Identification From the Public of an Agenda Item of Interest: Provides an opportunity for members of the public to identify an agenda item which the public member may request be brought forward and considered earlier in the meeting. 11. Notes Notes The back part of the building was the original tavern built in 1854, by William Heard. This is now covered with white siding. The Heard Tavern was the meeting place for discuss plans for a public school in 1859 as well as plans were discussed for the Oro Fair. The brick portion of the tavern was built in 1882 by Archibald Campbell. in the 1950rs the property was bought by Sam Terry who installed gas pumps and ran a garage service. Principle of integration means services that allow people with disabilities to fully benefit from the same services, in the same place and in the same or similar way as other customers. Integration means that policies, practices and procedures are designed to be accessible to everyone including people with disabilities. At times when integration does not serve the needs of all people with disabilities, it may be necessary to use alternate measures to provide goods or services. Providing services means providing goods or services to members of the public Public Sector includes provincial government, municipal government, universities, colleges, hospitals, health care, school boards, and public transportation organizations. Service Animal means any animal used by a person with a disability for reasons relating to the disability where it is readily apparent that the animal is used by the person for reasons relating to the disability; or where the person provides a letter from a Regulated Health Professional or the Attorney General of Canada confirming that the person requires the animal for reasons relating to the disability; or a valid identification card signed by the Attorney General of Canada or a certificate of training from a recognized service animal training school. Support person means a person who accompanies a person with a disability in order to assist the person with communication, mobility, personal care, medical needs or with access to goods and services. Requirements Under the Election Accessibility Plan The Township is offering three methods of voting: Vote by paper ballot with tabulators. Vote by internet. Vote by phone. .40t The ability to offer three voting methods is a unique opportunity for an election, and provides the voter with multiple options to vote that suit their needs and abilities. Voters have the ability to vote anywhere that has a phone or internet connection from a device they would already own that meets their specific needs. All employees and election personnel shall be trained, and have regard to, accessibility policies, procedures and plans, which include the Election Accessibility Plan and the Accessibility Policy. The underlying assumptions are consistent with the 2013 EDC analysis in that the background study and calculations were based on a jurisdiction wide analysis, with a uniform rate applied equally to all types of residential development. The charges are based on a 90% residential allocation and 10% non-residential allocation. The background study contains a sensitivity analysis that shows a range of EDC charges based on allocations from 0% non-residential to the maximum allowable non-residential rate of 40%. In addition, the background study also provides a range of charges based on dwelling types to illustrate the differences in the charge between uniform and differentiated rates. The residential housing forecast is used principally to project student enrolment that will be generated from new residential development. The residential forecast for this EDC analysis totals more than 92,000 units (including seasonal units). This is more than 16,000 units greater than the number of units that was assumed in the 2013 EDC forecast. While there are considerably more units in the 2018 EDC forecast, it is important to note that in the 2013 forecast almost 62% of all units were low density whereas in 2018 only 53% are low density and 40% are medium or high density. In addition, in 2013 there were just over 3,500 units forecast for seasonal uses while in 2018 there are almost 6,000 seasonal units included in the forecast. The increase in units has resulted in increased enrolment projections and site needs in some areas of the County; however, the higher density developments have mitigated the number of students projected in some cases. The current SCDSB EDC is $1,311 per residential unit and $0.35 per square foot of gross floor area ("GFA") for the non-residential charge. For the SMCDSB, the residential charge is $448 per dwelling unit and $0.12 per square foot of GFA. The total combined charges for both school boards is currently $1,759 per residential unit and $0.47 per square foot of GFA. The proposed 2018 EDC rates have escalated fairly significantly for both school boards. The proposed charges for the two school boards total $5,064 per