Take notice thatthe Township of Oro-Medonte deemed the following applicationsto
amend the Official Planand the Zoning By-law“Complete” Applicationspursuant to
th
the Planning Acton the 14day of June, 2018.
Take notice thatthe Development Services Committee of the Township of Oro-
Medonte will hold a Public Meeting on Wednesday September 5, 2018at 5:30p.m.
in the Municipal Council Chambers. The purpose of the Public Meeting is to notify the
public and to obtain public comments on theproposed Amendmentsto the Official
Planand Zoning By-law.
The subject lands are described as Part of Lot 1,Concession 5. A key map illustrating
the location of the subject lands, and a copy of the applicants site plan are included
with this notice.
The purpose and effectof the proposed Official PlanAmendment is toamend the
“Horseshoe Valley –Resort Facility” designation to permit additional permitted uses in
order to permit the development of a commercial plaza on thesubject lands.
The purpose and effect of the proposed Zoning By-law Amendment is torezone the
subject lands from the “Agricultural/Rural Exception 15 (A/RU*15) Zone” to “Local
Commercial Exception (LC*#) Zone” to permit the development of a commercial
plaza.
Any personmay attend the public meeting and/or make written or verbal representation
either in support of, or in opposition to, the proposed Official Planand Zoning By-law
Amendments.Written comments by any person unable to attend the meeting should be
mailed/faxed/e-mailed to the Director, Development Services, The Corporation of the
Township of Oro-Medonteto be received no later than 12:00 p.m. noon on Wednesday,
September 5, 2018.Please ensure that you include your name and address so that you
may be contacted if necessary.
If a person or public body does not make oral submissions at the public meeting or
make written submissions to the Director, Development Services, The Corporation of the
Township of Oro-Medontebefore the proposed Official PlanAmendment is adopted or
refusedand/or the Zoning By-law Amendment is passed or refused, the person or public
body is not entitled to appeal the decision of the Council of the Township of Oro-
Medonteto the Local Planning Appeal Tribunaland may not be added as a party to the
hearing of an appeal before the Local Planning Appeal Tribunalunless, in the opinion of
the Tribunal, there are reasonable grounds to do so.

viewing/inspectionbetween 8:30 a.m. and 4:30 p.m. at the Township of Oro-Medonte
Administration Buildingand available on the Township’s website www.oro-

Good Afternoon Andy,
Thank you for the opportunity to provide comments on the proposed commercial development
on a currently vacant parcel of land (Roll # 43460100023000) located at the south-west corner of
the intersection of Horseshoe Valley Road and Line 4 North in the Township of Oro-Medonte.We
understand an Official Plan and Zoning By-law Amendment is required and the development
would be subject to a Site Plan process under the Planning Act.
The Nottawasaga Valley Conservation Authority (NVCA) has reviewed the documentation
submitted in support of the above noted applications and based upon this information and a
review of environmental information for the area, the Nottawasaga Valley Conservation
Authority (NVCA) would have no objection to the proposed applications. Further, we note the
development will not be located within:
a flood susceptible area;
a hazardous site (characterized by unstable soils or bedrock);
an erosion hazard area, or;
an area regu
Alterations To Shorelines and Watercourses Regulation (Ontario Regulation 172/06).
Lastly, the NVCA is also prepared to defer the review of stormwater management to the
municipality.
Fees
Effective March 2016, the NVCA has a new fee schedule. A copy of the policy and associated fee
schedule can be found online using the following link:

The review fee for the proposed zoning by-law amendment and/or official plan amendment is
$500.

I am voting against the approval of the above noted amendments to the Official Plan and
Zoning By-Law of the Township of Oro-Medonte, Part of Lot 1, Concession 5.
Iͪ Surrounding the natural beauty of Horseshoe Valley, the areas of Barrie, Orillia,
Midland, Midhurst and Craighurst will burst and continue to burst with urban development.
This natural landscape is vital to preserving regional ecosystems and slow global warming amid
urban growth. The tranquility of the trails and visual beauty of this area alone contributes to
the reduction of health care costs by offering individuals living in the surrounding areas a
tranquil environment for a multitude of outdoor physical family activities.
A plaza with over 150 parking spaces would be the beginning of the end, setting precedent for
Simply taking a stroll around our local resort or along Landscape Drive is proof enough to
demonstrate how lack of vision, poor planning and poor execution of a plan, can quickly cause
the demise of what was once a beautiful, cohesive, harmonious community.
There is an opportunity for success in this beautiful environment. A success that rests simply
upon management.

