2018-016 By-law to amend the zoning provisions which apply to the lands within Part of Lot 40m Con 1, 3239 Penetanguishene Rd, Oro-Medonte and Repeal By-law No. 2018-015The Corporation of the Township of Oro-Medonte By-law No. 2018-016 A By-law to amend the zoning provisions which apply to the lands within Part of Lot 40, Concession 1 E.P.R. (Oro), Township of Oro-Medonte, County of Simcoe, 3239 Penetanguishene Road and to Repeal By -Law No. 2018-015 Whereas the Council of the Corporation of the Township of Oro-Medonte is empowered to pass By-laws to regulate the use of land pursuant to Section 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13; And Whereas Council deems it appropriate to rezone the subject lands, in accordance with Section C2 of the Official Plan; And Whereas Council deems it expedient to repeal and replace By-law 2018-015; Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Schedule `A14' to Zoning By-law 97-95, as amended, is hereby further amended by changing the zone symbol applying to the lands located in Part of Lot 40, Concession 1 E.P.R. (Oro), Township of Oro-Medonte, County of Simcoe, 3239 Penetanguishene Road from the Local Commercial (LC) Zone and Agricultural/Rural Exception 15 (A/RU*15) Zone to the Local Commercial Exception 285 - Holding (LC -*285)(H) Zone as shown on Schedule `A' attached hereto and forming part of this By-law. 2. Section 7 — Exceptions of Zoning By-law 97-95 as amended is hereby further amended by adding the following site specific provisions on the lands being Part of Lot 40, Concession 1 E.P.R. (Oro), Township of Oro-Medonte, County of Simcoe, 3239 Penetanguishene Road: "7.285 *285 - Part of Lot 40, Concession 1 (Oro), Township of Oro- Medonte (Costellos of Craighurst Inc.) Notwithstanding any other provision in this By-law, the following uses and provisions apply to the lands denoted by the symbol *285 on the schedules to this By-law and in addition to the permitted uses in Table A2 — Commercial Zones Permitted Uses, a Restaurant, Drive-Thru shall also be permitted." 3. That the Holding Provision shall be removed after the appropriate Site Plan is approved by the Township, the related Site Plan Agreement is registered and the Township has received the securities identified in the Site Plan Agreement. 4. Schedule "A" attached to By-law No. 2018-016 is declared to form a part of this By- law. 5. That By -Law No. 2018-015 is hereby repealed in its entirety 6. That this By-law shall come into force and effect on the date that it was enacted subject to Official Plan Amendment No. 40 coming into force pursuant to Section 24(2) of the Planning Act, R.S.O. 1990, as amended, and in accordance with the provisions of Section 34 of the Planning Act, R.S.O. 1990 and the regulations thereto.