residential unit and $1.37 per square foot of GFA — this is an increase of 188% on the residential side and almost 192% on the non-residential side. The SCDSB proposed EDC is $3,591 per dwelling unit and $0.97 per square foot of GFA and the SMCDSB proposed EDC is $1,472 per dwelling unit and $0.40 per square foot of GFA. While the proposed EDC increases are significant, it is important to note that the price of land in Simcoe County has escalated significantly since the Boards passed their current by-laws in 2013. At that time, the average price of land in Simcoe County, based on then current appraisals, was approximately $305,000 per acre (using an average of appraised values throughout the County). The 2018 appraisals commissioned by the Boards indicate that the average price per acre is now closer to $800,000 per acre. For example, in 2013 land in Barrie was valued at a little less than $317,000 per acre and land in Bradford West Gwillimbury was appraised at approximately $430,000 per acre. Background: The Alcohol and Gaming Commission (AGCO) is responsible for administering the lottery licensing program in the Province. Municipalities and the AGCO are responsible for issuing lottery licenses to eligible charitable and religious organizations which may raise funds through licensed lottery events. The Orillia Fish and Game Conservation Club (OFGCC) is a volunteer organization that was founded in 1947 initiating conservation projects in the Orillia area. OFGCC began conducting 50150 draws at Burl's Creek in 2006. These draws are held annually in June and September during the Barrie Automotive Flea Markets. Per OFGCC's website, these draws are a major fundraiser for OFGCC, raising money for the many sponsored conservation projects. In addition to funds raised for conservation, a portion of the funds are donated to other local charities such as St. John Ambulance and the Orillia Corporate Services May 9, 2018 Report No. CS2018-13 Page 1 of 4 Page 120 of 158 Soldier's 9h'4ervices... draws in 2006, the Club has made charitable donations close to $100,000.00. Council has previously waived the Financial Guarantees/Letter of Credit component, per the AGCO's policy, for OFGCC's 50150 draws yearly since 2012. Staff received correspondence dated April 23, 2018 from John Kranjec, Past President & Chairman, OFGCC, to request the same consideration for the 2018 draws (Attachment #1). The purpose of this report is to advise Council of the AGCO's licensing policy requirements and make a decision with respect to the Financial Guarantees component for the said draws held in the Township. Analysis: AGCO Lottery Policies provides that, in order to safeguard the interests of both the public and the licensee, and to ensure that all prizes can be awarded, the licensing authority (the Township), may require that an organization submit a financial guarantee covering the total value of prizes. However, the licensing authority must require a financial guarantee for lotteries with a total prize value of $10,000 or over, including taxes. Acceptable financial guarantees include: (1) an irrevocable letter of credit from a recognized financial institution, or (2) a bank draft or money order. Additional requirements are outlined in the AGCO Lottery Licensing Policy Manual, Sections 3.6.7, Financial Guarantees and 3.6.8 Letters of Credit, enclosed respectively as Attachments 42 and #3. Staff confirm that all past licenses were issued and that the Township did not receive any complaints regarding OFGCC's process of running the lotteries or the lottery applications. Due to OFGCC's long standing history, process of conducting and success of the lotteries, there is an option for the Township to waive this financial requirement. Accordingly, the potential total, if the June 8, and 9 draws are not correctly processed, could be up to a maximum of $25,000. However, staff have received written confidential correspondence dated December 31, 2017 confirming that OFGCC does have liquid funds to cover any indebtedness that OFGCC may be responsible for in relation to the granting of the submitted licenses. FINANCIAL GUARANTEES In order to safeguard the interests of both the public and the licensee, and to ensure that all prizes can be awarded, the licensing authority may require that an organization submit a financial guarantee covering the total value of prizes. The licensing authority must require a financial guarantee for lotteries with a total fixed prize value of $10,000 or more, including taxes. When the total fixed -prize value is $10,000 or more, the licensing authority requires an irrevocable standby letter of credit as the form of financial guarantee. (See Section 3.6.8, "Letters of credit;' for further information.) Where deemed appropriate, the licensing authority may also require a financial guarantee for lotteries with a fixed prize amount below $10,000 where the prize is a percentage of the gross ticket sales. Acceptable forms of financial guarantees are: an irrevocable standby letter of