1997-046 For the imposition of fees with respect to the conduct of election for which the Clerk of the Township of Oro-Medonte must hold such election ~ y . . ~ THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 97-46 Being a By-law for the ~position of fees with respect to the conduct of election for which the Clerk of the Township of Oro- Medonte must hold such election. WHEREAS Section 220.1 of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended, permits a municipality to pass by-laws for imposing fees or charges, (a) for services or activities provided or done by or on behalf of it; (b) for costs payable by it for services or activities provided or done by or on behalf of any other municipality or local board; and (c) for the use of its property including property under its control; AND WHEREAS Bill 86, an Act to provide for better local government by updating and streamlining the Municipal Elections Act, the Municipal Act and related statutes received Royal Assent on December 19, 1996; AND WHEREAS Section 7, Subsection (5) of the Municipal Elections Act, 1996 provides that the powers conferred by section 220.1 of the Municipal Act are not restricted by Section 7, Subsections (1) to (4) of the Municipal Elections Act, 1996. Said Section 7 pertaining to costs of the election; AND WHEREAS Council at their Committee of the Whole meeting of April 23, 1997 and approved at their regular meeting of Council held May 7, 1997 adopted a method of collecting a fee as a cost recovery basis for the conduct of election for each governing body for which the Clerk must hold such elections under any act of the Province of Ontario, as may be amended from time to time; AND WHEREAS to provide for cost recovery of some of the election costs, Council deems it necessary and appropriate to impose certain fees on certain local boards. NOW THEREFORE the Council of The Corporation of the Township of Oro-Medonte enacts the following: 1. The cost for each governing body (D), being: (a) Simcoe County Board of Education - English Language (b) Simcoe County Board of Education - French Language (c) Simcoe County Roman Catholic Separate School Board - English Language (d) Simcoe County Roman Catholic Separate School Board - French Language will be in accordance with the following formula representing the proportion of the total cost (A) of the election and all positions to be elected (B) assignable based on the number of positions to be elected for that body (C).
