09 06 2017 2017-ZBA-07 (Diamond Valley Estates)Notice of Receipt of a Complete Application Notice of Particulars and Public Access (9ra��llc�%nte Notice of Public Meeting for a Proposed Amendment to the Zoning By-law of the Township of Oro-Medonte 2017-ZBA-07 (Diamond Valley Estates) Take notice that the Township of Oro-Medonte deemed the following application to amend Zonin�q By-law No. 97-95, as amended, a "Complete Application' pursuant to the Planning Act on the 14 day of July, 2017. And take notice that the Development Services Committee of the Corporation of the Township of Oro-Medonte will hold a Public Meeting on Wednesday, September 6, 2017, at 5:45 p.m. in the Municipal Council Chambers. The purpose of the Public Meeting is to notify the public and to obtain public comments on a proposed Amendment to the Zoning By-law. The subject lands are described as Block 136, Registered Plan 51 M-957. A key map illustrating the location of the subject lands is included with this Notice. The purpose and effect of the proposed Zoning By-law Amendment is to rezone the subject lands from "Open Space Exception 73 Hold (OS*73(H)) Zone" to "Residential One Exception 71 (R1*71) Zone" to permit the construction of a single detached dwelling. Any person may attend the public meeting and/or make written or verbal representation either in support of, or in opposition to, the proposed Zoning By-law Amendment. Written comments by any person unable to attend the meeting should be mailed/faxed/e-mailed to the Secretary - Treasurer, The Corporation of the Township of Oro-Medonte to be received no later than 12:00 p.m. noon on September 6, 2017. Please ensure that you include your name and address so that you may be contacted if necessary. If a person or public body does not make oral submissions at the public meeting or make written submissions to the Secretary -Treasurer, The Corporation of the Township of Oro-Medonte before the proposed Zoning By-law Amendment is passed or refused, the person or public body is not entitled to appeal the decision of the Council of the Township of Oro-Medonte to the Ontario Municipal Board and may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so. The application is part of the public record and is available to the public for viewing/inspection between 8:30 a.m. and 4:30 p.m. at the Township of Oro-Medonte Administration Building and available on the Township's website www.oro-medonte.ca. In review of the provided circulation memo and applicant's planning justification report our authority offers the following comments: Conservation authority staff accept the provided justification for the rezoning of this individual parcel to allow for a single detached dwelling on the presently Open Space zoned site. However, in consideration of the Provincially Significant Wetlands (West Coulson Swamp) occurring on adjacent parcels to the north and east; and with unevaluated features noted forthe northern portions of the parcel currently being considered for rezoning, we would recommend alterations to the proposed rezoning schedule to recognize and protect the noted wetland features. Extending the adjacent Environmental Protection (EP) zoning onto the northern portions of the currently zoned OS*73(H) (as shown in the attached drawing above) parcel will protect natural heritage features in following Section 2.1.8 of the Provincial Policy Statement, Conservation Authority policies, and the Township of Oro-Medonte Official Plan. We would further note that the site occurs within an area of regulatory review whereby permits (or approvals) will be required from the conservation authority for any future development.
