It is our understanding that the purpose and effect of this application is to sever one th residential lot from the lands known as 392 10 Line S. Based on available mapping, the subject lands are within the Lake Simcoe watershed and contain key natural heritage features (significant woodland) and key hydrologic features (wetlands). The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the Lake Simcoe Protection Plan (LSPP) and Ontario Regulation 179/06 under the Conservation Authorities Act. Based on available mapping and the submitted materials, it appears a lot line is proposed through a key natural heritage feature. Designated Policy 6.23 of the LSPP states that development, which includes the creation of a lot, is not permitted within a key natural heritage feature or key hydrologic feature and within a related vegetation protection zone (30m). As such, we recommend deferral of this application until the following matters are addressed to our satisfaction: That the applicant provide a Natural Heritage Evaluation demonstrating conformance with all natural heritage policies of the PPS and LSPP. Among other things, this study should demonstrate that the property has two building envelopes outside of any key natural heritage features and/or key hydrologic features and the required 30m vegetation protection zone. You will want also want to reach out to Township planning staff to confirm the proposal conforms to the local Official Plan. Your property is primarily designated to Greenlands in the County Official Plan, with a small pocket of lands at the north of the property being with in the Rural designation. I’ve included a couple images showing the County Official Plan land use designations for your property. The green colour depicts the Greenlands designation, while the brown colouring depicts the Rural designation. Residential lot creation is permitted within the Rural designation (subject to certain criteria), however, it is not a permitted use within the Greenlands designation. You would be limited to creating a new residential lot to the lands that are designated Rural. I calculate this area to be approximately 1 acre in size, with approximately 65m of frontage along Line 1 South. If you decide to bring an application forward to create a residential lot, the County will request that the following conditions be fulfilled in accordance County Official Plan policies: -That access to the lot be from Line 5 South. The County will not grant an entrance permit onto Ridge Road (County Road 20) in accordance with County Official Plan policy 4.8.32. You will want to confirm that the Township can grant an entrance permit for Line 10 South. -The basic right-of-way width from County Road 20 is 30.5m, as identified on Schedule 5.4 to the County Official Plan. The current right-of-way width is approximately 25m. The County will require a road widening of approximately 2 to 2.5m from both the retained and proposed lot (along County Road 20) so the distance to the edge of the right-of-way from the centreline is th approximately 15.25m. The daylight triangle at the intersection of County Road 20 and the 10 Line South will have to measure 15m x 15m from the new lot line. -All costs associated with the land transfer, including costs relating to surveying, legal fees, and disbursements, agreements, HST, etc. shall be fully borne by the applicant. All legal documentation is to be negotiated, prepared and registered by the Legal Services Department of the County and to be executed where required by the Applicant. The Applicant shall submit to the Legal Services Department of the County a deposit in the amount of $1000.00 prior to the services being rendered. -The County of Simcoe would be requesting the road widening pursuant to section 53(12) of the Planning Act and such land will form part of the highway to the extent of the designated widening in accordance with section 31(6) of the Municipal Act, 2001. The widening of County Road 20 is required pursuant to the County’s standards for construction and is consistent with proper safety standards. -Please note that the County’s Setback By-law does not permit structures with 15m of the new lot line.
