municipality will provide wildland firefighting
services for the County Forest(s) located within Participating Municipality's
geographic boundaries (the "Original Agreement");
E. The parties wish to terminate the Original Agreement and set out new terms and
conditions under which the Participating Municipality will provide fire services for
the County Forest;
NOW THEREFORE WITNESSETH that in consideration of the above and the
covenants contained herein, the parties agree as follows:
1. Definitions
a. "Fire Chief" — means the person (or their designate) appointed by the
Participating Municipality as the head of the fire department.
b. "Fire Co-ordinator" - means the person appointed by the Fire Marshal to
co-ordinate a Mutual Aid Plan.
c. "Host Municipality" — means a municipality with care and control of a
Wildland Equipment Cache(s) as listed in Appendix A.
d. "Mutual Aid Plan" — means a program to provide or receive assistance in
the case of a major emergency in a municipality, community or area.
e. "Wildland Equipment Cache" — means a collection of specialized
wildland firefighting equipment used to extinguish wildland fires.
2. Termination of Original Agreement
The parties agree that the Original Agreement will be terminated as of the
Effective Date of this Agreement and the rights and obligations of the parties with
respect to wildland firefighting services shall be conducted in accordance with
this Agreement.
3. Municipal Fire Services
The Participating Municipality will respond to calls for fire services, as its
resources reasonably permit, to fight and extinguish fires occurring in all County
Forests located within the Participating Municipality's geographic boundaries.
The Fire Chief will have full authority to manage the fire until all units have
returned to their stations or the fire has otherwise been declared out by the Fire
Chief.
The Host Municipalities listed in Appendix A will be responsible to check, inspect
and repair the equipment contained in the applicable Wildland Equipment
Caches.
4. Location of County Forests
The County will work with the Participating Municipality to provide up-to-date
County Forest property information including maps of the County Forests, in a
mutually agreeable form.
5. Wildland Equipment Caches
The County will provide caches of wildland firefighting equipment for use by the
Participating Municipality and other municipal fire departments within the County.
Each equipment cache will contain the items listed in Appendix A and will be
stored by the Host Municipalities listed in Appendix A. The County will be
responsible to repair or replace items within each Wildland Equipment Cache on
an 'as -needed' basis as identified by the Host Municipalities. The County will
cover the costs associated with repair and replacement of such equipment.
Notwithstanding their location, all Wildland Equipment Caches will be available to
any municipality, including the Participating Municipality, in any emergency. If
multiple municipalities require equipment at the same time, the Fire Co-ordinator
will resolve such conflict based on priorities of fire response.
6. Specialized Training Costs
The County will cover the cost for firefighters to attend the SP103 course up to a
maximum of $2,500.00 annually for all Participating and Host Municipalities
combined. The SP103 course is a 2-day course for municipal fire departments
designed to provide firefighters with basic wildland firefighting knowledge and
skills. Priority attendance will be offered to firefighters from Host Municipalities
followed by other interested firefighters from Participating Municipalities.
7. Fees
In consideration of the Participating Municipality responding to calls pursuant to
this Agreement, the County shall pay to the Participating Municipality the current
fee rate as established by the Ministry of Transportation for highway calls or the
Ministry of Natural Resources & Forestry (MNRF), if applicable, whichever is
higher.
If other municipalities or provincial agencies, including but not limited to the
MNRF provide fire assistance pursuant to a mutual aid agreement, the County
will pay the fees set out above with respect to all fire apparatus or support units
including all on or off road fire department vehicles as well as any MNRF land or
air support vehicles, as determined by the Fire Chief. The Participating
Municipality will be responsible for forwarding any fees collected from the County
to the other responding municipalities or provincial agencies, including but not
limited to the MNRF.
The County shall pay for any equipment rented or purchased to assist in
extinguishing a fire if such equipment rental or purchase has been authorized by
the Fire Chief.
8. Termination
This agreement may be terminated by either party upon the giving of thirty (30)
days written notice to the following addresses:

APPENDIX A
The County's six equipment caches will be stored by the following Host Municipalities:
a. Two in the Township of Springwater;
b. One in the Township of Oro-Medonte;
c. One in the Township of Tiny;
d. One in the Town of New Tecumseth;
e. One in the Township of Ramara.
Notwithstanding their location, all equipment caches will be available to any
municipality, including the Participating Municipality, in any emergency.