credit from a recognized financial institution acceptable to the licensing authority; • a bank draft or money order. The Registrar may specify the form of financial guarantee that must be provided. Guarantees for municipally issued licences must be made payable to the municipality and guarantees for provincially issued licences must be made payable to the Minister of Finance. A guarantee must begin on the date of the licence application and expire no sooner than 45 days after the licence expiry date. The financial guarantee must indicate the purpose for which it was issued and must be in a form acceptable to the licensing authority. If a licensee is unable to award the prizes approved by the licence, the licensing authority may draw upon the financial guarantee to ensure that the prizes are awarded. The licensing authority will return the financial guarantee to the organization as soon as the organization has distributed all prizes and submitted the list of winners and the required financial reports. Therefore, it is in an organization's best interest to fulfil these obligations as soon as possible. In the case of municipal licences, the municipality must inform the Registrar if the licensee is unable to award the prizes as approved in the licence. CHAPTER 3: GENERAL LOTTERY LICENSING POLICIES 3.6.8. LETTERS OF CREDIT With the exception of 50/50 draws, licensing authorities must obtain irrevocable standby letters of credit for lottery licences with a total prize value of $10,000 or greater, including taxes. A licensing authority may also require a letter of credit for a lower prize amount. A letter of credit or other financial guarantee may be required for 50/50 draws where deemed appropriate. The letter of credit must: • be issued by a recognized financial institution, • be made payable on presentation of the original letter of credit at the issuing financial institution, • cover the full value of all prizes offered, including any bonus prize, • permit partial draws (that is, can be cashed in part), • be valid for a minimum of 45 days after the licence expiry date, and • indicate the purpose for which it was issued. The licensing authority may accept a letter of credit set up and paid for by a third party that permits draws to secure the licensee's obligations. A letter of guarantee is not an acceptable financial guarantee. A letter of credit must be made payable independent of any occurrence of default on any obligation by the licensee. Payment under a letter of credit must not require the Minister of Finance or municipal licensing authority to provide a statement that amounts paid will be retained or used in connection with any obligation or pursuant to any agreement between the licensing authority and the licensee. The licensing authority will return the letter of credit to the licensee once the licensee has distributed the prizes and submitted the list of winners and a financial report. If a licensee is unable to award the prizes as approved on the licence, the licensing authority may draw upon the letter of credit to ensure that the prizes are awarded as approved on the licence. A municipality must inform the Registrar if a licensee is unable to award the prizes. A licensee's inability to award prizes may have implications for the licensee's future applications. 3.6.9. STANDARD FINANCIAL REPORTS Licensees must complete accurate standard financial reports for each lottery event. The reports must be filed with the licensing authority in accordance with the reporting requirements of the terms and conditions of the lottery licence. On this end, the volunteers and board of the Coldwater Canadiana Heritage Museum have already held several meetings to plan and organize the Museum's 2018 season. Once again, we'll be serving our deluxe pancake breakfasts every Saturday morning in May; a special Mother's Day Tea on May 121h should also be popular. On June 2nd, we have organized an Estate, Yard and Plant Sale to coincide with Coldwater's community -wide yard sale. Later in the month, we'll be hosting six talented artisans during the weekend -long Coldwater Area Studio Tour (June 23-24). Our annual Heritage Day celebration will occur on Sunday, July 15th. Once again, we will be holding a silent auction. Since 2015, we have come to rely on this event to raise much-needed funds which help cover the day-to- day costs associated with keeping the museum open for another season. At last year's Heritage Day, you had mentioned to a couple of our board members that you were aware of some contacts who might be willing to donate an item or service to our silent auction. We recorded this fact in our "notes for 2018 auction", and as I'm coordinating the auction again this year, getting an early start on this end of things is quite imperative. Our volunteers, families and friends have all been extremely supportive with donations to our auction over the past three years and several have already committed things for this year. Would you be willing to pass on the names of