The following correspondence was received: Township of Oro-Medonte, Building
Division dated January 15, 2018; Township of Oro-Medonte, Manager, Development
Engineering dated January 18, 2018; Simcoe County District School Board dated
January 18, 2018; Nottawasaga Valley Conservation Authority dated January 22, 2018.
Derek Witlib, Manager, Planning Services, explained the purpose and effect of the
application. A PowerPoint presentation was presented.
Peter Wassenaar, on behalf of the applicant, was present.

It is recommended
1. That Report No. DS2018-08, Deborah -Ann Liske, Planner re: Minor Variance
Application 2017-A-56, John & Susan Smith, 11 Nelson Street be received and
adopted.
2. That Minor Variance Application 2017-A-56 by John and Susan Smith, specifically to
permit a detached accessory building with a 4.5 metre (14.7 feet) front yard setback,
a lot coverage of 9.4% and a maximum floor area of 154 square metres (1656
square feet) comprised of a first storey floor area of 93.6 square metres (1008
square feet) and a 60.1 square metre (648 square feet) storage loft on the lands
municipally known as 11 Nelson Street, Township of Oro-Medonte, be approved.
3. That the following conditions be imposed on the Committee's decision:
a) That notwithstanding Section 5.1.3 a), 5.1.5, 5.1.6 of Zoning By-law 97-95, the
proposed detached accessory building shall otherwise comply with all other
applicable provisions of the Zoning By-law;
b) That the proposed buildings/structures and landscaping on the property be
substantially and proportionally in conformity with the dimensions as set out on
the application and sketches submitted and approved by the Committee;
c) That an Ontario Land Surveyor may be required to verify by pinning the
foundation wall and verifying in writing by way of survey/real property report, prior
to the pouring of the footing and if no footing, the foundation, that the detached
accessory building is located no closer than 4.5 metres from the front property
line;

d) That the applicant obtain any permits and or approvals required for the proposed
detached garage and drainage works from the Nottawasaga Valley Conservation
Authority;
e) That the appropriate Development Agreement between the Owners and the
Township is executed to ensure all drainage works are completed to the
satisfaction of the Township;
f) That the Township register a drainage easement and that all costs associated
with the easement, including surveying, registration and legal costs, be borne by
the applicant;
g) That the appropriate Zoning Certificate and Building Permit be obtained from the
Township only after the Committee's decision becomes final and binding, and the
Development Agreement and drainage easement are registered, as provided for
within the Planning Act R.S.O. 1990, c.P. 13;
4. And that the applicant be advised of the Committee's decision under the Secretary -
Treasurer's signature.

1. That Report No. DS2017-153, Catherine McLean, Planner re: Minor Variance Application
2017-A-66, Robert Ahearn, 346 Shanty Bay Road be received and adopted.
2. That Minor Variance Application 2017-A-66 by Robert Ahearn, specifically to permit a
detached accessory building with a floor area of 139.35 square metres (1,500 square feet),
a maximum height of 4.88 metres (16 feet), and an increased in lot coverage of 6% percent
on the lands municipally known as 346 Shanty Bay Road, Township of Oro-Medonte, be
denied on the basis that the proposed development does not conform to the general intent
of the Zoning By-law, is not appropriate for the desirable development of the lot and is not
minor.
3. And that the applicant be advised of the Committee's decision under the Secretary -
Treasurer's signature.

and proportionally in conformity with the dimensions as set out on the application and
approved by the Committee; and,
c) That the appropriate Zoning Certificate, Engineered Lot Grading Plan and Building
Permit be obtained from the Township only after the Committee's decision becomes final
and binding, as provided for within the Planning Act R.S.O. 1990, c.P. 13.
4. And that the applicant be advised of the Committee's decision under the Secretary -
Treasurer's signature.

Township of Oro-Medonte be received and adopted;
2. That Zoning By-law Amendment Application 2017-ZBA-15, that would rezone a
portion of the subject lands from the Private Recreation (PR) Zone to the Private
Recreation Exception 283 Hold (PR'283(H)) Zone on Schedule A17 to Zoning
By-law No. 97-95, be approved.
3. That the appropriate by-law be brought forward for Council's consideration.

