That Report No. DS2018-056, Catherine McLean, Planner re: Consent Application 2018-B-09, Dennis, Kathleen, Bethany, Connor and Benjamin Knapp, 76 Lakeshore Road East be received and adopted. 2. That the Development Services Committee grant provisional consent to Application 2018-B-09 to permit the creation of a new lot consisting of a severed parcel having an area of approximately 0.087 hectares (0.22 acres) and a frontage of approximately 19.05 metres (62.5 feet); and a retained parcel consisting of a lot area of approximately 0.186 hectares (0.46 acres) and a frontage of approximately 30.5 metres (100.17 feet), subject to the following conditions: a) That the applicant signs the Township's Memorandum of Understanding by which the applicant acknowledges the requirements and timing of matters that may include: payment of development charges, payment of cash in lieu of parkland, detailed design of a building or septic system, engineered lot grading, and water and sanitary servicing, on either the vacant severed or vacant retained parcel. b) That the applicant apply for and obtain approval of Minor Variances to permit a reduced lot frontage and lot area on the severed parcel and to permit a reduced lot area on the retained parcel; Page 6 of 13 Development Services Committee Minutes — Tuesday, June 5, 2018. c) That the Applicant transfer to The Corporation of the Township of Oro-Medonte ("Township"), in fee simple, free and clear of all liens and encumberances, a 5 metre by 5 metre daylighting triangle at the corner of Lakeshore Road E. and Sunnyside Ave. dimensioned to the satisfaction of the Director, Operations and Community Services. All costs associated with the preparation and registration of the Transfer and Consolidation Application, including costs relating to surveying, legal fees, and disbursements, agreements, HST, etc. shall be fully borne by the Applicant. d) That the applicant submit information, to the satisfaction of the Chief Building Official, verifying that the severed parcel may be capable of accommodating an appropriate private on-site sewage disposal system. e) That the applicant pay to the Municipality a fee of $2,000 as a parkland contribution for each residential lot to be created as cash -in -lieu of a parkland contribution pursuant to By-law 2006-50 under the authority of subsection 53(13) of the Planning Act, R.S.O. 1990 c. P. 13; f) That one copy of a Registered Reference Plan of the severed lands prepared by an Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer. g) That the applicant's solicitor prepare and submit a copy of the proposed conveyance for the parcel severed, for review by the Municipality. h) That all municipal taxes be paid to the Township of Oro-Medonte. i) That the Certificate of Consent be issued utilizing Form 2, under Section 53(42) of the Planning Act R.S.O. 1990, without qualification. j) That the conditions of consent imposed by the Committee be fulfilled within one year from the date of the giving of the notice of decision (Approval shall lapse where the conditions have not been fulfilled within one year of being imposed and/or two years from the date of the certificate if the transaction has not been finalized.).WARNING: Failing to fulfil the conditions within the above -noted statutory periods (Sections 53(41) & 53(43), the Planning Act R.S.O. 1990) shall cause the application to lapse and render this Decision null and void. 3. That Report No. DS2018-057, Andy Karaiskakis, Senior Planner re: Minor Variance Application 2018-A-24, Chad Mooney & Mariette Kouwenberg, 773 Woodland Drive be received and adopted. 2. That Minor Variance Application 2018-A-24 by Chad Mooney & Mariette Kouwenberg, specifically to permit the construction of a 2 -storey single detached dwelling with a front yard setback of 3.04 metres (9.97 feet) to the attached garage and setback from the average high water mark of Lake Simcoe of 12.84 metres (42.12 feet) to the proposed deck and 15.43 metres (50.62 feet) to the proposed dwelling on the lands known as 773 Woodland Drive, be approved. 3. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Table B1 and Section 5.30, the proposed dwelling shall otherwise comply with all other applicable provisions of the Zoning By-law; b) That the proposed dwelling be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; c) That an Ontario Land Surveyor provide verification in writing to the Township by way of survey/real property report prior to the pouring of the footing and if no footing, the foundation, that the proposed dwelling is no closer than 15.43 metres (50.62 feet) from the average high water mark of Lake Simcoe, the proposed deck is no closer than 12.84 metres (42.12 feet) from the average high water mark of Lake Simcoe, and the attached garage is no closer than 3.04 metres (9.97 feet) from the front lot line; Page 8 of 13 Development Services Committee Minutes — Tuesday, June 5, 2018. d) That the applicant satisfy the conditions outlined in the Lake Simcoe Region Conservation Authority letter dated May 22, 2018; e) That the applicant maintains the existing vegetative buffer on the interior property lines, or replace with a similar vegetative buffer; f) That the appropriate Zoning Certificate, Engineered Lot Grading Plan and Building Permit be obtained from the Township only after the Committee's decision becomes final and binding, as provided for within the Planning Act R.S.O. 1990, c.P. 13. 4.
