Executive Summary The purpose of this report is to provide a progress update on Simcoe CountyArchaeological Management Plan (AMP) project. The County is commencing the AMP project in order to identify, protect and conserve significant County archaeological sites and our rich cultural heritage. The AMP will provide comprehensive GIS mapping of all known archaeological sites in the County of Simcoe as well as areas of Indigenous and colonial period archaeological potential to help guide future planning and development decisions. A component of the project is the development of a clear and comprehensive protocol to guide future engagement and consultation with the Indigenous communities that have an ancestral or traditional territorial interest in Simcoe County. This protocol will help ensure Indigenous communities are fully engaged in the preparation of the AMP document. The County has retained Archaeological Services Inc. (ASI) to prepare and consult on the County AMP. Given the importance of this study in guiding future development within the County, the project is following an accelerated process, with an estimated draft completion date of November, 2018. Once finalized, County Planning staff will seek Council approval in order to incorporate the AMP into the County's Official Plan. County Planning staff and ASI have contacted various Indigenous communities which have a known or suspected ancestral or traditional territorial interest in Simcoe County to advise them of the initiation of the AMP Project. The project is seeking to obtain their initial comments on the draft AMP Terms of Reference. A couple of the Indigenous communities contacted have provided formal requests for capacity funding related to their consultation on the AMP project. This follows a similar request considered by County Council in June 2016 put forth by the Métis Nation of Ontario relating to harvesting rights in the County Forests. County staff has been researching the practices of other municipalities regarding such funding requests and will detail examples of what has occurred in other jurisdictions in this report and provide a recommendation regarding the requests. Background The Archaeological Management Plan (AMP) project 2018. The County of Simcoe is embarking on an Archaeological Management Plan (AMP) in order to identify, protect and conserve the County's archaeological sites and rich cultural heritage. The Planning Act requires that municipal decision makers and planners be aware of all lands containing known archaeological sites or areas of archaeological potential, and that all planning decisions are made in accordance with provincial policies and regulations. Sections 2.6.4 and 2.6.5 of the Provincial Policy Statement (PPS 2014) identifies that planning authorities should consider and promote archaeological management plans and cultural plans in conserving cultural heritage and archaeological resources, and shall consider the interests of Aboriginal communities in conserving cultural heritage and archaeological resources. Furthermore identifies the need to recognize, conserve and educate the public in regards to cultural heritage conservation, including archaeological features and sites. Specifically, County Official Plan Section 4.6.4 states: The County may consider undertaking the preparation and completion of a cultural heritage and/or archaeological management plan to assist in identifying sensitive cultural and archaeological areas including cemeteries and burials within the County, which is to include but not limited to: a) Comprehensive mapping and inventories of significant built heritage resources, significant cultural heritage landscapes, and areas of archaeological potential; b) Identification and evaluation of cultural heritage and archaeological resources; c) Strategies for conserving and enhancing these identified resources; d) Programs to foster interpretation and promotion; and e) Education and public participation in cultural heritage conservation. As a result, the County is undertaking the preparation and completion of an Archaeological Management Plan and an Indigenous Communities Consultation Protocol to address the above- noted legislative requirements and cultural heritage and archaeology policies. However, it should be noted that comprehensive mapping and inventories of significant built heritage resources is beyond the scope of this project and may be completed in the future. The Indigenous Communities Consultation Protocol will help provide clearer direction on how Indigenous community engagement and consultation is to occur for this process. Beginning in November, 2017, the County and ASI contacted various Indigenous communities with a known or suspected interest in Simcoe County to advise them of the initiation of the AMP Project. The County also requested their initial comments on the draft AMP Terms of Reference. The list of Indigenous communities contacted is included as Appendix A to the Terms of Reference. See Schedule 1. ASI has also had on-going dialogue with many of the Indigenous communities and is currently working to arrange individual meetings with each community requesting a meeting. A few meetings are already scheduled to occur in February, with others anticipated for March of this year. In discussions regarding the scheduling of related meetings, the following Indigenous communities have requested capacity funding related to their consultation on the AMP project: Métis Nation of Ontario (MNO) and the Huron-Wendat Nation. We should note that ASI has indicated we should anticipate there may be other Indigenous communities who wish to be involved in the AMP project who could at some point also request some amount of capacity funding relating to meetings throughout the duration of this specific project. As County Council may recall back in June 2016, Council considered a consultation compensation request from the MNO relating to harvesting rights in the County Forests. Committee of the Whole considered this request and passed a Resolution which was adopted by Council directing staff to proceed with consultation with the MNO, but to do so without the provision for compensation believing that all parties should come together for discussions under their own means. There was also direction for staff to research the practices of other municipalities regarding compensation and then to report back to Council asking for further direction. The Resolution is included as Schedule 2 to this Item. In light of this resolution and considering the consultation funding requests received in relation to the AMP project, research