I took a tour of this property the first time it came up for sale and decided it was a tear down. It appears the new owner has figured this out and wants to build two houses to recoup his money. Our township has it's regulations for lot sizes which this plan does not if into. I feel if it is aloud to go through it will open the way to more challenges from many more developers trying to make more money from property they purchase at the expense of our lifestyle in the village and the rest of the township. To Whom it may concern, I wish to express my concern against the proposed Severance Application on Line 2 South in Shanty Bay. I believe if it was granted it would be detrimental to the general neighborhood of Shanty Bay. It is important that the feel and landscape of the village is protected, both now and for future generations. I feel very strongly that developers should not be allowed to simply move in and change the feel of our village for a quick profit. I ask that the severance application would not be granted. The property is located partially within the Wellhead Protection Area C (WHPA-C) of the Canterbury water system with a vulnerability score of 4. Water quality policies in the South Georgian Bay Lake Simcoe Source Protection Plan (SPP) (approved: January 26; amended: May 14, 2015; effective: July 1, 2015) may apply. The SSEA has no objections to the Zoning By-Law Amendment as it pertains to the Drinking Water Source Protection program. Current environmental mapping indicates that the property is within an area governed by Ontario Regulation 179/06 under the Conservation Authorities Act for flooding and erosion hazards, unevaluated wetlands and lands adjacent to wetlands. Further, the property is identified within the Natural Heritage System of the Growth Plan and contains key natural heritage features and key hydrologic features as per the Growth Plan and the LSPP. The presence of frontages and areas comparable to those proposed for the severed and retained lots within the immediate and greater surrounding area is a key component of the rationale supporting the proposed severance. PROPERTY BOUNDARY SURVEY During Novembers Development Services Committee meeting, clarification was requested on the limits / boundaries of the proposed severed and retained lots. At that time a recent survey was not available for the subject lands. Since the Development Services Committee meeting, the applicant has retained C.A. MacDonald Surveying to complete a boundary survey of the subject lands. This survey can be found attached here under Appendix A. TREE INVENTORY & PRESERVATION PLAN Specific focus was placed on where the mature trees and vegetation were located on the proposed severed lot, and further information relating to the impact of the proposed development on mature vegetation on the subject lands was requested by members of the Planning Addendum December, 2018 IPS File 18-791 (1179 Line 2 S, Oro-Medonte) Page 2 Page 337 of 403 8.b) 8:30 p.m. Memorandum correspondence dated January 2, 2019 from Todd... PLANNING ADDENDUM APPLICATIONS FOR CONSENT, MINOR VARIANCE Development Services Committee during the November meeting. Since that meeting the applicant has retained a qualified arborist (Kuntz Forestry Consulting Inc.) to prepare a tree inventory and preservation plan (TIPP). All trees on site were located and tied in to the aforementioned boundary survey. Of the mature vegetation on the proposed severed lot, of particular concern to the Public and members of the Committee were the row of mature Spruce trees along the northern lot line of the proposed severed lot, along with the row of mature Sugar Maples along Line 2 South. The TIPP has identified two trees identified as hazard trees are proposed for removal; one sugar maple along the southern lot line, and one sugar maple along the western lot line, each on the proposed retained lot. Given the poor health of these trees and the hazard they pose to private property, their removal is recommended independent of the substance of the proposal. Removal of these trees is not required in order to allow for the proposed severance. Aside from the recommended removal of trees for poor health / hazardous reasons, the proposed severance does not require the removal of any trees. Tree preservation recommendations have been provided for in the full TIPP. The TIPP is attached as Appendix B. CULTURAL AND BUILT HERITAGE CONSIDERATIONS Further information relating to the impacts of the proposed development on cultural and heritage aspects of the community (Shanty Bay) was requested by members of the Development Services Committee during the November meeting. The age of construction of the homes along the surrounding section of Line 2 S varies considerably, as does building materials used and architectural style of exterior finishes. MPAC (Municipal Property Assessment Corporation) records indicate residences in the area range in age from 1900 to as recent as 2014. Materials used in external finishes include both wood and vinyl siding, brickwork, stonework, stucco, exposed concrete (foundation), and aluminum paneling. As sampled in Figure 2, a large variety of architectural styles are employed given the diversity in dates of construction and materials employed. Though no materials or style is formally proposed for the proposed new residential dwelling at this time, the existing diversity along the surrounding portion of Line 2 S, would support a wide range of potential external finishes and styles. PLANNING ADDENDUM APPLICATIONS FOR CONSENT, MINOR VARIANCE With respect to the proposed demolition of the residential addition on the existing dwelling: MPAC records indicate a construction date of 1978, notably more recent than the construction date of the original residence. The external finishes used on the addition (aluminum paneling) is not reflective of the age of the greater structure, nor is it a material seemingly used elsewhere along the portion of Line 2 S. The proposed demolition of a small portion of the existing dwelling on the proposed retained lot would not compromise the integrity of the greater structure while conversely it would restore the aesthetic properties and style of the original residence. There are no significant historic, cultural or social events known to be associated with the private residence. At the November Development Services Committee meeting, it was opined by members of the Public and Committee that the mature vegetation lining Line 2 South as well as generally on the subject lands would be considered aspects of the cultural and heritage framework of Shanty Bay. Through this addendum, evidence has been provided that no tree removal is required on the severed or retained lots in order to allow for the