Ms. Teeter, The Township of Oro-Medonte's proposed Minor Variances for Boathouses does not comply with the Lake Simcoe Protection Act, sound environmental practices or community harmony in the following ways: 1. It gives preferential treatment to landowners with larger structures to build larger boathouses than their neighbours with smaller properties. 2. It negatively impacts the poor neighbour who just has to put up with the huge 7 metre or 23' high boathouse being built next door, casting shadows on his property and obscuring his views. The four tests as prescribed by Sec. 45(1) of the Planning Act are applied to determine if the variance should be approved. The four tests are: Is the application minor in nature? Is it appropriate and desirable development for the area? Is it in keeping with the purpose and intent of the Zoning By-law? Is it in keeping with the purpose and intent of the Official Plan? In my opinion, these variance proposals do not scientifically or from a common sense approach in any way meet the means tests as above. Subjective and abstract opinions of staff should not form the basis of such critical shoreline decisions. In fact, the DS report, D2018-018, from staff for the Lakeshore Rd E site actually states on p.4 "will not result in further over-development of the subject lot or the shoreline". Staff acknowledges there is already over-development in place at the site and staff still wants to add more development. Not a good idea to further compromise a site that is already over-developed. There is no logic to the staff report or recommendation. The Township of OM may be trying to streamline the process, but this proposal will create more problems and conflict between neighbours and make a real mess of our shorelines that we are supposed to be protecting! Residents should question the wisdom of this proposal. In my view it is extremely poor planning, does not comply with Page 13 of 157 2.a) Motion to Approve the Agenda. Provincial law and is frankly insulting to many of us who live along the Lake Simcoe shoreline and respect and honour this lake. The shoreline is sacred and should not be tampered with based on the subjective and abstract opinions of planners as to the positive esthetics. The planner has a responsibility to protect and preserve the shoreline, not destroy based on 'it looks nice'. The facts are the variances being requested are NOT MINOR. An 80%+ variance is NOT MINOR and any professional statistician will attest to the fact. The changes in light reflection from glass on the second storeys facing SE caused by these proposals will negatively impact nesting and the food chain along the shoreline. If people don't want to honour the shoreline as required by law, then they should have done some discovery to learn of the restrictions. Such residents are the problem, not the solution.. Creeping incrementalism of variances will only start the 'my boathouse is bigger than yours' mentality and lead to further shoreline encroachments and habitat destruction. I urge ALL Council members to be responsible to preserve and protect Lake Simcoe and reject such so-called minor variances as proposed on behalf of ALL residents and staff, not those who won't honour the shoreline. The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the Lake Simcoe Protection Plan (LSPP) and Ontario Regulation 179/06 under the Conservation Authorities Act. The subject property is located on the shoreline of Lake Simcoe and is partially regulated by Ontario Regulation 179/06 for a watercourse (Pemberton Creek), erosion and flooding hazards. Based on our review of the submitted materials we are satisfied from a watershed management perspective that this application is consistent with the Natural Heritage and Natural Hazard Policies of the PPS and conforms with the requirements of the LSPP. The building exceeds the minimum distance allowed from an existing building by a substantial Amount. In fact it seems to overlap the existing building. Secondly the proposed building far exceeds the square footage by more the twice the footage allowed. This application is clearly in violation of the existing rules. Ms. Teeter, The Township of Oro-Medonte's proposed Minor Variances for Boathouses does not comply with the Lake Simcoe Protection Act, sound environmental practices or community harmony in the following ways: 1. It gives preferential treatment to landowners with larger structures to build larger boathouses than their neighbours with smaller properties. 2. It negatively impacts the poor neighbour who just has to put up with the huge 7 metre or 23' high boathouse being built next door, casting shadows on his property and obscuring his views. The four tests as prescribed by Sec. 45(1) of the Planning Act are applied to determine if the variance should be approved. The four tests are: Is the application minor in nature? Is it appropriate and desirable development for the area? Is it in keeping with the purpose and intent of the Zoning By-law? Is it in keeping with the purpose and intent of the Official Plan? In my opinion, these variance proposals do not scientifically or from a common sense approach in any way meet the means tests as above. Subjective and abstract opinions of staff should not form the basis of such critical shoreline decisions. In fact, the DS report, D2018-018, from staff for the Lakeshore Rd E site actually states on p.4 "will not result in further over-development of the subject lot or the shoreline". Staff acknowledges there is already over-development in place at the site and staff still wants to add more development. Not a good idea to further compromise a site that is already over-developed. There is no logic to the staff report or recommendation. The Township of OM may be trying to streamline the process, but this proposal will create more problems and conflict between neighbours and make a real mess of our shorelines that we are supposed to be protecting! Residents should question the wisdom of this proposal. In my view it is extremely poor planning, does not comply with Page 109 of 157 6.d) 6:00 p.m. Report No. DS2018-18, Andria Leigh, Director, Development... Provincial law and is frankly insulting to many of us who live along the Lake Simcoe shoreline and respect and honour this lake. The shoreline is sacred and should not be tampered with based on the subjective and abstract opinions of planners as to the positive esthetics. The planner has a responsibility to protect and preserve the shoreline, not destroy based on 'it looks nice'. The facts are the variances being requested are NOT MINOR. An 80%+ variance is NOT MINOR and any professional statistician will attest to the fact. The changes in light reflection from glass on the second storeys facing SE caused by these proposals will negatively impact nesting and the food chain along the shoreline. If people don't want to honour the shoreline as required by law, then they should have done some discovery to learn of the restrictions. Such residents are the problem, not the solution.. Creeping incrementalism of variances will only start the 'my boathouse is bigger than yours' mentality and lead to further shoreline encroachments and habitat destruction. I urge ALL Council members to be responsible to preserve and protect Lake Simcoe and reject such so-called minor variances as proposed on behalf of ALL residents and staff, not those who won't honour the shoreline. We understand the applicant is seeking relief from Zoning By-law 97-95, for the maximum boathouse height. The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the Lake Simcoe Protection Plan (LSPP) and Ontario Regulation 179/06 under the Conservation Authorities Act. Based on available mapping, the subject property appears to be located on the shore of Lake Simcoe and is subject to erosion and flooding hazards. It appears the shoreline of the property contains a steep slope that exceeds a 3:1 ratio (being approximately 1.75:1). It also appears that the slope and Vegetation Protection Zone (VPZ) associated with the Lake on this property has been previously disturbed and that a LSRCA permit has not been issued in support of the work taken place to date. Based on our review of the submitted material, we recommend that any approval of this application be deferred until the following information is submitted to our satisfaction: 1.That a Geotechnical Investigation be completed by a qualified professional, in accordance with MNRFs Technical Guidelines, to confirm the slope will be stable in a post development situation and provide bioengineering solutions to the maximum extent possible. 2.That a planting plan be provided to the satisfaction of the LSRCA for the 30m VPZ associated with Lake Simcoe in accordance with Policy 6.45-DP of the LSPP.
