Deputy Mayor Hough called the meeting to order at 5:33 p.m. and explained the public meeting is being held in accordance with Section 34 of the Planning Act, to obtain public comment with respect to a proposed Zoning By-law Amendment Application. The purpose of Application 2018-ZBA-12 is to rezone the subject lands to permit a Motor Vehicle Storage Yard and a Single Family Dwelling. Notice of the Public Meeting was mailed to landowners within 120 metres of the specified site, circulated to the appropriate Agencies and posted on the Township's website on or before June 8, 2018. The following correspondence was received: Township of Oro-Medonte, Manager, Development Engineering dated June 8, 2018; Ministry of Transportation dated June 8, 2018; Enbridge Gas Distribution dated June 14, 2018; Brad Slater dated July 12, 2018. Andria Leigh, Director, Development Services, explained the purpose and effect of the proposed amendment. A PowerPoint presentation was presented. Howard Frost, on behalf of applicant, was present. The following public persons offered verbal comments with respect to the proposed amendment: Josh Morgan, Morgan Planning & Development, on behalf of Tammy and Marty Emery questioned if multiple businesses were going to be held, if all uses were permitted or just the two uses spoken to at the meeting, questioned why the by-law indicated all uses, concerns regarding policy, a landscape plan, a justification plan, headlights at night, noise, security, potential impact of the dug well, the potential of solid wood board fence, a spill management plan to address at the zoning stage, the limit/size of storage yard and the restriction of uses of property to the storage, yard and house. Tammy Emery provided concerns regarding contamination, noise, hours of service, loss of wildlife, contamination of her vegetable garden and water and the potential effect on her family. Claude Michaud, applicant, provided comments regarding owning a business, change of use, erecting a fence, maintaining and cleaning up of the property. (Medonte), Township of Oro-Medonte, 2003-SUB-01 and 2018-ZBA-02 (Craighurst Land Corp.). Deputy Mayor Hough called the meeting to order at 6:00 p.m. and explained the public meeting is being held in accordance with Sections 50 and 34 of the Planning Act, to obtain public comment with respect to proposed Development Applications. The purpose of Application 2003-SUB-01 is for a Draft Plan of Subdivision comprised of 318 single detached residential lots and Application 2018-ZBA-02 proposes to rezone the subject lands from the Agricultural/Rural Zone to the Residential One Exception Zone, Institutional Zone, Environmental Protection Exception Zone and Open Space Zone. Notice of the Public Meeting was mailed to landowners within 120 metres of the specified site on June 15, 2018 and a notice sign was posted on or before June 15, 2018. Matthew Cory, Malone Given Parsons Ltd. on behalf of applicant, was present. Also present was Shawna Dudding and Cheryl Shinduk, Geranium Homes Corporation; Mark Jamieson, BA Consulting Group Ltd.; and Steve Shaver, SCS Consulting Group. A PowerPoint presentation was presented. The following public persons offered verbal comments with respect to the proposed amendment: Sheila Craig questioned who was on the Board of Craighurst Land Corporation and the housing mix formula versus the numbers proposed. Neil Craig provided comments that the notice should include a map, the 42 backyards that will be against his field, a fence row of trees that he would like retained, zoning Page 4 of 19 Development Services Committee Minutes — Thursday, July 19, 2018. suggested changes, sewage treatment questions, the proposed plan of subdivision may be premature due to other outstanding issues, concerns regarding the impact to his property which is actively farmed, no buffer on the plan with respect to his property, seasonal noise, dust and the impact on both sides, increased dumping, trespassing, minimum distance separation should be adhered to, existing pond on northwest side should be removed and trees/shrubs planted, sidewalk linking to Craighurst services, rural character, farming environment considerations and having a sincere interest. Lynette Mader questioned the provision of the road widening, stormwater management ponds, and nutrient run-off. Steve Schaefer, SCS Consulting Group provided comments with respect to erosion, quality controls, and zoning. Sandy Agnew provided comments with respect to developing a complete community and the Craighurst Settlement Area and the emphasis of jobs on the west side. Francis Poole provided questions with respect to what studies have been done for traffic. Mark Jamieson, BA Consulting Group Ltd., provided comments with respect to the turning lanes, reports from additional questions and traffic flow. Judith Banville provided comments with respect to the higher density housing clarification, single family homes and townhomes in the future, safe guards of other development, future process of residents with their own wells and septic systems. Betty Veitch provided comments with respect to the development being planned as a bedroom community and work opportunities would have to be on other quadrants and traffic concerns. Mariana Benitez provided comments with resect to the traffic backlog with respect to the train going through Craighurst, potential density and commuting concerns with Highway 400 and questioned same consideration in the traffic reports. Pamela Cowell provided comments with resect to the wildlife, and questioned if there was a master plan of the entire Secondary Plan. Nigel Cooper provided comments with respect to the character and progress of development, to encourage compromises/enjoyment of the area and concerns that his property would not be landlocked. Brent Hornick provided comments in support of the application, the application looks like a dwelling (not like a garage/shop), made professionally, at the back of the house and the potential to plant additional trees. Bruce Liebold provided comments with respect to setting a precedence, potentially suiting multiples purposes, i.e., a commercial building and a second residence. Manon Liebold provided comments with respect to planning trees, the potential of a business being run and setting a precedence. Bob Campling provided comments with respect to the by-laws outlining dimensions that should be adhered to, being in a residential area and buildings of significant size other than what is in the by-laws. That Report No. DS2018-70, Andria Leigh, Director, Development Services re: Minor Variance Application 2018-A-29, Oro Agricultural Society, 82 15/16 Side Road East be received and adopted. 2. That Minor Variance Application 2018-A-29 by the Oro Agricultural Society, specifically to permit construction of an agricultural building with an interior side yard setback of 4.0 metres and a rear yard setback of 9.0 metres on lands municipally known as 82 15/16 Side Road East, be approved. 3. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Table B4-C of Zoning By-law 97-95, the proposed agricultural building shall otherwise comply with all other applicable provisions of the Zoning By-law; b) That the proposed agricultural building be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; c) That an Ontario Land Surveyor provide verification in writing to the Township by way of survey/real property report prior to the pouring of the footing and if no footing, the foundation, that the proposed agricultural building is no closer than 4.0 metres (13.1 feet) from the interior side lot line and 9.0 metres (29.5 feet) from the rear lot line; and d) That the appropriate Zoning Certificate, Engineered Lot Grading (if required), and Building Permit be obtained only after the Committee's decision becomes final and binding, as provided for within the Planning Act R.S.O. 1990, c.P. 13. e) That the applicant and property owner at 901 Line 7 North enter into an appropriate agreement for the timing of completion of fence repairs as a result of snow damage. 4.