proposed severance, aside from recommended removals for health and safety reasons that exist today. It should be noted that Oro-Medonte currently offers no regulatory mechanisms to protect the exiting dwelling on the subject lands, or private trees, independent of these applications, with reference to 1179 Line 2 S. Chris McCaskie5December2018 Tree Inventory and Preservation Plan Report, 1179 Line 2 South, Oro-Medonte, Ontario Introduction Kuntz Forestry Consulting Inc. was retained by Chris McCaskie to complete a Tree Inventory and Preservation Plan report in support of a development application for a property located at 1179 Line 2 South in Township of Oro-Medonte, Ontario. The site is located on the southeast side of Line 2 South and Ridge Road West, within a residential area. The work plan for this tree preservation study included the following: Prepare inventory of the tree resources over 10 cm in diameter on private lands and trees of all sizes within the road right-of-way; Evaluate potential tree saving opportunities based on proposed development plans; and, Document the findings in a Tree Inventory and Preservation Plan report. Tree resources were visually assessed for condition utilizing the following parameters: Tree # - numbers assigned to trees that corresponds to Figure 1. Species - common and botanical names provided in the inventory table. DBH - diameter (centimeters) at breast height, measured at 1.4 m above the ground. Condition - condition of tree considering trunk integrity, crown structure and crown vigor. Condition ratings include poor (P), fair (F) and good (G). Comments - additional relevant detail. The results of the evaluation are provided below. Methodology ! Trees measuring over 10cm DBH on private lands and trees of all sizes on the road right- of-way were included in the tree inventory. Trees were located using a handheld GPS ® unit (Trimble GeoExplorer 6000 series) accurate to ±1m. Trees included in the inventory were numbered 1-33. Tree locations are shown on Figure 1. See Table 1 for the results of the inventory. Existing Site Conditions The subject property is currently occupied by a one and half story dwelling and gravel driveway. Tree resources exist in the form of landscape trees. Refer to Figure 1 for the existing site conditions. Individual Tree Resources The tree inventory was conducted on 29 November 2018. The inventory documented 33 trees on and within six metres of the subject property. Refer to Table 1 for the full tree inventory and Figure 1 for the location of trees reported in the tree inventory. Tree resource was comprised of Sugar Maple (Acer saccharum), American Beech (Fagus grandifolia), Black Walnut (Juglans nigra), Norway Spruce (Picea abies), White Spruce (Picea glauca), Blue Spruce (Picea pungens), Basswood (Tilia americana), and White Elm (Ulmus americana). Chris McCaskie5December2018 Tree Inventory and Preservation Plan Report, 1179 Line 2 South, Oro-Medonte, Ontario Proposed Development The proposed development includes the demolition of the northern part of the existing dwelling and the construction of a new dwelling on the north side of the subject property. The installation of septic tanks, tile beds, and driveways is proposed for each dwelling. Refer to Figure 1 for the proposed development. ! Discussion The following sections provide a discussion and analysis of tree impacts and tree preservation relative to the proposed development and existing conditions. Development Impacts/Tree Removal The removal of Trees 5 and 13 will be required due to their poor and/or hazardous conditions. The removal of two dead Ash trees on the northeast corner of the subject property is also recommended. Refer to Figure 1 for the location of the proposed tree removals. Tree Preservation Preservation of Trees 1-4, 6-12, and 14-33 (31 trees) will be possible with the use of appropriate tree protection measures as indicated on Figure 1 with GREEN tree labels. Tree protection measures will have to be implemented prior to the proposed development to ensure tree resource designated for retention is not impacted. Refer to Figure 1 for the location of required tree preservation fencing and general Tree Protection Plan Notes, and Appendix A for tree preservation fence details. Trees 2, 3, 4, 9 and 17 Encroachment into the dripline of Trees 2, 3, 4, 9, and 17 will be required to accommodate the proposed driveways and tile beds. Excavation will be required at 5.0m from Trees 2 and 3, 4.5m from Trees 4 and 9, and 3.5m from Tree 17. Given that encroachment is limited to outer edge of the dripline of these trees and with the following mitigation measures, long-term adverse effects are not anticipated to the trees. Prior to the proposed development, tree preservation fence must be installed as indicated on Figure 1; Excavation for the proposed driveway within the dripline of Trees 2-4, 9, and 17 should be completed by air spade excavation methods and supervised by a Certified Arborist to ascertain the extent of roots and to ensure the trees would not be destabilized after root pruning; Once the air spade excavation has been completed the exposed tree roots should be pruned by a Certified Arborist in accordance with Good Arboricultural Standards; and Branches that extend into the proposed development and require pruning must be pruned by a Certified Arborist or other tree professional in accordance with Good Arboricultural Standards. Trees 12 and 23-31 Encroachment into the dripline of Trees 12 and 23-31 will be required to provide an access during the construction. The following recommendations are suggested to minimize impacts to trees identified for preservation. Refer to Figure 1 for tree protection fence locations, further tree preservation plan notes and the tree protection fencing detail. Tree protection barriers and fencing should be erected at locations as prescribed on Figure 1. All tree protection measures should follow the guidelines as set out in the tree preservation plan notes and the tree preservation fencing detail. No construction activity including surface treatments, excavations of any kind, storage of materials or vehicles, unless specifically outlined above, is permitted within the area identified on Figure 1 as a tree protection zone (TPZ) at any time during or after construction. Branches that extend beyond prescribed tree protection zones that require pruning must be pruned by a qualified Arborist or other tree professional. All pruning of tree branches must be in accordance with Good Arboricultural Standards. Site visits, pre, during and post construction is recommended by either a certified consulting arborist (I.S.A.) or registered professional forester (R.P.F.) to ensure proper utilization of tree protection barriers.
