WHEREAS SHIRLEY ANN Y ANKOO ("Yankoo") is the registered owner of Part of West half of Lot 21, Concession 14, shown as Part 3 on a Plan of survey prepared by S. Palu, O.L.S. on June 18th, 1965 (the "subject property), pursuant to instrument no. 267314 registered on May 1, 1968 in the Land Registry Office for the County of Simcoe; AND WHEREAS Yankoo's property contains a portion of the original unopened road allowance between Lots 20 and 21; AND WHEREAS instrument no. 195520, (being a deed to Yankoo's predecessor in title), indicates that the trespass road was given in lieu of the original road allowance between Lots 20 and 21; AND WHEREAS sections 316 and 317 of the Municipal Act provide for a conveyance of the original road allowance to the person who is in possession of it, if that person's predecessors in title have laid out and opened a new road in place of the original road allowance without receiving compensation for it. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE HEREBY ENACTS AS FOLLOWS: 1. That the Mayor and the Clerk are hereby authorized to execute on behalf of the Corporation of the Township of Oro-Medonte, a quit claim deed to Shirley Ann Yankoo confirming that the municipality has no interest in the subject property.