into this matter has now been conducted by County staff and a couple examples of our findings are provided. In the case of the York Region Archaeological Management Plan (ASI 2014), the Region undertook an extensive consulta communities and stakeholders. This program, intended to create a long-lasting protocol for the Region and Indigenous communities, was in part initiated to provide opportunities for Indigenous input into the York Region AMP. In total, 13 Indigenous groups or communities were represented during the consultation process including all seven Williams Treaty member nations, Huron-Wendat Nation, and the Métis Nation of Ontario. As part of this process, 10 Indigenous Steering Committee meetings were held over three years related specifically to the York Region AMP. All attendees of these meetings were compensated for travel, meals, and accommodation expenses to ensure full involvement in the process. February 13, 2018 Committee of the Whole - CCW 18-058 Page 4 requested a meeting after business hours so that members would not have to miss work (MNO is largely a volunteer-run organization). A more common example of occasions where municipalities have provided capacity funding for Indigenous involvement in a project is related to Environmental Assessments where the municipality is the proponent. For example, in 2006 York and Durham Regions undertook an extensive aboriginal consultation program related to the Southeast Collector sewer line joining East Gwillimbury to the main trunk sewer. This consultation included a series of meetings held at Rama First Nation where all attendees were compensated for travel, meal, and accommodation expenses. The same format was then repeated by York Region in 2009 for the Upper York Sewage Solutions Environmental Assessment with the same general conditions. ASI has indicated they believe these two projects provided the foundation for which the York AMP consultation process followed by building some trust between Indigenous contacts and the Regions. MNO has provided a detailed budget for their consultation meeting Archaeological Management Plan. The total cost for the meeting is approximately $1,300.00. Speaking with MNO staff, it is anticipated that no more than 2 such meetings will be required relating to their involvement in the AMP Project. County staff are anticipating that the costs associated with the consultation meetings for the Huron-Wendat Nation would be similar, if required. Reviewing the AMP budget and the projected cost of the project, the County will have reserves to pay for the meetings with the Indigenous communities who have requested capacity funding. Speaking with our consultant, we understand that the AMP Project would certainly benefit from the involvement of these Indigenous communities. compensating Indigenous communities for attendance at various significant project meetings. This compensation ensures full involvement and credibility in the process. Providing accommodation and having Indigenous community involvement in the AMP Project will help the County to build a relationship and increase some trust with each community. It will assist in creating a more consistent consultation protocol that will not only clarify how we review and consult on land use policy and development related matters, but will also assist other activities and works undertaken by County departments such as Forestry and Transportation & Engineering. Given the very nature of, and the content of, this particular Study, County Planning staff are therefore recommending that Staff be given the authority and flexibility from County Council to determine when capacity funding would be provided to Indigenous communities relating to their specific consultation on the AMP project, on a case-by-case basis. This would not be intended to set a policy or standard for all projects and initiatives going forward, but it will facilitate meaningful participation in the development of a consultation protocol, and assist in completing this important Study. In addition to the Indigenous engagement and consultation noted above, the County has also reached out to a variety of groups to participate in the AMP Project. A sample of those groups are outlined on pages 2 and 3 to the AMP Terms of Reference. See Schedule 1. We had a strong and positive interest and response to the Steering Committee invitation and the composition of the Steering Committee has now been established. The first Steering Committee Meeting occurred on January 29, 2018 and there are at least two additional meetings anticipated throughout the remainder of the Project. County Planning staff are in the early stages of designing an AMP website which will include information and updates regarding the project including opportunities for public input into the project. February 13, 2018 Committee of the Whole - CCW 18-058 Page 5 County Planning staff will periodically report back to Council with interim update reports and ASI will be presenting the study findings to Committee and Council prior to being asked to endorse the final AMP document. Financial and Resource Implications The Archaeological Management Plan development has been budgeted for in the 2018 budget. Recommendation That County Staff be given the authority and flexibility from Simcoe County Council to determine when capacity funding may be provided to our participating Indigenous Communities relating to their consultation specifically on the AMP project, on a case-by-case basis. Relationship to Corporate Strategic Plan A. Growth Related Service Delivery The Growth Plan, 2017 sets out regional level responsibilities and comprehensive, integrated planning requirements. Through the undertakings of the Review (MCR), the County will be working with local municipalities and other stakeholders to determine where growth and development should be directed to support the development of complete communities. The finalization of the AMP and the comprehensive GIS-based mapping of all known archaeological sites in the County of Simcoe as well as areas of Indigenous and colonial period archaeological potential will help guide future planning and development decisions. The development of an Indigenous Consultation Protocol will also clarify which Indigenous Communities have a traditional or territorial interest in the County of Simcoe and the process by which the County should consult with these communities to ensure that meaningful consultation occurs with respect to the MCR process, on-going development application review and processing, forestry related matters, and other County projects.
