Take notice that the Township of Oro-Medonte deemed the following applicationto amend Zoning
th
By-law No. 97-95, as amended, a “Complete Application” pursuant to the Planning Acton the 10
day of November, 2017.
And take noticethat the Development Services Committee of the Corporation of the Township of
Oro-Medonte will hold a Public Meeting on Wednesday,January 3, 2018, at 5:30p.m.in the
Municipal Council Chambers. The purpose of the Public Meeting is to notify the publicand to
obtain publiccomments on aproposed Amendment to the Zoning By-law.
The subject landsare described as Part of Lots 1 and 2, Concession 3, Part 1 on 51R-9949.A
key mapillustrating the location of the subject landsis included with this Notice.
The purposeand effect of the proposedZoning By-law Amendment is to rezone the subject
lands from “Agricultural/Rural (A/RU) Zone”to “Agricultural/Rural Exception (A/RU*) Zone”to
permit the development of an outdoor Nordic spa with associated uses (corporate meeting
facilities/chalets, restaurants/bistros, administrative offices, retail uses and personal service
uses).
Any personmay attend the public meeting and/or make written or verbal representation either in
support of, or in opposition to, the proposed Zoning By-law Amendment. Writtencomments by
any person unable to attend the meeting should be mailed/faxed/e-mailed to the Secretary-
Treasurer, The Corporation of the Township of Oro-Medonte to be received no later than 12:00
p.m. noon on January 3, 2018. Please ensure that you include your name and address so that
you may be contacted if necessary.
If a person or public body does not make oral submissions at the public meeting or make written
submissions to the Secretary-Treasurer, The Corporation of the Township of Oro-Medonte before
the proposed Zoning By-law Amendment is passed or refused, the person or public body is not
entitled to appeal the decision of the Council of the Township of Oro-Medonte to the Ontario
Municipal Board and may not be added as a party to the hearing of an appeal before the Ontario
Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.
The application is part of the public record and is available to the public for viewing/inspection
between 8:30 a.m. and 4:30 p.m. at the Township of Oro-Medonte Administration Buildingand
available on the Township’s website www.oro-medonte.ca. Any person wishing further
information or clarification with regard to the application or to arrange to inspect the application
should contact the Planning Division at 705-487-2171. Individuals who submit letters and other
information to Council and its advisory bodies should be aware that all information, including
contact information, contained within theircommunications may become part of the public
record and may be made available through the agenda process which includes publication on
the Township’s website.
If you wish to be notified of the decision of the Township of Oro-Medonte in respect to the
proposed Zoning By-law Amendment, you must make a written request.

Re: Vetta Nordic Spa Zoning By-law Amendment and Consent to Sever applications

Dear Mayor Hughes and Members of Council,
We would like to take this opportunity to express our support for both the Zoning By-law
Amendment application and the Consent to Sever application, which have been
submitted by Mr. Eric Harkonen of Vetta Nordic Spa. This is a passive, compatible
recreational asset for our community, with health and employment benefits.
Mr. Harkonen has provided our Property Owners Association with an overview of the
proposed Vetta Spa, met with residents, and we feel that it would be a welcome addition
to our community. We particularly appreciate that the owner has approached us at an
early stage in the planning process to advise us of the features of the proposed land
use, and his desire to work closely with the community going forward.
We are aware that the applications will be considered by the Development Services

The Building Department comments are as follows.
Detailed specifications on limiting distance separations and unprotected
openings may be required.
Soil conditions should be evaluated and sewage system envelope, clearances
and design is required to be in conformance with the OBC.
Further to our comments above, special consideration should be taken in the
process/design of the excavation and the requirements of OH&S Act. Excavations must
not negatively effect neighbouring properties.

Thank you for circulating the Lake Simcoe Region Conservation Authority (LSRCA) on the above-noted
Application for Minor Variance.
The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the Lake
Simcoe Protection Plan (LSPP) and Ontario Regulation 179/06 under the Conservation Authorities Act. The
subject property is located on the shore of Lake Simcoe and is subject to shoreline erosion and flooding
hazards.
Based on our review of the submitted materials we are satisfied from a watershed management perspective
that this application is consistent with the Natural Heritage and Natural Hazard Policies of the PPS and
conforms with the requirements of the LSPP. As such, we recommend that any approval of this application be
subject to the following condition:
The applicant shall obtain a permit from the LSRCA for any development or site alteration within the
lands regulated under Ontario Regulation 179/06 of the Conservation Authorities Act.