any of your contacts or would you be able to request an item or service on our behalf from them? Oro-Medonte Township is host to several County owned forest tracts, some of which appear to have found their way on at least one occasion alongside other forests as potential sites for development. The Friends of Simcoe Forests is an award winning not for profit organization. Our mission is to inform and unite all persons interested in the conservation of our Simcoe County forests. Our experiences and encounters with people and communities throughout this County point quite clearly to a very strong desire for protecting and preserving the County forest tracts, not developing them. It appears as though these forests are being viewed for their land value while greatly under valuing the ecological and social benefits these forests provide to our communities and the planet as a whole. An example of this is the Freele Tract in Springwater Township, chosen by the County of Simcoe as the preferred site to build what is now being referred to as an Environmental Resource Recover Centre (ERRC). Constituents throughout this County are struggling to understand how Simcoe County forests came to be viewed by our elected officials as potential sites for infrastructure and Industrial use. This facility has been proposed by the County of Simcoe to be located within the Simcoe County Forest, within an area known as the Freele Tract. Our purpose in writing at this time is to inform MMAH of the known significance of the natural heritage system at the site and in its vicinity, based on our review of documents prepared in support of the facility by GHD Ltd., our own site reconnaissance, and observations of others affiliated with the Friends of Simcoe Forests Inc., including Mr. Bob Bowles, a highly respected field scientist who is also engaged by the FSF Inc. We note that the Province has published its own Regional Natural Heritage System (RNHS) mapping that will form the basis of planning under the Growth Plan (2017), and under the Greenbelt Plan (2017). On-line mapping of this system currently indicates the County's preferred ERRC site is located within the RNHS, with woodland cover throughout the site, and unevaluated wetlands in the northeast corner of the site. Based on the GHD studies and reconnaissance on behalf of FSF Inc., we believe that the following Provincial Policy Statement categories of natural heritage features are present on the site: Significant Woodlands — the site includes natural forest (upland deciduous forest and swamp) as well as plantations that are all in an advanced stage of succession towards mixed natural forest with associated understorey flora typical of natural forest. At least 21 species of area -sensitive birds (based on MNRF criteria) have been documented by GHD, indicating that this forest is part of a larger forested system and the site itself is relatively free of forest edge influences. The forest is located on varied terrain, ranging from low-lying areas with vernal pools, to significant sandy feature deposits (the latter directly under the proposed ERRC). Significant Wetlands — the site contains two areas of wetlands with swamp and marsh cover; the RNHS mapping shows the northeast component; a second area of forested swamp is located in the southeast corner of the site, tied to a seasonal headwater watercourse. Vernal pools are present in both areas of wetland (see Significant Wildlife Habitat). These wetlands are not currently evaluated, but given their connection to offsite wetlands, and the documented presence of significant and diverse biota, we believe that it is quite feasible that they would score as a Provincially Significant Wetland. Significant Wildlife Habitat (SWH) —the following categories of Significant Wildlife Habitat, per MNRF SWH Criteria Schedules for Ecoregion 6E (2015): • Amphibian Breeding Habitat (Woodland) which is present in both the northeast and southeast wetlands; MNRF guidelines recommend a 230 m buffer around such features; • Special Concern and Rare Wildlife Species (Western Chorus Frog, Eastern Wood -Pewee, Red - Shouldered Hawk, Wood Thrush); rare plants; • Woodland Area -Sensitive Bird Breeding Habitat, well exceeding the MNRF threshold for significance; • Woodland Raptor Nesting Habitat (potential) as three of six indicator species were documented by GHD; • Bat Maternity Colonies. Notably, in 2016 GHD incorrectly concluded that cultural plantations do not qualify as SWH; this is counter to MNRF Ecoregion 6E Criteria, which do not exclude plantations, and in some cases (e.g. raptor nesting) highlights them as potential habitat. Habitat of Endangered and Threatened Species — Three Provincially Endangered bat species have been documented on the Freele Tract site, and habitat use by these species includes maternity roosts, day roosting and foraging. We believe that there is also potential for Endangered Jefferson Salamander hybrids to be using the vernal pools. Natural Heritage Concerns with the County ERRC Proposal Our June 2017 review of the studies supporting the County's proposal to locate the ERRC in the Freele Tract identified several key concerns regarding natural heritage impacts, including the following: 1. The facility will cause significant fragmentation of the forested NHS, and will degrade the quality of forest. We estimate that approximately 18 ha of forest interior will be eliminated. 