The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the Lake Simcoe Protection Plan (LSPP) and Ontario Regulation 179/06 under the Conservation Authorities Act. The subject property is located within close proximity to Lake Simcoe and is subject to shoreline erosion hazards. Based on our review of the submitted materials we are satisfied from a watershed management perspective that this application is consistent with the Natural Heritage and Natural Hazard Policies of the PPS and conforms with the requirements of the LSPP. As such, we recommend that any approval of this application be subject to the following condition: The applicant shall obtain a permit from the LSRCA for any development or site alteration within the lands regulated under Ontario Regulation 179/06 of the Conservation Authorities Act. County Planning staff understand that the applicant is seeking to sever approximately 0.275 hectares (0.68 acers) for the purpose of creating a new residential lot. Planning Comments The subject lands are fully within the Greenlands designation as per Schedule 5.1 – Land Use Designations to the Simcoe County Official Plan (SCOP). An unevaluated wetland has been identified north-west of the subject lands. Furthermore, the subject lands and surrounding area are within the Natural Heritage System of the Growth Plan for the Greater Golden Horseshoe (‘Growth Plan’). As such the unevaluated wetland north-west of the subject lands meets the definition of a Key Natural Heritage Feature as per the Growth Plan. The application is therefore subject to the Greenlands policies of the SCOP and the Natural Heritage policies of the Growth Plan. A key objective of the Greenlands designation is to protect and restore the natural character, form, function, and connectivity of the County’s natural heritage system. Furthermore, natural heritage features and areas, and their ecological functions, are to be preserved. In addition, as applicable to this application, the Greenlands designation is to ensure that the location, scale, and form of development respects and supports the protection of the County's natural heritage system. The creation of the proposed lot would introduce a residential use on lands within the County’s Greenlands designation. As indicated in point viii above, residential dwelling units are only permitted on lots which were created before May 9, 2016, subject to the lands not being within a prime agricultural area. The introduction of a residential use on the new lot would therefore conflict with the County’s Greenland designation policies. As such County Planning staff cannot support the creation of the proposed residential lot. Please note that the legally existing residential use on the subject lands may continue to exist as per policy 4.11.6 of the SCOP. As stated above, the subject lands are within the Natural Heritage System of the Growth Plan, and adjacent to a Key Natural Heritage Feature, being the unevaluated wetland north-west of the subject lands. Therefore, any development occurring on the subject lands must satisfy the Natural Heritage Policies of the Growth Plan. Conclusion As indicated above, the subject lands are within the County’s Greenlands designation. The residential use, as proposed, is not permitted in the Greenlands designation as per SCOP policy 3.8.15. Therefore, County Planning staff cannot support the creation of the proposed residential lot on the subject lands. Please provide a Notice of Decision. Example you have a 20 ft vehicle you bring out the garage door that’s facing the road, you park this vehicle outside this door, your vehicle is now sticking out onto the roadway. If you leave this distance at 24.6 feet. You can nicely leave a vehicle parked here and still have 4.6 feet of space between the road and the vehicle. If the township is going to allow the 19.68 feet setback, then I think the garage door facing the roadway should not be allowed. This would prevent vehicles from being parked outside this door. Section 5.1.6 -MAXIMUM floor area Why does the township even have a Maximum floor area, if they are allowing that Maximum to be almost doubled in size? With adding an extra 746.5 sq feet to the maximum allowable size, at what size is this building no longer categorized as an accessory building. All it would take is to add a kitchen and bathroom and this would be a second house on this lot. The Township has maximum sizes for a reason and I feel they need be followed. Based on our mandate and policies under Conservation Authorities Act, we have no objection to its approval. NVCAs understanding of the proposal is that the applicant seeks relief from the EP setback and a revision of the original decision of the Committee of Adjustment to allow for the construction of a deck. The proposed deck, as well as the previously approved addition to the existing residence is separated from the natural heritage features on the property by multiple structures. NVCA is of the opinion that impact on the features is not foreseen. Two previous letters of clearance have been provided by NVCA and remain in effect. This letter may be used as clearance for the proposed construction of the deck as described in the revised plans circulated.
