a) Notice of Particulars and Public Access, Notice of Public Meeting for a Proposed
Draft Plan of Subdivision, West Side of Line 11 North and South of 15/16 Sideroad,
Part of Lot 16, Concession 11 (Oro), Township of Oro-Medonte, 2018-SUB-02,
1157389 Ontario Inc. (East Oro Estates).
Deputy Mayor Hough called the meeting to order at 5:34 p.m. and explained the public
meeting is being held in accordance with Section 51, of the Planning Act, to obtain
public comment with respect to proposed Development Application. The purpose of
Application 2018-SUB-02 is to consider a proposal for a Draft Plan of Subdivision
comprised of 10 single detached dwellings.
Notice of the Public Meeting was mailed to landowners within 120 metres of the
specified site on October 9, 2018 and a notice sign was posted on the subject property
on or before October 9, 2018.
The following correspondence was received: Lake Simcoe Region Conservation
Authority dated October 12 and 18, 2018; Hydro One Networks Inc. dated October 15,
2018; Enbridge Gas Distribution dated October 22, 2018; Canada Post dated October

Andria Leigh, Director, Development Services, explained the purpose and effect of the
proposed amendment. A PowerPoint presentation was presented.
Nicola Mitchinson, Mitchinson Planning & Development Consultants, on behalf of
applicant, was present. A PowerPoint presentation was presented.
The following public persons offered verbal comments with respect to the proposed
amendment:
Brenda Nelles provided concerns regarding an easement and emergency access with
respect to the width of the road, concerns regarding her well and water table and
assurances her well will not be compromised, location of the road, number of original
lots and the number of lots on the application submitted, Lot 4 and 5 is close to her well,
the backyards of the dwellings will be against their property and the potential of planting
trees on the new lots or their property as a buffer.
Bruce Nelles provided comments that test holes were dug for the school and the two
potential houses should face their house vs. not face the back of their house.
Tim Crooks provided comments in support of the application, provided historical
information on the property, depth of well information, potential increase in numbers to
attend the school, potential improvements to the area cemetery, 4 way stop sign and
safety comments and the potential added value of homes in area.
Steve Morash, WMI & Associates Limited, on behalf of applicant, provided comments
with respect to soil pockets, percentages and assessments that have been completed.

1. That Report No. DS2018-110, Andy Karaiskakis, Senior Planner re: Consent
Applications 2018-B-29 & 2018-B-30 by 2250377 Ontario Limited & 2250375 Ontario
Limited, 3224 Line 4 North & 3094 Line 4 North be received and adopted.
2. That the Development Services Committee grant provisional consent to Application
2018-B-29 to convey a parcel having an area of approximately 0.64 hectares (1.58
acres) and a lot frontage of approximately 90.0 metres (295.2 feet), on lands
municipally known as 3224 Line 4 North, subject to the following conditions:
a) That the applicant pay to the Municipality a fee of $2,000 as a parkland
contribution for each residential lot to be created as cash -in -lieu of a parkland
contribution pursuant to By-law 2006-50 under the authority of subsection 53(13)
of the Planning Act, R.S.O. 1990 c. P. 13;
b) That one copy of a Registered Reference Plan of the severed lands prepared by
an Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer;
c) That the Applicant transfer to The Corporation of the Township of Oro-Medonte
("Township"), in fee simple, free and clear of all liens and encumbrances, a 3.0
metre road widening along the entire frontage of the severed and retained lands

adjacent to Line 4 North to the Township. The Applicant's solicitor shall prepare
and submit a draft of the proposed Transfer for review by the Township, together
with his/her opinion letter stating that upon registration of the Transfer, the
Township will have acquired a good and marketable title thereto, free and clear
of all liens and encumbrances. Further, the Applicant's solicitor shall be
responsible to see to the registration of the Transfer and Application under The
Land Titles Act, R.S.O. 1990, as amended, to consolidate the 3.0 metre widening
with Line 4 North as one Property Identifier Number to the satisfaction of the
Township. All costs associated with the preparation and registration of the
Transfer and Consolidation Application, including costs relating to surveying,
legal fees, and disbursements, agreements, HST, etc. shall be fully borne by the
Applicant;
d) That the applicant's solicitor prepare and submit a copy of the proposed
conveyance for the parcel severed, for review by the Municipality;
e) That all municipal taxes be paid to the Township of Oro-Medonte;
f) That the Certificate of Consent be issued utilizing Form 2, under Section 53(42)
of the Planning Act R.S.O. 1990, without qualification;
g) That the conditions of consent imposed by the Committee be fulfilled within one
year from the date of the giving of the notice of decision (Approval shall lapse
where the conditions have not been fulfilled within one year of being imposed
and/or two years from the date of the certificate if the transaction has not been
finalized.). WARNING: Failing to fulfil the conditions within the above -noted
statutory periods (Sections 53(41) & 53(43), the Planning Act R.S.O. 1990)
shall cause the application to lapse and render this Decision null and void.
3. The Development Services Committee grant provisional consent to Application
2018-B-30 being to permit a boundary adjustment of an area of approximately 2.2
hectares (5.4 acres) subject to the following conditions:
a) That the applicant obtain approval of Consent Application 2018-B-29 for the
creation of a new lot;
b) That the severed lands be merged in title with the abutting property to the north
and that the provisions of Section 50(3) and 50(5) of the Planning Act apply to
any subsequent conveyance of, or other transaction involving, the identical
subject parcel of land. Therefore, once the subject parcel of land has been
conveyed to the owner of the abutting parcel to the north, the subject parcel and
the said abutting parcel shall merge in title and become one parcel of land. A
solicitor's written undertaking shall be provided to the Secretary -Treasurer
indicating that the necessary steps will be taken to implement the conveyance
and to consolidate the parcels to one Property Identifier Number.
c) That one copy of a Registered Reference Plan of the subject lands prepared by
an Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer;
d) That the applicant's solicitor prepare and submit a copy of the proposed
conveyance for the parcel severed, for review by the Municipality;
e) That all municipal taxes be paid to the Township of Oro-Medonte;
f) That the Certificate of Consent be issued utilizing Form 4, Section 53 (42) of the
Planning Act, R.S.O. 1990, to merge the parcels; and

