11. Open Forum:
The Open Forum provides an opportunity for the public to provide verbal

speaking to and provide their name and address, which may become

PERMIT FEE SCHEDULE REVISIONS
Council of the Corporation of the Township of Oro-Medonte receiveda Staff Report
DS2018-013 at their meeting of March 14, 2018 proposing Revisions to Fees & Charges
Bylaw# 2016-110as amended, Schedule B-Building.The draft by-law 2018-024 is
available on the Township website &attached to thisNotice of Public Meeting for review
prior to the Public Meeting.

THE BUILDING CODE ACTand subsequent Regulations, the Building Code, are, on
an ongoing basis, amended by the Ministry of Municipal Affairs and Housing.
Consequently, it is periodically necessary for the municipal Building By-Law to be
amended to remain current with the Provincial legislation from which it is derived.
SCHEDULE B to the Fees By-Law contains the municipal Building Division’s Fees.
Pursuantto the Building Code Act 7.(6) a Public Meeting is to be held when fee revisions
are proposed to give Council and the general public the opportunity to ask questions,
express concerns and discuss the proposal, prior to any decision by Council, relative to
the proposed revisions.
THE EFFECT of the proposed Fee Revisions adjustments are intended to reflect the
true costs of administering the various Building Permitcategories and to ensure that the
general tax revenues are not required to subsidize those BuildingPermit processes, as
per BCA 7.(2).These proposed revisions are identified on the attached draft by-law
2018-024 in underline and reflect the following amendments: increase in minimum
permit fees, addition of more types of agricultural buildings/greenhouses, revision to the
deck permit fees, increase in the sewage system permit fees, additionof an hourly
permit review fee for staff time to review permit revisions, inclusion of an alternative
solutions examination fee, inclusion of securities for conditional permit fees, inclusionof
anannual increase adjustment, inclusion of provisions for cost recovery of permit fees
and all costs associated with obtaining compliance.

BY-LAW NO. 2018-024(PROPOSED)
A By-law to Amend By-law 2016-110, “A By-law of The Corporation of the
Township of Oro-Medonte
To provide for the imposition of Fees or Charges
(Fees and Charges By-law)
WhereasPart XII, Section 391(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, authorizes a municipality to impose fees or charges on persons, for services
or activities provided or done by or on behalf of it; for costs payable by it for services or
activities provided or done by or on behalf of any other municipality or local board; and
for the use of its property including property under its control;
And WhereasSection 7(1) of the Building Code Act,1992,S.O., c.23, as amended,
authorizes the Council of a municipality to pass by-laws requiring the payment of fees
on applications for and on the issuance of permits, requiring the payment of fees for
maintenance inspections, and prescribing the amounts of the fees;

AndWhereasCouncil of the Township of Oro-Medonte did, on the 4
day of April,
2012, enact By-law 2016-110;
And Whereasa public meeting was held on April 11, 2018under the authority of the
Building Code Act, Section 7.(6), S.O. 1992, c.23 as amended, to obtain public
comments with respect to the proposed amendments to the Fees and Charges by-law;
AndWhereasCouncil deems it necessary to amend Schedule B,Building, of By-law
2016-110;
NowThereforethe Council of the Township of Oro-Medonte hereby enacts as follows:
1.That Schedule “B” to By-law 2016-110–Buildingbe deleted in its entirety and
replaced by Appendix “A” entitled “Schedule “B”–to By-law 2016-110–Building
attached hereto and forming part of this by-law;
2.That this By-law shall take effect on the final passing thereof.

3.Refund of Permit Fees
3.1Pursuant to this by-law, the portion of the totalcalculated permit fees that may be refunded
shall be a percentage of the total fees payable under this by-law, calculated as follows in
regard to functions undertaken by the municipality:
a)75% if administrative function only have been performed;
b)50% if administrative and plans examination functions have been performed;
c)25% if the permit has been issued and no field inspections have been performed
subsequent to permit issuance; or
d)0% if any field inspections have been performed subsequent to permit issuance.
In the case of any refund request, the minimum permit fee of $ 250.00 will be retained.
3.2The permit fee shall be returned to the person named on the fee receipt, unless such person
advises the Chief Building Official, in writing and prior to release of the refund, of a change in
name, in which case the refund shall be returned to the person then authorized to receive it.
When only the minimum fee has been collected/submitted, no refund will be processed.
4.Deposits & Securities

4.2Conditional Permit Security
As requested and issued by the Chief Building Official, to be paid
in addition to applicable permit fees.