2. The proposed facility is within identified Significant Woodlands, as recognized in the County Official Plan (2016), and the Province's Regional NHS. 3. Habitat for Endangered Species at Risk will be removed or otherwise impacted. 4. The site contains Key Hydrologic Features and Key Hydrologic Areas as defined by the Province; impacts to these resources are likely, particularly given the ultimate scale of infrastructure development (20 ha) to meet the County's future requirements. 5. Invasive and/or predatory species are typically transported or attracted by recycling waste, based on the experience of established recycling centres. Introduction of such an infrastructure facility into a high -functioning area of the RNHS is clearly a high riskventure that will inevitably affect many sensitive plant and wildlife attributes. 6. Site studies to date have not adequately addressed 'adjacent lands' as defined under the PPS and its supporting documents. The waste facility will have effects capable of extending well beyond the minimum 120 m recommended in the Natural Heritage Reference Manual (2010). The proposed facility will double as a waste handling and fleet maintenance facility. In our opinion the effects of traffic and emergency access cannot be adequately addressed without serious harm to the RNHS and its functions on the site and in its vicinity. 8. Although the proposed facility and access roads will occupy 5.5 ha, the County's "ONE SITE, ONE SOLUTION" study criteria include adequate space for a 20 ha facility as a basic requirement. Therefore significant cumulative effects are considered very likely once the initial facility is established. Conclusions We believe that the County's proposal to place this facility within the RNHS is not consistent with the Provincial Policy Statement or the RNHS policies within the Growth Plan. The area protected under the Greenbelt Plan (2017) may be extended in the future to cover this area of the Oro Moraine; Greenbelt Policy 4.2.1.2(h) would prohibit such a use. We understand that MMA will be serving in a review capacity when Official Plan Amendments and re- zoning applications are put forward by the County and Township. We strongly recommend that the serious implications and precedents affecting the RNHS for the long term be carefully considered by the Province. The Owner acknowledges and agrees that the Owner shall be responsible for the cost of performance of all the Owner's obligations hereunder, unless the context otherwise requires. Every provision of this Agreement, by which the Owner is obligated in any way, shall be deemed to include the words "at the expense of the Owner", unless specifically stated otherwise. The refundable deposit for expenses and actual cost shall be $ 1,000.00. COVENANTS BY THE TOWNSHIP The Township covenants and agrees as follows: a) That the Township has enacted a By-law to permit a 587.5 square metre (6,325 square foot) contractors yard/shop for Scotty's Excavator Service Ltd., described on the Site Plan. b) That the Township agrees that subject to compliance by the Owner with all relevant Municipal By-laws and Provincial Statutes and Regulations, the Owner may proceed to develop the subject lands, as indicated on the Site Plan Drawings, Details and Specifications attached hereto as Schedule "B", subject to the development restrictions contained herein. 3. Owner shall be on and subject to the following terms and conditions: a) Site Plan The use and development of the subject lands shall be in accordance with and as set out on the Site Plan Drawings, Details, Reports and Specifications, attached hereto as Schedule "B". b) Lightinq All on-site exterior lighting shall be L.E.D., directed downward and internal to the site and shall be in accordance with "Dark Sky Friendly" lighting design. Designs must show that fixtures have no up light focus. As per Township of Oro-Medonte Development Engineering Policies, Process and Design Standards - Section 3.21.9 — Site Lighting C) Parkinq Areas and Driveways All parking areas and driveways shall be constructed as per Township of Oro-Medonte Development Engineering Policies, Process and Design Standards - Section 3.21.11 — Driveways and Parking Areas / Lots. All driveways and internal fire routes shall be required to satisfy Fire Access Route Design as per OBC 3.2.5.6. Parking areas, loading, and access areas shall be kept free and clear of snow and ice and kept adequately drained. The Owner agrees to obtain all necessary approvals from the Ministry of Transportation, County of Simcoe and Township of Oro-Medonte. d) Outside Storage No outside storage