Farida Jones questioned the number of severances on the property, concerns regarding
the time to review documents, consultant's report was misleading with respect to
property sizes, driveway concerns with respect to threes, lot coverage percentage, no
setbacks for septic per the application, historical concerns regarding the demolition of
part or the whole dwelling, concerns regarding well, septic and water quality, concerns
of severing with less frontage and historical comments with respect to the character of
the community.
Suzanne Robillard read part of her submission dated November 7, 2018 regarding over
intensification, character of the area and not meeting the needs of the community.
Randy White provided comments with respect to the effects of his property.
Cindy White provided tree concerns with respect to digging the septic bed with two
potential lots which will affect properties.
Mary Kay Marshall provided comments with respect to the character of lots and tourists
visiting the area.

acres)for a proposed single detached residential use on lands municipally known as
1179 Line 2 South, at the request of the Committee pending further information from a
qualified arborist with respect to the impact of the proposed development on the existing
trees and the heritage aspects of the community including an existing survey of the
subject lands.

may include: payment of development charges, payment of cash in lieu of
parkland, detailed design of a building or septic system, engineered lot grading,
and water and sanitary servicing, on either the vacant severed or vacant retained
parcel.
d) That the applicant implement the requirements, if any, of the Nottawasaga Valley
Conservation Authority.
e) That applicant apply for and obtain approval of minor variances to recognize the
minimum lot areas for Parts 1 to 5.
f) That the applicant dedicate to the Municipality a fee of $2,000 as a parkland
contribution for each residential lot to be created as cash -in -lieu of a parkland
contribution pursuant to subsection 53(13) of the Planning Act, R.S.O. 1990 c. P.
13.;
g) That the Applicant transfer to The Corporation of the Township of Oro-Medonte
("Township"), in fee simple, free and clear of all liens and encumbrances, a 10.0
metre sight triangle at the corner of Warminster Sideroad and Burnett Street as
identified as Part 6 on draft reference plan, as well as a partial turn around
easement identified as Part 7 on the draft reference plan and dimensioned to the
satisfaction of the Director, Operations and Community Services. The Applicant's
solicitor shall prepare and submit a draft of the proposed Transfer for review by
the Township, together with his/her opinion letter stating that upon registration of
the Transfer, the Township will have acquired a good and marketable title

thereto, free and clear of all liens and encumbrances. Further, the Applicant's
solicitor shall be responsible to see to the registration of the Transfer and
Application under The Land Titles Act, R.S.O. 1990, as amended. All costs
associated with the preparation and registration of the Transfer and
Consolidation Application, including costs relating to surveying, legal fees, and
disbursements, agreements, HST, etc. shall be fully borne by the Applicant.
h) That the applicant pay $9,302.74 for each of the five (5) lots created as a pro-
rated fee for upgrades to the municipal water system in the Warminster
settlement area;
i) That all municipal taxes be paid to the Township of Oro-Medonte;
j) That the Certificates of Consent be issued utilizing Form 2, under Section 53(42)
of the Planning Act R.S.O. 1990, without qualification; and
k) That the conditions of consent imposed by the Committee be fulfilled within one
year from the date of the giving of the notice of decision (Approval shall lapse
where the conditions have not been fulfilled within one year of being imposed
and/or two years from the date of the certificate if the transaction has not been
finalized.).WARNING: Failing to fulfil the conditions within the above -noted
statutory periods (Sections 53(41) & 53(43), the Planning Act R.S.O. 1990)
shall cause the application to lapse and render this Decision null and void.
3. That Minor Variance Application 2018-A-43 by 12 West Holdings Inc., specifically to
permit five (5) severed lots with minimum lot areas of 0.15 hectares (0.39 acres) on
lands municipally known as 1750 Warminster Sideroad, be approved and that the
following conditions be imposed on the Committee's decision:
a) That notwithstanding Table 131 of Zoning By-law 97-95, the severed lots shall
otherwise comply with all other applicable provisions of the Zoning By-law; and,
b) That the proposed lots be substantially and proportionally in conformity with the
dimensions as set out on the application and sketches submitted and approved
by the Committee.
4. And, that the applicant be advised of the Development Services Committee's
decision under the Secretary -Treasurer's signature.