Minor Variance Application 2017-A-60
Dear Secretary Treasurer,
I object to the proposed variance at 23 Greenwood Forest Road for the following reasons:
I am concerned about the impact on my privacy and property value should Ms. Galic build within 1.3
metres from the property line. My property includes a community easement between our
properties. The easement has a negative impact on my property value and optimizing my privacy is
important to me.
on 3 different dates. Each contractor claimed to be
unaware that the easement was my property. This confusion may have resulted because all the survey
stakes that designated the property line were removed by unknown persons.

On December 5, 2017, Ms. Galic and I met. I told her my concerns about the lack of regard for my
property and the reasons that I would object to the proposed variance. I was concerned about Ms.
her application would be granted regardless of the
submissions at the public hearing.
A mature cedar hedge was on the property line from the street to half way down the property. It is
clearly marked on my 2013 property survey. contractors cut down all the cedars and
removed all the vegetation from the easement without consultation or permission from me. She has
apologized.
Ms. Galic is legally obligated to replace the cedar hedge when her project is completed. However, she
advised me that her driveway/garage design meant that she could not replace the cedar hedgeon the
property line and put in a fence on her yard because she did not have adequate space.
Based on the above circumstances I respectfully request that the Oro-Medonte Town Council deny the
requested variance.

s homeowners located immediately to the west of 23 Greenwood Forest Road, we are

opposed to the side yard variances requested by way of minor variance application
2017-A-60.
These variances if granted, would have a significant negative impact on our family’s
privacy and enjoyment of our residence.
A structure of this size is not in keeping with the character of the neighbourhood and not
compatible with existing residences.
New residences have been constructed in this neighbourhood which complied with the
required set backs. These residents respected the community and their neighbours’
right to enjoy their privacy and lifestyle.
We are concerned about setting a negative precedent for future construction.
Having a building 1.3 m from our property line and 4.3m from our house is unacceptable
as it increases the fire hazard.
The proposed variances, if granted, would result in an unacceptable adverse impact on
us as immediately adjacent neighbours.
The request to reduce both side yard setbacks to less than half of the by-law standardis
not minor.
This request is not desirable for the appropriate development of the applicant’s land and
does not maintainthe intent and purpose of the Township’s Official Plan and Zoning By-
law.
For all of these reasons, we are strongly opposed to these variances and respectfully
request that the Committee of Adjustment deny Application 2017-A-60.

This Application is problematic from the perspective of access / egress to the Lot by
way of a typical driveway entrance,
compounded by drainage issues that may result along the roadside, due to the fact the
building is (almost) immediately
adjacent to the Municipal Right of Way.
There is little depth to the Driveway to allow for a vehicle pulling of the travelled portion
of the road prior to needing to stop and access the
garage entrance. Even with automatic door openers, power failure or mechanism failure
would prevent sufficient depth / space to
park vehicles within the private property and away from the travelled road.
As well, there is insufficient space to accommodate snow storage during winter
operations.
Development Engineering would not be in support of this Application for the reasons
above.
Should accommodation to address these issues be made with Operations and
Community Services, I would review this
Application again at that time.

Application Summary
Thank you for circulating the County of Simcoe. County planning staff understand that the applicant is
proposing a boundary adjustment that is to sever approximately 0.81 hectares (2 acres) from the subject
lands, and merge the balance of the subject lands (approx. 34.75 ha/85.9 ac) with a landlocked parcel to
the north-west. The merger will increase the size of the retained portion to 52.35 ha (129.36 ac).
The subject lands are entirely within the Greenlands designation as per Schedule 5.1 – Land Use
Designations of the Simcoe County Official Plan (SCOP). Furthermore, the subject lands appear to be
partially within a Provincially Significant Wetland (PSW) as per Schedule 5.2.2 – Streams and Evaluated
Wetlands of the SCOP.
Application Comments
As stated above, the subject lands appear to be partially within a PSW, with the 0.81 ha (2 acre) portion
of vacant land proposed to be severed being outside the PSW. County planning staff are of the opinion
that while no additional lot are to be created as a result of the proposed boundary adjustment, the
severed 0.81 ha (2 acre) portion of vacant land would constitute a developable lot. Furthermore, the lot
proposed to be severed is within 120 meters of the PSW. Section 2.1.8 of Provincial Policy Statement,
2014, (PPS) states that:
“Development and site alteration shall not be permitted on adjacent lands to the natural
heritage features and areas…unless the ecological function of the adjacent lands has been
evaluated and it has been demonstrated that there will be no negative impacts on the natural
features or on their ecological functions.”
Furthermore, the PPS states that for the purpose of section 2.1.8 adjacent lands means:
“…those lands contiguous to a specific natural heritage feature or area where it is likely that
development or site alteration would have a negative impact on the feature or area. The extent of the
adjacent lands may be recommended by the Province or based on municipal approaches which achieve
the same objectives;” (PPS, 2014: Pg. 38).