My concern is with the location of the stairs. They are even closer to the road then the
6 meter front yard setback. It looks like they are about 3 meters set back from the road.
I feel, that in an accessory building of 1784 sq ft there should be lots of room to locate
the stairs inside the building.

Development Engineering has issue with the lack of an appropriate Delivery / Loading
Space due to the lack of turning movement
within the parking lot and the lack of turning movement incorporated for the garbage
collection vehicle.
The Parking Lot should be configured such that delivery / collection vehicle movements
are included in the overall Site Plan design.
Development Engineering has No Objection to a minor reduction in parking stall
numbers to accommodate the vehicle turning and delivery
Movements within the site.

Thank you for circulating the Lake Simcoe Region Conservation Authority (LSRCA) on the above-noted captioned
application. We understand the applicant is seeking relief from Zoning By-law 97-95, for a 14.3 sq. m. deck extension
within 13.1m of the shoreline whereby the By-law requires a 20m setback. The LSRCA has reviewed this application
in the context of the Provincial Policy Statement (PPS), the Lake Simcoe Protection Plan (LSPP), the Growth Plan for
the Greater Golden Horseshoe (Growth Plan) and Ontario Regulation 179/06 under the Conservation Authorities Act.
Based on our review of the submitted materials, the deck extension is proposed within an area regulated by the
LSRCA under Ontario Regulation 179/06 for being susceptible to shoreline hazards and proposed within the
vegetation protection zone of Lake Simcoe as per the LSPP. As a result, we recommend that any approval of this
application be subject to the following conditions:
1. That the proposed deck extension shall not include habitable space and shall not be enclosed above or
below the deck surface.
2. That a planting plan be provided to the satisfaction of the LSRCA prior to the issuance of a municipal permit.
3. That a permit from the LSRCA be obtained for development in the area regulated by the LSRCA under
Ontario .Regulation 179/06.

Thank you for circulating the Lake Simcoe Region Conservation Authority (LSRCA) on the above-noted captioned
application. We understand the applicant is seeking relief from Zoning By-law 97-95, for the maximum boathouse
height. The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the Lake
Simcoe Protection Plan (LSPP), the Growth Plan for the Greater Golden Horseshoe (Growth Plan) and Ontario
Regulation 179/06 under the Conservation Authorities Act.
The subject property appears to be located on the shoreline of Lake Simcoe. As a result, part of the property is
regulated by LSRCA under Ontario Regulation 179/06 for being susceptible to shoreline hazards such as flooding and
erosion (including steep slopes). Further, the property is identified as being within the Natural Heritage System of
the Growth Plan, and it appears to contain and/or be adjacent to key natural heritage features, key hydrologic
features, key hydrologic areas, and associated vegetation protection zones as per the Growth Plan and/or LSPP.
Based on our review of the submitted material, we recommend that any approval of this application be deferred
until the following information is addressed to our satisfaction:
1. That our review fee for this application ($500) be provided.
2. That the applicant demonstrates that the proposed structure will not contain habitable space and be
serviced.
3. That the applicant demonstrates that the structure is a boathouse. It is unclear from the submitted
information how the structure would be used for boat storage.
4. That a Natural Heritage Evaluation (NHE) be submitted to the satisfaction of the LSRCA, as per Chapter 6 of
the LSPP (e.g. Designated Policies 6.3, 6.7, 6.8, 6.11) and the Growth Plan (Section 4.2.4, 4.2.3, 4.2.4). A
planting and restoration plan should be included in the NHE for the shoreline, slope and/or other areas of
the property where there is opportunity for enhancement.

