BY-LAW NO. 97-16
Being a By-law to Enter Into an Agreement Between The Corporation of the Township of Oro-Medonte and
The Corporation of the City of Orillia to Provide Certain 9-1-1 Answering Services
WHEREAS Section 207, paragraph 5 of the Municipal Act, R.S.O. 1990, c.MA5 provides for entering into
agreement with one or more municipalities to provide for the joint management and operation of systems and
services, and for the establishment of joint boards of management thereof.
AND WHEREAS the City ofOrillia and the Township ofOro-Medonte have approved the implementation of the
enhanced 9-1-1 emergency reporting service for all persons within their municipal corporate limits, wherever
possible;
AND WHEREAS Bell Canada completed the equipment installations, and the Enhanced 9-1-1 System was made
operational for the City ofOrillia and the Township ofOro-Medonte on November 12,1996.
AND WHEREAS the City of Orillia and the Township of Oro-Medonte are desirous of entering into an Agreement
for the City of Orillia to provide certain 9-1-1 answering services to the Township of Oro-Medonte;
NOW THEREFORE the Council of The Corporation of the Township ofOro-Medonte hereby enacts as follows:
1. That the Mayor and Clerk be authorized to execute said Agreement, attached hereto as Schedule "A" and
forming part of this By-law.
2. That this By-law shall come into full force and effect on its final passing thereof.
By-law read a first and second time this 19th day of February, 1997.

MEMORANDUM OF AGREEMENT DATED IN TRIPLICATE THIS 12th DAY OF

BETWEEN:
THE CORPORATION OF THE CITY OF ORILLlA

hereinafter called the "City"
OF THE FIRST PART
THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE
hereinafter called the "Township"
OF THE SECOND PART

WHEREAS Section 207, paragraph 5 of the Municipal Act, R.S.O. 1990
c.M45 provides for entering into agreement with one or more municipalities to provide
for the joint management and operation of systems and services, and for the
establishment of joint boards of management thereof.
AND WHEREAS the City and the Township have approved the
implementation of the enhanced 9-1-1 emergency reporting service for all persons within
their municipal corporate limits, wherever possible;
AND WHEREAS Bell Canada completed the equipment installations, and the
Enhanced 9-1-1 System was made operational for the City and the Township on
November 12, 1996.
AND WHEREAS the City and the Township are desirous of entering into an
Agreement for the City to provide certain 9-1-1 answering services to the Township;
NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration
of the premises and the mutual covenants and conditions herein contracted, the Parties
hereto do mutually covenant and agree as follows:
1 . The 9-1-1 answering bureau shall be a part of and located in the City of
Orillia Fire Department Communications Centre and shall receive and answer all
emergency calls from the public and transfer them to the appropriate police, fire and
ambulance services.
2. The basic function of the 9-1-1 answering bureau shall be the initial
answering of the 9-1-1 calls from the public and transfer of those emergency calls to the
appropriate agency.
3. The City shall be responsible for the management and operation of the 9-1-
1 answering bureau, including equipment and personnel.
4. The City shall operate the 9-1-1 answering bureau twenty-four (24) hours a day,
seven (7) days a week.
5. The City shall staff the 9-1-1 answering bureau at a level appropriate to
efficiently handle call lines in a manner suitable for emergency situations.
6. The City shall be responsible for the efficient operation of the 9-1-1
answering bureau and the rapid and accurate discharge of the duties of the 9-1-1 bureau

operators, and the selection and training of personnel.
7. The City shall log and tape-record all 9-1-1 calls and retain such logs and
recordings as required. The Township shall have reason~ble access to review all tape
recordings and time records of the 9-1-1 answering bureau pertaining to any 9-1-1
.-. situation that relates to that municipality.
,.. 8. The City shall provide a back-up Central Emergency Reporting Bureau to
which 9-1-1 calls will be directed in the event that the primary bureau is unable to -
accept the calls for any reason.
9. The Township shall provide to Bell, in written form, all geographical
information, including street names, addresses and borders within their municipal 9-1-
1 serving area, and shall be responsible for providing Bell with all changes that may
occur in any such geographical area during the term of the Agreement.
10. The Township shall agree to pay to the City all costs as set out in Schedule
"A" attached to and forming part of this Agreement.
11. The City and the Township and representatives of the 9-1-1 emergency
services shall meet at least annually and more frequently if required, where issues
regarding the 9-1-1 answering service would be discussed.
12. The Township shall add the City as an "additional insured" on their General
Liability Policy with respect to the services provided by the City under this agreement.
13. The Township covenants and agrees that it will at all times indemnify and
save harmless the City and the members of the Orillia Fire Department or any other
person who may render or attempt to render assistance in the spirit of the Agreement
from all and any liability, claims, actions, suits or demands for damages or otherwise for
or by reason of or arising in any way from delivery of the 9-1-1 answering service to the
Township.
14. This Agreement shall come into effect on the first day of January, 1997
and shall continue in force for a five (5) year period until the 31 st day of December
2001. Notification of renewal of this contract is required prior to December 31, 2000.

SCHEDULE "A"
The City shall charge an amount equal to the Township's share of the Bell
Neutral Answer (BNAS) Tariff that would be charged for all 16 County of Simcoe
municipalities, based on the Township's percentage share of the County levy by-law.
The costs will be updated annually based on the current BNAS Tariff and the previous
year's County Levy By-law apportionment.
An annual administration fee in the amount of 10% of the total annual cost
will be charged.
Based on the 1996 BNAS Tariff and County Levy Apportionment, the
annual cost payable would be as follows:
