NOTICE OF PUBLIC MEETING
RE: PROPOSED BUILDING
PERMIT FEE SCHEDULE REVISIONS
Council of the Corporation of the Township of Oro-Medonte received a Staff Report
DS2018-013 at their meeting of March 14, 2018 proposing Revisions to Fees & Charges
Bylaw# 2016-110 as amended, Schedule B- Building. The draft by-law 2018-024 is
available on the Township website & attached to this Notice of Public Meeting for review
prior to the Public Meeting.

THE BUILDING CODE ACT and subsequent Regulations, the Building Code, are, on
an ongoing basis, amended by the Ministry of Municipal Affairs and Housing.
Consequently, it is periodically necessary for the municipal Building By -Law to be
amended to remain current with the Provincial legislation from which it is derived.
SCHEDULE B to the Fees By -Law contains the municipal Building Division's Fees.
Pursuant to the Building Code Act 7.(6) a Public Meeting is to be held when fee revisions
are proposed to give Council and the general public the opportunity to ask questions,
express concerns and discuss the proposal, prior to any decision by Council, relative to
the proposed revisions.
THE EFFECT of the proposed Fee Revisions adjustments are intended to reflect the
true costs of administering the various Building Permit categories and to ensure that the
general tax revenues are not required to subsidize those Building Permit processes, as
per BCA 7.(2). These proposed revisions are identified on the attached draft by-law
2018-024 in underline and reflect the following amendments: increase in minimum
permit fees, addition of more types of agricultural buildings/greenhouses, revision to the
deck permit fees, increase in the sewage system permit fees, addition of an hourly
permit review fee for staff time to review permit revisions, inclusion of an alternative
solutions examination fee, inclusion of securities for conditional permit fees, inclusion of
an annual increase adjustment, inclusion of provisions for cost recovery of permit fees
and all costs associated with obtaining compliance.

A By-law to Amend By-law 2016-110, "A By-law of The Corporation of the
Township of Oro-Medonte
To provide for the imposition of Fees or Charges
(Fees and Charges By-law)
Whereas Part XII, Section 391 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, authorizes a municipality to impose fees or charges on persons, for services
or activities provided or done by or on behalf of it, for costs payable by it for services or
activities provided or done by or on behalf of any other municipality or local board; and
for the use of its property including property under its control;
And Whereas Section 7(1) of the Building Code Act, 1992, S.O., c.23, as amended,
authorizes the Council of a municipality to pass by-laws requiring the payment of fees
on applications for and on the issuance of permits, requiring the payment of fees for
maintenance inspections, and prescribing the amounts of the fees;
And Whereas Council of the Township of Oro-Medonte did, on the 41h day of April,
2012, enact By-law 2016-110;
And Whereas a public meeting was held on April 11, 2018 under the authority of the
Building Code Act, Section 7.(6), S.O. 1992, c.23 as amended, to obtain public
comments with respect to the proposed amendments to the Fees and Charges by-law,
And Whereas Council deems it necessary to amend Schedule B, Building, of By-law
2016-110;
Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows
That Schedule "B" to By-law 2016-110 — Building be deleted in its entirety and
replaced by Appendix "A" entitled Schedule "B" — to By-law 2016-110 — Building
attached hereto and forming part of this by-law,
2. That this By-law shall take effect on the final passing thereof.
By-law read a first, second and third time, and passed this 11TH day of April, 2018.

3. Refund of Permit Fees
3.1 Pursuant to this by-law, the portion of the total calculated permit fees that may be refunded
shall be a percentage of the total fees payable under this by-law, calculated as follows in
regard to functions undertaken by the municipality:
a) 75% if administrative function only have been performed;
b) 50% if administrative and plans examination functions have been performed;
c) 25% if the permit has been issued and no field inspections have been performed
subsequent to permit issuance; or
d) 0% if any field inspections have been performed subsequent to permit issuance.
In the case of any refund request, the minimum permit fee of $ 250.00 will be retained.
3.2 The permit fee shall be returned to the person named on the fee receipt, unless such person
advises the Chief Building Official, in writing and prior to release of the refund, of a change in
name, in which case the refund shall be returned to the person then authorized to receive it.
When only the minimum fee has been collected/submitted, no refund will be processed.
4. Deposits & Securities
4.1 Lot Grading Deposit $ 1,000.00

& procedures. Refundable upon satisfactory inspection minus any
applicable charges.
4.2 Conditional Permit Security
As requested and issued by the Chief Building Official, to be paid
in addition to applicable permit fees.

Notes
5.1 Total fee is payable upon receipt of completed application.
5.2 Where a person is found to have commenced construction or demolition of a building without
a permit having been issued, the permit fee shall be doubled, minimum fee of $250.00 in
addition to required fees will be applied to cover the cost of administration and enforcement.

Compassion fee - Permit fees for a rebuild due to fire (Fre restoration or a new build same
size) will be charged at 50% of the determined fees, but not less than the minimum fee.
Additional new build beyond the original structure size will be charged at full permit fees as
noted above.