shall be permitted between any buildings on the premises and any street. Any other outside storage shall be contained in the fenced compound, as identified on Schedule "B". e) Garbage Storage The Owner agrees to provide suitable storage areas for garbage and waste, as shown on the Site Plan Drawings, Details, Reports and Specifications, and to install and maintain litter containers in and around development on the lands. All metal scrap and associated refuse contained in the fenced compound shall be removed on a weekly basis. f) Garbage Collection The Owner acknowledges and agrees that any Industrial, Commercial and Institutional (I. C. & 1) and multi -unit locations (six (6) units and over) will not receive curb side waste collection services from the County of Simcoe. Each 1. C. & I location and multi -unit residential location will be responsible for their own garbage and recycling disposal. g) Landscapinq h) The Owner shall complete all landscaping and landscaped areas shown on the Site Plan Drawings, Details, Reports and Specifications, attached as Schedule "B", as soon as weather permits, and all grading and sodding required, according to any Engineering drawings submitted, shall be done on all lawn areas. Erosion and Siltation Control The Owner shall take all necessary precautions to prevent erosion and sedimentation of ditches and culverts, slopes, etc., and prevent the migration of all silt, sediment and deleterious materials within the Site Plan, and downstream prior to and during construction. The Owner agrees to maintain all erosion and siltation control devices in good repair until vegetative cover has been successfully established. Tree Removal Identification and protection of approximately 50% of all over -storey trees to promote screening and retention of wildlife/habitat/corridor values. Within this area, no clear cutting of trees will be permitted, although thinning of dense, young tree growth and stems less than 4.0 c.m. diameter at breast height, as well as trees of poor health and quality will be permitted; 4. DEVELOPMENT CHANGES The parties acknowledge and agree that there shall be no changes to this Agreement or the Schedules attached hereto, unless and until such changes have been approved by all parties. It is the intention of the parties that material amendments to this Agreement be properly recorded. Such amendments may take the form of a registered Amending Agreement, an unregistered Agreement, exchange of correspondence, Memorandum of Confirmation, or notations on Engineering drawings. The nature of such record of amendment shall depend on circumstances. Prior to signing the Agreement, the Owner will deposit, with the Treasurer of the Township, to cover the faithful performance of the obligations of the Owner arising under this Agreement, including but not limited to the construction of the works and services identified in Schedule "D" to this Agreement (the "said Works"), the following securities: a) Cash in the amount of one hundred percent (100%) of the estimated cost of the said works, as approved by the Township's Engineering Consultant and Township Council, or: b) An irrevocable Letter of Credit from a chartered bank, issued in accordance with the requirements of Schedule "E", with an automatic renewal clause in the amount of one hundred percent (100%) of the estimated costs of the said works, and as approved by the Township's Engineering Consultant. The Letter of Credit shall be for a minimum guaranteed period of one (1) year, or such time as the Township decides, and shall be renewed automatically, as necessary, thirty (30) days prior to expiration. C) The Township reserves the right to accept or reject any of these alternative methods of providing securities. Prior to depositing the securities, the Owner's Consulting Engineer shall submit an estimate of the cost of the works to the Township's Engineering Consultant for approval. When the cost estimate has been approved, it will be set out in Schedule "D" of this Agreement and will become the basis for the limits of the securities. d) Any Letter of Credit or security filed with the Township is based upon the estimated cost of completing the various matters and works prescribed by this Agreement. However, all Letters of Credit and security received by the Township may be used as security for any item or any other matter which, under the terms of this Agreement, is the responsibility of the Owner, including without limiting the generality of the foregoing, payment of engineering, legal, planning or other costs incurred by the Township, which are the responsibility of the Owner, under the terms of this Agreement. e) Upon written notification by the Owner's agent, certifying that all required works for which the Letter of Credit was submitted have been completed in accordance with the plans submitted and upon confirmation by the Township or its agent that the Owner's obligations under this Agreement have been completed, the Township will return said Letter of Credit.
