the Council's donations/grant's allocation.

Be it resolved that the Township of Oro-Medonte suspend the rules of procedure in
accordance with Schedule "A" to By-law 2017-165 Section 15, with the following parameters:
1. Open Forum be permitted to take place now, in addition to the regularly scheduled Open
Forum as listed on the Agenda;
2. This Open Forum will be to solely allow the public to provide input on Site Alteration
Applications, the Site Alteration By-law, or the now withdrawn Site Alteration Application
that was for 1857 and 1929 Penetanguishene Road;
3. All other general rules governing Open Forum shall apply, including but not limited to:
• No response shall be provided to any question posed during Open Forum;
- -• Each speaker is permitted to speak only once; -
• Speakers providing comment on the same item, shall be requested to limit their
comments so as to provide additional information and not repeat the same information
provided by a previous speaker
4. All other individuals wishing to speak to an

12. Reports of Municipal Officers:
a) Report No. OCS2018-11, Shawn Binns, Director, Operations & Community Services re:
Off Road Vehicle Use on Municipal Roadways [Refer to Item 9a)].
Following a discussion, Council recessed to allow the Clerk an opportunity to prepare
Councillors names to be drawn for selection of appointment to the ATV Draft By-law
Taskforce.

Whereas
• The Township of Oro-Medonte first approved a By-law in 2010 on a pilot basis to allow All
Terrain Vehicles access to Municipal Highways. The pilot was successful with the area
expanded and reviewed on a yearly basis. Currently, By-law 2013-203 is the most recent
regulation to Permit All -Terrain Vehicles to permit ATV access to municipal highways
within the following boundaries:
o Northern Boundary — Hwy 11
o Southern Boundary — Lake Simcoe

o Western Boundary — Line 1 South
o Eastern Boundary — Line 14 South from Hwy 11 to the Railtrail. The boundary then
continues from Line 15 South from the Railtrail to Lake Simcoe.
All of the above noted boundaries are clearly depicted on Schedule 'B" of By-law 2013-
203.
• The ATV access is currently permitted from January 1 st through till March 15th of any
given year from 6:00 AM to 10:00 PM.
• The following municipalities:
Township of Innisfil By-law No. 099-05,
Township of Severn By-law No. 2015-68,
Township of Ramara By-law No. 2015.49,
Township of Adjala-Tosorontio No. 11-07,
County of Simcoe By-law No. 6532,
permit the operation of All Terrain Vehicles on certain Municipal Highways under certain
conditions. Consultation with elected officials confirm that the implementation has been
successful to the extent that they plan to continue permitting the use.
Now therefore, be it resolved
1. That Report No. OCS2018-11, Shawn Binns, Director, Operations & Community Services
re: Off Road Vehicle Use on Municipal Roadways in conjunction with Item 9a Sgt. Steve
Mihills, OPP Presentation, be received.
2. That Council of the Corporation of the Township of Oro-Medonte support, in principle, the -
operation of ORVs (ATV's) on Municipal Highways under certain conditions within the
Township of Oro-Medonte for a period of one (1) season.
3. The Township of Oro-Medonte reserves the right to revoke the authorization per the pilot
and/or amend the by-law in its entirety, without advance notice.
4. That two (2) Councillors with the Mayor as ex -officio form a taskforce to draft conditions
and parameters regarding the use of ORVs (ATVs) on municipal highways, considered in
a draft communication plan and draft by-law for Council's consideration with consultation
in the Clerk, Director, Operations & Community Services, Township staff and outside
agencies as required.
5. That Councillors Hall and Crawford be appointed to the ATV Draft By-law Taskforce.
6. And further that the task force report back to Council regarding the status of the draft by-
law by April 25, 2018.

re: 1857 and 1929 Penetanguishene Road Proposed Site Alteration.

2. That Tender OCS 2018-004 Guiderail Installation — Various Locations be awarded
to Peninsula Construction Ltd. in the amount of $67,646.50 plus HST.
3. That staff be authorized to undertake additional guiderail work up to the upset limit of
the 2018 capital budget allocation of $110,000 following a favorable mid -year
variance review.
4. That the Director, Operations and Community Services be authorized to execute the
appropriate agreements on behalf of the Township.
5. And that the bidders be thanked and notified under the Director, Operations and

2. That the Clerk be directed to prepare the necessary by-law prior to Nomination Day (July
27, 2018), delegating authority to the Chief Administrative Officer from July 27, 2018 to
December 2, 2018 for the following matters:
a) The appointment or removal from office of any officer of the municipality;
b) The disposition of any real or personal property of the municipality which has a value
exceeding $50,000 at the time of disposal; and
c) Making any expenditures or incurring any other liability which exceeds $50,000.
3. That the by-law shall come into force and effect only in the event that at any time less
than seventy-five percent (75%) of the current Members of Council will be returning to sit
on the new Council after Nomination Day of the 2018 Municipal Election as determined
by the Municipal Clerk.