1. That Report No. DS2018-07, Andy Karaiskakis, Senior Planner re: Zoning By-law
Amendment Application 2017-ZBA-14, Consent Application 2017-B-25, Skyline Utility
Services Inc., Part of Lots 1 and 2, Concession 3, Part 1 on 51 R-9949 be received and
adopted;
2. That Zoning By-law Amendment Application 2017-ZBA-14, that would rezone a portion
of the subject lands from the Agricultural/Rural (A/RU) Zone to the Agricultural/Rural
Exception 284 - Holding (A/RU*284-H) Zone on Schedule A15 to Zoning By-law No. 97-
95, as amended, be approved;
3. That the appropriate by-law be brought forward for Council's consideration;
4. That the required Holding (H) Provision not to be removed from the zoning of the subject
lands until such time as the appropriate Site Plan is approved by the Township, the
related Site Plan Agreement is registered and the Township has received the securities
identified in the Site Plan Agreement;
5. That the applicant be advised of the Committee's decision under the Director,
Development Services signature;
6. That the Development Services Committee grant provisional consent to Application
2017-B-25 to convey a parcel having an area of approximately 10.4 hectares (25.7
acres) and a lot frontage of approximately 493.0 metres (1,617.4 feet), subject to the
following conditions:
a) That the applicant signs the Township's Memorandum of Understanding by which
the applicant acknowledges the requirements and timing of matters that may include:
payment of development charges, payment of parkland contribution, water and
sanitary servicing;
b) That the applicant pay $500.00 for the lot created as cash -in -lieu of a parkland
contribution;
c) That one copy of a Registered Reference Plan of the subject lands prepared by an
Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer;
d) That the applicant's solicitor prepare and submit a copy of the proposed conveyance
for the parcel severed, for review by the Municipality;
e) That all municipal taxes be paid to the Township of Oro-Medonte;
f) That the Certificate of Consent be issued utilizing Form 2, Section 53 (42) of the
Planning Act, R.S.O. 1990; and
g) That the conditions of consent imposed by the Committee be fulfilled within one year
from the date of the giving of the notice.
7. And that the applicant be advised of the Development Services Committee's decision
under the Secretary -Treasurer's signature.

1. That Report No. DS2018-09, Derek Witlib, Manager, Planning Services re: Official
Plan Amendment Application 2017-OPA-01 and Zoning By -Law Amendment
Application 2017-ZBA-05 by Costellos of Craighurst Inc., 3239 Penetanguishene
Road, North Part of Lot 40, Concession 1 E.P.R. (Oro) Township of Oro-Medonte be
received and adopted.
2. That Official Plan Amendment Application 2017-OPA-01, 3239 Penetanguishene
Road, North Part of Lot 40, Concession 1 E.P.R. (Oro), Township of Oro-Medonte,
that would serve to redesignate the subject lands from the Core Area and Living
Area designations to a Core Area Exception designation on Schedule A of the
Official Plan, be adopted as Amendment No. 40 to the Township of Oro-Medonte
Official Plan and be forwarded to the County of Simcoe for approval.
3. That Zoning By-law Amendment Application 2017-ZBA-05, that would rezone a
portion of the subject lands to a Local Commercial Exception 285 Holding
(LC'285)(H) Zone on Schedule A14 to Zoning By-law No. 97-95, be approved.
4. That the required Holding (H) Provision not be removed from the zoning of the
subject lands until such time as the appropriate Site Plan is approved by the
Township, the related Site Pan Agreement is registered and the Township has
received the securities identified in the Site Plan Agreement.
5. That the appropriate Official Plan Amendment Adopting By-law and Zoning By-law
Amendment be brought forward for Council's consideration.
6. And that the applicant be advised of the Committee's decision under the Director,
Development Services' signature.

the Nottawasaga Valley Conservation Authority and the requirements for registration.
