BY-LAW NO. 97.. 45
Being a By-law to Enter into an Agreement With the Warminster Volunteer
Community Hall Committee and the Optimist Club of Warminster
WHEREAS the Municipal Act, R.S.O. 1990, c.MA5, as amended, provides that By-laws
may be passed by Councils for maintaining, operating or managing parks, recreational
areas, playgrounds, athletic fields and community recreation centres;
AND WHEREAS the Township of Oro-Medonte is in ownership of a Community Hall, a
Park, a ball diamond and a soccer field located in the Hamlet of Warminster;
AND WHEREAS the Volunteer Groups being the Warminster Volunteer Community
Hall Committee and the Optimist Club of Warminster desire to enter into an Agreement
with the Township of Oro-Medonte for the maintenance, operation and management of
the Community Hall, park, ball diamond and soccer field located in the Hamlet of
Warminster;
AND WHEREAS the Township of Oro-Medonte deems it appropriate to enter into an
Agreement with the Warminster Volunteer Community Hall Committee and the Optimist
Club of Warminster for the purposes of maintenance, management and operation of the
Warminster Community Hall, park, ball diamond and soccer field;
NOW THEREFORE the Council of The Corporation of the Township of Oro-Medonte
enacts as follows:
1. That the Mayor and Clerk be authorized to execute the Agreement attached
hereto as Schedule "A".
2. That this by-law come into force and effect on its final passing.

hereinafter referred to as the "Township", the PARTY OF THE FIRST
PART,
-AND-
THE WARMINSTER VOLUNTEER COMMUNITY HALL COMMITTEE
-AND-
THE OPTIMIST CLUB OF WARMINSTER
hereinafter referred to as the "Volunteer Groups", the PARTIES OF
THE SECOND PART,
WHEREAS the Committees will act as agents of the Township under the
direction of the Director of Recreation and Community Economic
Development for the operation and development of recreational
facilities in accordance with Municipal By-laws and guidelines and
related Provincial, and Federal Legislation in Warminster, namely
the Community Hall, Park, Ball Diamond and Soccer Fields;
AND WHEREAS, the Township is in ownership of the the above-
mentioned recreational facilities in the Hamlet of Warminster;
NOW THEREFORE in consideration of the premises and of the covenants
and agreements herein contained, the parties hereto covenant and
agree as follows:
1. The Committees will be responsible to the Township of Oro-
Medonte Council for the protection, management, development
and financial accounting in accordance with Municipal By-laws
and guidelines, and related provincial and Federal
Legislation, with respect to the recreation facilities in the
Hamlet of Warminster, owned by the Township;
2. The Committess will each appoint a representative to the
Township Community Hall/Parks Association to promote the
interests of Warminster area residents for improved
recreational facilities;

3. It is accepted that the facilities described above are
primarily intended for the use of all Warminster area
residents of all ages, but not necessarily restricted to local
use. In the event of a conflict of interest, priority will be
given to individuals or groups from the Warminster areai

Monies derived from the rental of the Community Hall, Park,
Ball Diamonds and Soccer Fields will be deposited with the
Township according to the guidelines (established June, 1995)
of the Community Halls/Parks Associationi
5. The Township and the Committees agree that the Community Hall
Committee of Warminster will manage and operate the Community
Hall according to Township guidelines.
6. The Township and the Committees agree that the Optimist Club
of Warminster will manage and operate the park facilities
subject to the following conditions:
Park, Ball Diamond & Soccer Fields
Two members of the Optimist Club will be named to the Park
Management Sub-committee and will be responsible for:
a) Approval of facility permits for requested use of
the park, ball diamond, soccer fields, and washroom
facilities according to Municipal guidelinesi
b) Maintaining the washroom facilities, ball diamonds,
soccer fields, park area and parking areai
c) Operating the snack bar and boothi
d)
Identifying ongoing misconduct
problems to the Townshipi
e) Permitting facility use of the park, ball diamonds
and soccer fields for any other community function
such as Children's Day Camp, skating, etc., that
may be developedi
and
security
f) Submitting to the Township a proposed budget for
the park, ball diamond and soccer field on an
annual basis, the due date of said submission to be
set each year by the Director of Recreation and
Community Economic Developmenti
g) Submitting to the Township, requests for capital
project assistance.

The Committee and Optimist Club agree that the Township will
be responsible for:

a)
Development of policy and procedures as it relates
to the management of the Park and Community hall;
b) Development of a maintenance standard for Park and
Community Hall operation;
c) Inspect, record, and repair and safety deficiencies
of the ball diamond, playground, soccer fields and
Community Hall.
d) Proper wording, installation, maintenance and cost
of all park signs.
7. This Agreement will be in effect for a period of five (5)
years and may be extended as agreed by all parties. This
Agreement may be terminated by anyone party with a thirty
(30) day written notice.
IN WITNESS WHEREOF the parties hereto affix their signatures duly
authorized by their proper signing officers on their behalf.
