2018-105 Establish and Assume Highways Within the Township of Oro Medonte and to Repeal By-law 2018-092 part of Merrington Avenue Plan 51M-1015The Corporation of the Township of Oro-Medonte By-law No. 2018-105 A By-law to Name, Establish and Assume Highways Within the Township of Oro-Medonte and to Repeal By-law No. 2018-092 Part of Merrington Avenue, Plan 51M-1015 Whereas Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that municipalities may pass by-laws with respect to highways; And Whereas Section 31(2) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that land may only become a highway by virtue of a by-law establishing the highway; And Whereas Section 26 of the MunicipalAct, 2001, S.O. 2001, c.25, as amended, defines what constitutes a highway; And Whereas Section 61(1) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a municipality may enter upon land lying along a highway to install and maintain a sign setting out the name of a highway; And Whereas Council at their September 26, 2018 meeting approved By-law 2018-091 issuing the Certificate of Substantial Completion and Final Acceptance for the Isabella Estates Inc. Subdivision; And Whereas Council of the Township of Oro-Medonte deems it necessary to name, establish and assume for use highways within the boundaries of the Township of Oro- Medonte listed on Schedule `A' attached hereto; Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. That all highways listed in Schedule "A" of this by-law are hereby named, established and assumed for use as a public highway; 2. That the names for the public highways identified in Schedule "A" shall be affixed at every affected intersection thereof on public property. Where it is not practical to affix the name on public property, it shall be affixed on private property. 3. That the attached Schedule "A" shall form part of this By-law; 4. That By-law 2018-092 be repealed in its entirety; 5. That this by-law shall take effect on the final passing thereof.
