09 06 2017 2017-ZBA-06 (Astin)Notice of Receipt of a Complete Application Notice of Particulars and Public Access and Notice of Public Meeting for Proposed Amendments to the Zoning By-law of the Township of Oro-Medonte 2017-ZBA-06 (Astin) Take notice that the Township of Oro-Medonte deemed the following application to amend the Zoning By-law 97-95, as amended, a "Complete" Application under the Subsection 34 of the Planning Act, R,S.O. 1990, c. P. 13 on the 12"' day of July, 2017. Take notice that the Development Services Committee of the Township of Oro-Medonte will hold a Public Meeting on Wednesday, September 6, 2017 at 5:30 p.m. in the Municipal Council Chambers. The purpose of the Public Meeting is to obtain public comments on a proposed Amendment to the Zoning By-law, under Section 34 of the Planning Act, R.S.O. 1990 c. P. 13. The subject lands are located at 425 Line 8 North, in Concession 9, Part Lots 18 & 19, Township of Oro-Medonte. The purpose and effect of the proposed Zoning By-law Amendment is to permit the construction of a Garden Suite on the subject property on a temporary basis for a period of 20 years as provided for under the Planning Act. The subject land is designated 'Agricultural' in theTownship's Official Plan and zoned Agricultural/Rural (A/RU) Zone' in the Township's Zoning By-law 97-95, as amended. A key map illustrating the location of the subject lands, and a copy of the applicants site plan including the lands to be rezoned are included with this notice. And take further notice that pursuant to Section 34 (10.7) of the Planning Act, the Application is part of the public record and is available to the public for viewing/inspection between 8:30 a.m. and 4:30 p.m. at the Township of Oro-Medonte Administration Building. Any person wishing further information or clarification with regard to the application or to arrange to inspect the application should contact Planning Services at 705-487-2171. If you are submitting letters, faxes, smalls, presentations or other communications with the Township concerning this application, you should be aware that your name and the fact that you communicated with the Township will become part of the public record. The Township will also make your communication and any personal information in it available to the public, unless you expressly request the Township to remove it. Any person may attend the public meeting and/or make written or verbal representation either in support of, or in opposition to, the proposed Amendment. If a person or public body that files an appeal of a decision of the Township of Oro-Medonte in respect of the proposed Amendment does not make oral submission at the Public Meeting, or make written submissions to the Township before the proposed Amendment is adopted, the Ontario Municipal Board may dismiss all or part of the appeal. The LSRCA has reviewed this application for consistency with the Provincial Policy Statement (PPS) and conformity with the Lake Simcoe Protection Plan. It should also be noted that a part of the subject lands is governed by Ontario Regulation 179/06 (OR 179/06) under the Conservation Authorities Act. To ensure consistency and conformity with the provincial plans and policies Including the regulatory requirements under the Conservation Authorities Act, the LSRCA has no objection to this rezoning application provided that all development including the placement of the garden suite will be located: 1. A minimum of 30 metres from the key natural heritage features on-site; and 2. Outside the area subject to Ontario Regulation 179/06. As you are aware, a part of the property contains wetland and significant woodland according to existing mapping. The wetland and woodland are defined as key natural heritage and hydrologic features in accordance with the Lake Simcoe Protection Plan. Additionally, the wetland feature and an adjacent 30 metres represent the area subject to OR 179/06. As you know defining the area to which the temporary use by-law can apply can be achieved in accordance with subsection 39.1.3 of the Planning Act. In doing so, this will eliminate the need for an Environmental Impact Study, Natural Heritage Evaluation and LSRCA permit requirements. it will also help ensure the wetland and significant woodland and their functions will be maintained.
