Based on the location of the property in proximity to the WHPA, the vulnerability score, and the purpose of the applications, it has been determined that neither section 57 (Prohibition) nor section 58 (Risk Management Plan) of the Clean Water Act, 2006 apply to this application. Mr. Karaiskakis, Thank you for circulating the County regarding the above-noted application. County Planning staff understand that the applicant is proposing a lot boundary adjustment to merge and enhance the agricultural lands to the north of 200 Line 5 North. The adjustment proposes a lot that contains a residence and agricultural buildings on lands with an approximate area of 4.86 hectares (12 acres), and an agricultural lot that would be approximately 40.5 hectares. Upon review of the application County Planning staff would like to offer the following comments. The subject lands are designated Agricultural, per Schedule 5.1 Land Use Designations to the Simcoe County Official Plan (SCOP). The province has also identified an agricultural system for the Greater Golden Horseshoe and the subject lands are located within the prime agricultural area. Section 2.3.4.2 of the PPS and Section 3.3.5 of the SCOP permit lot adjustments in prime agricultural areas for legal or technical reasons. Legal or technical reasons means severances for purposes such as easements, corrections of deeds, quit claims, and minor boundary adjustments, which do not result in the creation of a new lot. Although no new (additional) lot is being created, County planning staff would not consider this a minor boundary adjustment. The intention of prime agricultural areas is to protect land for long-term agricultural use. Section 2.3.4.1 of the Provincial Policy Statement (PPS 2014) states that lot creation in prime agricultural areas is discouraged and may only be permitted for agricultural uses, agricultural-related uses, a residence surplus to a farming operation as a result of farm consolidation, and infrastructure. Section 3.6.7 of the SCOP echoes the policy described above. New lots for agricultural uses may be permitted in the agricultural designation and should not be less than 40 hectares. A residence surplus to a farming operation as a result of farm consolidation may be permitted provided that the following criteria are met: i) the new lot will be limited to a minimum size needed to accommodate the residential use and appropriate sewage and water services, and should be an approximate size of 1 hectare; and tğŭĻ Њ ƚŅ Ћ Page 207 of 433 6.g) 6:50 p.m. Report No. DS2019-35, Catherine McLean, Planner re: Conse... ii) new residential dwellings are prohibited on any remnant parcel of farmland created by the severance. A severance that results in a 4.86 hectare (12 acre) parcel that contains a residence and agricultural buildings does not appear to meet the intention of lot creation to accommodate for a surplus residence in the prime agricultural area as outlined in the PPS or the Simcoe County Official Plan. Summary Based on the above, the County would recommend that the application be deferred to provide an opportunity for the applicant to provide additional information about the nature of the severance, to the satisfaction of the Township. For example, it is unclear why the agricultural buildings are not proposed to remain with the farm lands and instead are going to be located on the surplus residential lot. To conform to Section 3.6.7, the County is requesting that the surplus residential lot be restricted to the minimum size necessary to accommodate the residential use and appropriate sewer and water services. As noted, policy requires that this needs to be a lot size of approximately 1 hectare. As a condition of consent, the County is requesting that an application for a zoning by-law amendment be submitted and approved to prohibit new residential dwellings on any remnant parcel of farmland. The County also notes that the Township should satisfy itself regarding whether the proposal complies with the requirements of provincial Minimum Distance Separation guidelines (MDS).
