Public Meetings: a) Notice of Receipt of a Complete Application, Notice of Particulars and Public Access, Notice of Public Meeting for a Proposed Amendment to the Zoning By-law of the Township of Oro-Medonte, Lot 8, Plan 860, 2679 Lakeshore Road East, Application 2017-ZBA-11 (Doug & Kim Campbell). Deputy Mayor Hough called the meeting to order at 5:33 p.m. and explained the public meeting is being is being held in accordance with Section 34 of the Planning Act to obtain public comment with respect to a proposed Zoning By-law Amendment Application. The purpose of Application 2017-ZBA-11 is to permit a Bed and Breakfast Establishment. Notice of the Public Meeting was circulated to the appropriate Agencies and posted on the Township's website on or before September 27th, 2017. The following correspondence was received: Township of Oro-Medonte, Manager, Development Engineering dated September 27, 2017; Lake Simcoe Region Conservation Authority dated September 28, 2017; Simcoe County District School Board dated September 28, 2017; Rima and Norman Biback dated October 12, 2017; Cathie Bass dated October 30, 2017; Dean Blaine dated November 1, 2017; Paul Sanderson dated November 1, 2017. Derek Witlib, Manager, Planning Services, explained the purpose and effect of the proposed amendment. A PowerPoint presentation was presented. Doug Campbell, applicant, was present. The following public persons offered verbal comments with respect to the proposed amendment: Dean Blaine provided comments regarding his submitted correspondence. Comments included concern with permanent zoning by-law amendment and potential less responsible future owners, zoning/official plan concerns, larger lot sizes in the Township vs. smaller lot sizes in the area in accordance with the application; introducing an amendment in a residential area; precedent setting, zoning by-law is correct in terms of where B&B's are now allowed, use, enjoyment and privacy of properties. That Report No. DS2017-127, Todd Weatherell, Intermediate Planner re: Minor Variance Application 2017-A-39 by Rob Love, Robin Reynolds, Elyse Chazan, Martin Vanderwoude, 10028 Highway 12 be received and adopted. 2. That Minor Variance Application 2017-A-39 by Rob Love, Robin Reynolds, Elyse Chazan, Martin Vanderwoude, specifically to construct an addition to be used as an accessory apartment with a maximum floor area of the apartment being 131.5 square metres (1415.5 sq. ft.), be approved. 3. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Section 5.4 of Zoning By-law 97-95, the proposed addition shall otherwise comply with all other applicable provisions of the Zoning By-law; b) That the proposed addition/apartment on the property be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; c) That the appropriate Zoning Certificate and Building Permit be obtained only after the Committee's decision becomes final and binding, as provided for within the Planning Act R.S.O. 1990, c.P. 13. 4. The following public persons offered verbal comments Guenther Wellnhofer provided comments on zoning uses, number of severances on one lot, stewardship on farmland, future building on the lot, setting a precedent, road safety, location, privacy and growing crops concerns. That Report No. DS2017-130, Todd Weatherell, Intermediate Planner re: Consent Application 2017-B-19 (Storey), 2191 Line 2 North, Con. 3, North Part Lot 7 be received and adopted. 2. That the Development Services Committee.approve Consent Application 2017-B-19, subject to the following conditions: a) That one copy of a Registered Reference Plan for the subject lands indicating the severed parcel be prepared by an Ontario Land Surveyor and be submitted to the Secretary - Treasurer. b) That the applicant's solicitor prepares and submit a copy of the proposed conveyance for the parcel severed, for review by the Municipality. c) That the applicant pays $ 2,000.00 to the Township for the severed lot created as cash -in - lieu of a parkland contribution. d) That all municipal taxes be paid to the Township of Oro-Medonte. e) That the applicant signs the Township's Memorandum of Understanding by which the applicant acknowledges the requirements and timing of matters that may include; payment of development charges, payment of cash in lieu of parkland, detailed design of a building or septic system, engineered lot grading, and water and sanitary servicing, on either the vacant severed or vacant retained parcel. f) That the applicant applies for and obtains approval of a Minor Variance to permit a minimum lot area of 1.54 hectare (3.82 acres) for a hobby farm on the severed parcel. g) That the conditions of consent imposed by the Committee be fulfilled within one year from the date of the giving of the notice. 3. That Report No. DS2017-132, Andy Karaiskakis, Senior Planner re: Minor Variance Application 2017-A-55 Thomas & Benita Kerr, 877 Woodland Drive be received and adopted. 2. That Minor Variance Application 2017-A-55 by Thomas & Benita Kerr specifically to permit the construction of a new detached accessory building (garage) with a maximum accessory building lot coverage of 7.7 percent and a maximum floor area of 79.1 square metres (852.0 square feet), on lands known as 877 Woodland Drive, Township of Oro- Medonte, be approved. 3. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Sections 5.1.5 and 5.1.6 of Zoning By-law 97-95, as amended, the proposed detached accessory building shall otherwise comply with all other applicable provisions of the Zoning By-law. b) That the proposed detached accessory building be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee. c) That the applicant maintains and preserves the existing vegetative buffer on the front and interior property lines or if damaged during construction, replace with a vegetative buffer similar in species type and size. d) That the applicant satisfy any permits and/or approvals from the Lake Simcoe Region Conservation Authority. e) That the appropriate Zoning Certificate, Engineered Lot Grading Plan and Building Permit be obtained from the Township only after the Committee's decision becomes final and binding, as provided for within the Planning Act R.S.O. 1990, c.P. 13. 4. That Report No. DS2017-134, Deborah -Ann Liske, Planner re: Minor Variance Application 2017-A-57 Ted & Victoria Gowland, 181 Moon Point Drive be received and adopted. 2. That Minor Variance Application 2017-A-57 specifically to permit a detached accessory building with a reduced front yard setback of 3.5 metres on the lands municipally known as 181 Moon Point Drive, Township of Oro-Medonte, be approved. 3. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Section 5.1. 3.a) of Zoning By-law 97-95, the proposed agricultural building shall otherwise comply with all other applicable provisions of the Zoning By-law. b) That the proposed buildings/structures and landscaping on the property be substantially and proportionally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee. c) That an Ontario Land Surveyor may be required to verify by pinning the foundation wall and verifying in writing by way of survey/real property report, prior to the pouring of the footing and if no footing, the foundation, that the detached accessory building is located no closer than 3.5 metres from the front property line. d) That the appropriate Zoning Certificate and Building Permit be obtained from the Township only after the Committee's decision becomes final and binding, as provided for within the Planning Act R.S.O. 1990, c.P. 13. 4. And that the applicant be advised of the Committee's decision under the Secretary - Treasurer's signature. Carried.