5. That a Geotechnical Report be completed by a qualified professional, in accordance with MNRFs Technical
Guidelines, to confirm the slope will be stable in a post development situation and provide bioengineering
solutions to the maximum extent possible. All works that are proposed in the erosion hazard, such as the
construction of the boathouse, shoreline access, and grading, must be addressed in this report.
Please note, a permit from our office will be required prior to any development (including site alteration) within the
area regulated by the LSRCA under Ontario Regulation 179/06.

This letteris to provide input on the above minor variance application - Public Hearing date
Sept. 5, 2018.
As neighbours, it is in our opinion, the applicant is proposing the construction of a new
boathouse with significant changes, not minor ones to the Townships Zoning By-law 97-95.
We respectfully submit several questions and comments for your consideration.
First Question:Is the application minor in nature?
The proposed height to first roof top (28.5 ft.) is a 94% increase to the townships official plan
permitted allowance of 14.7 ft.
The proposed height to the second roof top (33.89 ft.) is a 130 % increase to the townships
official permitted allowance of 14.7 ft.
The proposed total deck footprint (933.58 sq. ft.) is 24% increase to the townships official
permitted allowance of 753 sq. ft.
Given that by definition a minor variance is considered to be a small change to the Zoning By-
law, we believe this application does not meet this definition. In fact, given the significant
percentage increase proposed by the applicant to each by-law section, this variance in our
opinion is deemed Major in nature.

oes the variance conform to the general intent of the Zoning By-law?
Th
e adjacent finished boathouse next to the proposed boathouse, as stated in the planning
report is 5.7 m. or 18.7 ft. in height. The proposed boathouse is to have a top roof of 8.7 m or
28.5ft.; that would be a 52% height increase over the adjacent boathouse ( and the second roof
top of the elevator would bring it to an 81% increase over the adjacent boathouse) On this basis
I would comment that this proposed boathouse would greatly dominate the current shoreline
elevations, dominate the adjacent structure and ultimately impacting the character of the
shoreline. On this basis, we believe it does not conform to the general intent of the Zoning By-
law.

Second Question: Why is a variance of this magnitude necessary? What are the practical
difficulties, the hardships or the circumstances the applicant states for not carrying out the
current height and footprint regulations of the Zoning By-law for a new boathouse build?
It is totally understandable that given the nature of the Lake Simcoe shoreline and its sloping
nature that minor variances are sometimes deemed necessary. This being said, there is no
reasons given by the applicant for building such a structure significantly larger than what the
zoning by-law permits.
Third Question: What is intended usage of this structure? Is this a Boathouse – as there are no
doors to allow boats in and out of water; or is this for storage or for sitting on three levels? Or is
this structure to provide sitting for future land development use? Again, this begs the question
why is a variance of this magnitude is necessary for a single house dwelling?
As well, what is the height of the elevator – based on measurements supplied by the applicant,
on page one, the roof top being proposed is 8.7 m and height to top of elevator is 10.33m, so
that makes the elevator 1.6 m (5 feet 3 inches) in height. So, is this elevator to be used for
storage, as an average height person would not be able to fit?
And one final note: With respect to the elevator roof top – if that height is approved 10.3 m.,
what prevents the owner to continue to build a finished total roof top of that approved
variance height in the future.

The subject property appears to be located on the shoreline of Lake Simcoe. As a result, part of the property is
regulated by LSRCA under Ontario Regulation 179/06 for being susceptible to shoreline hazards such as flooding and
erosion (including steep slopes). Further, the property is identified as being within the Natural Heritage System of
the Growth Plan, and it appears to contain and/or be adjacent to key natural heritage features, key hydrologic
features, key hydrologic areas, and associated vegetation protection zones as per the Growth Plan and/or LSPP.
Based on our review of the submitted material, we recommend that any approval of this application be deferred
until the following information is addressed to our satisfaction:
1. That the applicant demonstrates that the proposed structure will not contain habitable space and be
serviced.
2. That the site plan be amended to clarify the existing and proposed development. Please note, the proposed
terraced retaining walls would not be permitted under the LSPP and Ontario Regulation 179/06.
3. That photos of the slope / shoreline be submitted to confirm the existing conditions.
Please note, a permit from our office is required prior to any development (including site alteration) within the area
regulated by the LSRCA under Ontario Regulation 179/06.
