1997-018 To Authorize the Sale of Lands (Part of the east half of Lot 36, Concession 1 E.P.R., Township of Oro-Medonte THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE IV BY-LAW NO. 97 - 18 BEING A BY-LAW TO AUTHORIZE THE SALE OF LANDS (Part of the east half of Lot 36, Concession 1 E.P.R., Township of Oro-Medonte, (formerly Township of Oro), County of Simcoe, designated as Parts 11 and 12 on Plan 51R-16674) e WHEREAS the Municipal Act, R.S.O. 1990, c.M.45, Section 191 and Section 193, as amended, authorize a Council of a municipality to dispose of surplus real property in accordance with the provisions of a by-law passed by the Council establishing procedures governing the sale of such real property; AND WHEREAS the Council of the Corporation of the Township of Oro- Medonte passed By-law No. 96-35 pursuant to Section 193 of the Municipal Act on the 17th day of April, 1996, being a by-law to establish procedures for the disposal of the surplus real property owned by the Municipality; AND WHEREAS Council has received an unsolicited offer to purchase the lands described in Schedule "A" to this By-law from 689328 Ontario Ltd. which Council proposes to accept in accordance with Section 6 of Schedule "A" to By-law No. 96-35; AND WHEREAS Council has obtained an appraisal of the value of the property described in Schedule "A" to this By-law in accordance with Section 3 of Schedule "A" to By-law No. 96-35 and has caused a notice of a proposed sale of the said property to be posted and published in accordance with Section 1 of Schedule "A" to By-law No. 96-35; AND WHEREAS Council has previously caused notice of intention of stop up, close and sell the lands described as part of the east half of Lot 36, Concession 1 E.P.R., Township of Oro-Medonte (formerly Township of Oro) , County of Simcoe, designated as Part 12, Plan 51R-16674 at the time of the passing of By-law No. 93-9 for the Corporation of the Township of Oro-Medonte (formerly the Township of Oro), in accordance with the requirements of Section 300 of the Municipal Act, R.S.O. 1990, c.M.45; AND WHEREAS Council desires to transfer the property described in Schedule "A" to this By-law to 689328 Ontario Ltd. in exchange for a conveyance of property described in Schedule "B" to this By-law; AND WHEREAS Council has received no notice of objection to the proposed property disposal from any party; AND WHEREAS Council therefore deems it expedient to establish procedures for the sale of the lands described in Schedule "A" to this By-law in accordance with Section 6 of Schedule "A" to By-law No. 96-35. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE HEREBY ENACTS AS FOLLOWS: 1. That the disposal of the lands described in Schedule "A" to this By-law, pursuant to the terms of the Agreement between the Township and 689328 Ontario Ltd. in accordance with the unsolicited offer received from 689328 Ontario Ltd., is hereby authorized pursuant to the provisions of Section 6 of Schedule "A" to By-law No. 96-35. The sale of the lands described in Schedule "A" to this by-law to 689328 Ontario Ltd. shall be completed without tendering the property for sale in accordance with Section 4 of Schedule "A" to By-law No. 96-35 or listing the property described in Schedule "A" to this by- law for sale in accordance with the provisions of Section 5 of Schedule "A" to By-law No. 96-35. e e ~ ~ -2- 2. That the consideration payable for the lands described in Schedule "A" to this By-law shall be the sum of $5,000.00. 3. That, as a condition of the transfer by the Municipality to 689328 Ontario Ltd. of the lands described in Schedule "A" to this By-law, the Municipality shall require a transfer to it of the lands described in Schedule "B" to this By-law, which conveyance shall constitute full satisfaction of the consideration payable for the lands described in Schedule "A" to this By-law, as set out in paragraph 2 above. 4. That By-law No. 93-9 for the Corporation of the Township of Oro-Medonte (formerly the Township of Oro) is hereby amended by deleting Paragraph 4 from the said by-law. 5. That the Mayor and Clerk be and are hereby authorized to execute all such documentation as may be required to give effect to the foregoing. 6. That this By-law shall come into force and effect on the date of passing thereof. By-law read a first and second time this 5th day of March, 1997. By-law read a third time and finally passed this 5th day of March, 1997.