The Ministry of Natural Resources Natural Heritage Resource manual recommends a width of 120
metres be used when considering the potential negative impact of development on a PSW.
Being that the 0.81 ha (2 acre) vacant lot proposed to be severed from the subject lands is within 120 of
the PSW, meeting the abovementioned criteria of adjacent lands, the applicant should be required to
consult with the Nottawasaga Valley Conservation Authority (NVCA) to determine if an Environment
Impact Statement (EIS) is required to satisfy Section 2.1.8 of the PPS. If required, the EIS should also
determine if the severed lot can accommodate a sufficiently sized developable area, and should be
completed to the satisfaction of the NVCA.
Finally, we note that the property is on lands with primarily Class 3, Class 4, and Organic Soils as per the
Canada Land Inventory. The 0.81 ha (2 acre) vacant lot proposed to be severed are on lands with Class 4
and Organic soils. Please be advised that the possible presence of the organic soils, and the proximity of
the PSW, may reduce the size of the development envelope on the lot proposed to be severed.
Conclusion
County planning staff do no object to the proposed consent application. However, it is recommended
that approval of the application be conditional on the applicant receiving confirmation from the NVCA
that an EIS is not required to support the proposed boundary adjustment. If an EIS is required, approval
of the application should be conditional on completion of an EIS to the satisfaction of the NVCA.

I received a notice of this proposed buildingat the residence 22 Baycrest. I have a few
questions that have not been noted on the drawing. Type of building to be constructed.
How high is the building.what is the purpose of the building. would this be for
personal use or business, Is it legal to have entrance of the back of this property. I f this
is to be used for anything other than personal use what amount of parking would be
available. Baycrest Dr is a narrow road would not like to see cars parked along the road.

Thank you for circulating the Lake Simcoe Region Conservation Authority (LSRCA) on the above-noted
Application for Minor Variance. We understand the applicant is proposing to construct a detached garage and
addition of a second level onto an existing boathouse containing a kitchen and two-piece bathroom. The LSRCA
has reviewed this application in the context of the Provincial Policy Statement, the Lake Simcoe Protection Plan
and Ontario Regulation 179/06 under the Conservation Authorities Act.
We recommend this application be refused for the following reason:
Based on our review it appears this application involves the creation of habitable space in a boathouse.
It is our mutual objective to direct development and people away from natural hazards such as
flooding, erosion and ice piling. To help meet this objective, we require that no new habitable space be
permitted in boathouses.
To successfully obtain a LSRCA permit, the application for an addition of a second level onto an existing
boathouse must be for storage purposes only, have a maximum ceiling height of 5ft and not be serviced. In
addition the owner must register a Restrictive Covenant under the Conservation Land Act prohibiting habitable
space and acknowledging the structure could be damaged by Lake hazards.

Due to the specific nature of this Application, Development Engineering has No
Objection to the Reduction in Parking.
The only concern would be in the event of a change of use at some point in time, there
maybe a requirement for an increase in parking as a result.

Hi Derek,
In addition to the attached letter, we recommend that any approval of this application be subject to the
following conditions:
That a plan of survey be undertaken by an OLS to the satisfaction of the LSRCA showing that the
proposed access to the new lot will be located outside the significant woodland feature.
That the Owner shall pay all development fees to the LSRCA in accordance with the approved Fees
Policy under the Conservation Authorities Act.
It appears the lot line on the Severance Sketch circulated with the application dated December 13, 2017
does not match the survey plan we approved i.e. it appears the lot line should be further south of the
tennis court to accommodate a driveway outside the woodland feature.
Dennis- please find the invoice attached. I believe a copy is also being mailed to you.
