Take notice that the Township of Oro-Medonte deemed the following application to amend Zoning By-law No. 97-95, as amended, a "Complete Application" pursuant to the Planning Act on the 1r day of July 2017. And take notice that the Development Services Committee of the Corporation of the Township of Oro-Medonte will hold a Public Meeting on Wednesday, September 6, 2017, at 6:00 p.m. in the Municipal Council Chambers. The purpose of the Public Meeting is to notify the public and to obtain public comments on a proposed Amendment to the Zoning By-law. The subject lands are located at 5071 Highway 11 North and are described as East Part of Lot 16, Concession 14 (Oro). A key map illustrating the location of the subject lands is included with this Notice. Written comments by any person unable to attend the meeting should be mailed/faxed/e-mailed to the Secretary - Treasurer, The Corporation of the Township of Oro-Medonte and would be appreciated by 12:00 p.m. noon on September 1, 2017. Please ensure that you include your name and address so that you may be contacted if necessary. If a person or public body does not make oral submissions at the public meeting or make written submissions to the Secretary -Treasurer, The Corporation of the Township of Ora-Medonte before the proposed Zoning By-law Amendment is passed or refused, the person or public body is not entitled to appeal the decision of the Council of the Township of Oro-Medonte to the Ontario Municipal Board and may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so. The application is part of the public record and is available to the public for viewing/inspection between 8:30 a.m. and 4:30 p.m. at the Township of Oro-Medonte Administration Building and available on the Township's website www.oro-medonte.ca. Oro-Medonte, ON LOL 2EO Dear Mr. Witlib: Re: Application for Zoning Bylaw Amendment 5071 Highway 11 North Township of Oro-Medonte, County of Simcoe Thank you for consulting with the Lake Simcoe Region Conservation Authority (LSRCA) with regard to this zoning by-law amendment application. The LSRCA has reviewed this application for consistency with the Natural Heritage and Natural Hazard policies of the Provincial Policy Statement (PPS) and conformity with the Lake Simcoe Protection Plan (LSPP) and Ontario Regulation 179/06 (OR 179/06) under the Conservation Authorities Act. Based on available mapping the property contains key natural heritage and key hydrologic features in accordance with the LSPP and areas subject to OR 179/06, such as: a tributary of Bluffs Creek, meanderbelt (erosion associated with the watercourse), Provincially Significant Wetland, floodplain, significant valleyland and significant woodland. To ensure consistency and conformity with the provincial plans and policies including the regulatory requirements under the Conservation Authorities Act, we recommend that the temporary use by-law only apply to the non -environmental area on the property. This would ensure all development will be located a minimum of 30 metres from key natural heritage and key hydrologic features on-site in accordance with Policy 6.23 -DP of the LSPP and outside the areas subject to environmental hazards identified under OR 179/06. To accurately delineate the appropriate lands for the temporary use by-law, we request the application be deferred until the following information is provided to our satisfaction: 1) A topographic survey completed and signed by an Ontario Land Surveyor to assist in accurately delineating the flood prone area on the property. 2) A natural heritage evaluation is required to identify the location of the key natural heritage and key hydrologic features and their appropriate buffers (minimum 30m), in accordance with LSPP Policies 6.25 -DP and 6.26 -DP. This evaluation should also assess for natural heritage features as identified in the PPS, such as significant wildlife habitat.