For Non-residential construction -A letter is to be provided to the Chief Building Official from
the Architect responsible for the project outlining the estimated cost in restoring the site to its
original state. The amount deemed shall be the amount of the security deposit required in the
form of a letter of credit.
All Residential and Non-Residential Projects -If the Chief Building Official determines that the
subject construction has not been removed orthe lands have not been restored to its original
state, the letter of credit may be drawn upon in full or in part to restore the lands. Should the
Townshipincur additional costs, the Townshipshall have a lien on the lands for such amount.

5.Notes
5.1Total fee is payable upon receipt of completed application.
5.2Where a person is found to have commenced construction or demolition of a building without
a permit having been issued, the permit fee shall be doubled, minimum fee of $250.00 in
addition to required fees will be applied to cover the cost of administration and enforcement.
5.3Compassion fee -Permit fees for a rebuild due to fire (fire restoration or a new build same
size) will be charged at 50% of the determined fees, but not less than the minimum fee.
Additional new build beyond the original structure size will be charged at full permit fees as
noted above.

5.4That Schedule B shall be adjusted without amendment to this By-law annually on January 1
each year, commencing January 2019, in accordance with the most recent twelve month charge
in Statistics Canada Quarterly, Construction Price Statistics when such statistic represents an
increase. Fees shall be rounded to the closest cent.
6.Cost Recovery
Where a building investigation results in theissuance of an Order under the Act the property
owner or any other person responsible for the action, shall pay fees in accordance with the most
recent fee schedule. Where an Order is issued under the Act and where the named achieved
eventual compliance with the Order, the Township may choose not to prosecute the named, if
satisfactory settlement is reached.
7. Additional Costs
When the Township, or another municipal, provincial, or federal agency/entity on the Township’s
behalf, takes actions or pays money to rectify failures, by-law infractions or situations created by,
or on behalf of a person, including but not limited to non-compliance with the terms of any
agreement, or permit, or license, such person shall be responsible for all costs paid or payable by
the Township including the cost of staff time, equipment expenses and other expenses incurred
by the Township. The person shall be invoiced for all costs. The minimum invoice shall not be
for less than three hours of time or $ 1000.00

watershed.

V. PRESENTATIONS
a) Update on the New Education and Training Facility Scanlon Creek Conservation Area
Chief Administrative Officer, Mike Walters, updated the Board regarding
Training Facility, noting that the existing facility (the Nature Centre at Scanlon Creek Conservation
Area) is quickly approaching the end of its useful life and would require a significant renovation and
investment to extend it. LSRCA has been considering and investigating the feasibility of raising funds
for a new multi-use facility; however, funds are not available in the 2018 budget to continue. CAO
Thiess Riverprize funds, which were received in
2009 and have been held in reserve until a worthy project was identified. Staff sought to incorporate
these funds into the 2018 budget to cover expenditures associated with completing a detailed design,
financial strategy, and to launch the fundraising campaign for the new Education and Training Facility
Project.

The Board approved Staff Report No. 03-18-BOD regarding the new Education and Training Facility
Project as it relates to the release of the Thiess Riverprize Reserve funds up to the full amount of
$235,625.00. Staff plan to incorporate the funds into the 2018 budget for the completion of the
detailed design, financial strategy and launch of the fund raising campaign. Staff will provide quarterly
updates to the Board regarding the project progress and any and all draws on the reserve.

b) Councillor Eek enquired as to how an Agricultural Advisory Committee would work, as recommended
by the Simcoe County Federation of Agriculture (SCFA) in their letter of January 18, 2018. CAO
Walters advised that he would arrange to meet with Mr. Partridge of SCFA to gather more
information and report back to the Board at a later meeting.

4. Closure of the Ontario Tree Seed Plant
Councillor Eek asked questions around the variety of seeds, a good tree to replace the emerald ash borer,
which trees are at greater risk, as well as what will happen to the seeds upon the plant closure. Manager,
plant has been collecting both hardwood and softwood for years, and that the draft letter covers all
issues and types of seeds. He went on to note that the seed plant has been a safety net that is heavily
relied on. He also noted that collective organizations and non-profits have convinced MNRF to assign
bulk of seeds to one collective, but that he was not sure at this point where that would be.
