Motion No. SC170721-1 Moved by Hall, Seconded by Jermey Be it resolved that the agenda for the Special Council meeting of Friday, July 21, 2017 be received and adopted; And that the correspondence dated July 19, 2017 and received from Tyson Alexander, President, Motorhome Escapes Canada; Derick Lehmann; Adam R. Burton; Greg Groen, Oro-Medonte Chamber of Commerce; be received. 3. Disclosure of Pecuniary Interest: None declared. 4. Closed Session Items: a) Motion to go In Closed Session. Reports of Municipal Officers: a) Andria Leigh, Director, Development Services re: Adaptive Management Plan Agreement Between the Corporation of the Township of Oro-Medonte and 1350341 Ontario Inc., 2437339 Ontario Inc. and 2434219 Ontario Inc. Motion No. SC170721-5 Moved by Coutanche, Seconded by Crawford Be it resolved That the correspondence presented by Andria Leigh, Director, Development Services re: Adaptive Management Plan Agreement Between the Corporation of the Township of Oro- Medonte and 1350341 Ontario Inc., 2437339 Ontario Inc. and 2434219 Ontario Inc. be received. And Whereas the Ontario Municipal Board issued its decision in Case No. PL151011 allowing the appeal respecting Burl's Creek's temporary use by-law application to amend Township Zoning By-law No. 97-95 to permit amongst other things, camping parking and concession booths on lands adjacent to 92 acres of lands zoned for special event purposes; And Whereas the Ontario Municipal Board Order is conditional on an agreement for the implementation of an Adaptive Management Plan between Burls Creek and the Township being entered into and registered on title; Now Therefore be it resolved that the Mayor and Deputy Clerk be authorized to execute the Adaptive Management Plan between the Township of Oro-Medonte and Burl's Creek dated July 19, 2017. Carried. Page 4 of 7 Special Council Minutes — Friday, July 21, 2017. b) Robin Dunn, CAO re: Memorandum of Understanding Between The Corporation of the Township of Oro-Medonte and Burl's Creek. Motion No. SC170721-6 Moved by Crawford, Seconded by Coutanche Be it resolved That the correspondence presented by Robin Dunn, CAO re: Memorandum of Understanding Between The Corporation of the Township of Oro-Medonte and Burl's Creek be received. And Whereas the Township of Oro-Medonte did enter into a Memorandum of Understanding (MOU) with Burl's Creek in 2015 and 2016 to address a number of specific matters relating to special events on lands owned and/or leased by Burl's Creek, including the provision of financial securities and the reimbursement to the Township of various expenses associated with the holding of special events on those lands; And Whereas the CAO has been directed by Council to renegotiate a MOU with Burl's Creek; And Whereas the provisions of the draft MOU address matters related to risk management and controls, including allowable sound level limits and times for the planned 2017 Wayhome and Boots and Hearts Festivals, have been reviewed and recommended by Township Legal Counsel and the Township's Acoustical Engineer; Now Therefore be it resolved that the Mayor and Deputy Clerk be authorized to execute the renewed Memorandum of Understanding between the Township of Oro-Medonte and Burl's Creek dated July 19, 2017. Motion No. SC170721-7 Moved by Coutanche, Seconded by Crawford Be it resolved That the PowerPoint presentation dated July 21, 2017 and presented by Shawn Binns, Director, Operations and Community Services re: Consideration of Special Events Permits for Wayhome and Boots and Hearts Festivals be received, And Whereas Burl's Creek have submitted such operational plans as may be required by the Special Events By-law including operational plans as required pursuant to Section 2.11 of said By-law; And Whereas the Township of Oro-Medonte did enter into a Memorandum of Understanding with Burl's Creek in both 2015 and 2016 to address a number of specific matters relating to special events on lands owned and/or leased by Burl's Creek, including the provision of financial security and the reimbursement to the Township of various expenses associated with the holding of special events on those lands; And Whereas by Resolution No. "SC170721-06"", the Mayor and Deputy Clerk have been authorized to execute a Memorandum of Understanding with Burl's Creek; And Whereas the Ontario Municipal Board issued its decision in Case No. PL151011 allowing the appeal respecting Burl's Creek's temporary use by-law application to amend Township Zoning By-law No. 97-95 to permit amongst other things, camping parking and concession booths on lands adjacent to 92 acres of lands zoned for special event purposes Now Therefore be it resolved that, pursuant to the Special Events By-law, as amended, Council of the Township of Oro-Medonte issues Special Events Permits for each of the 2017 Wayhome and the 2017 Boots and Hearts music festival events, for the 526 acres which are zoned in By-law No.97-95 as Private Recreation Exception 30 and 31 and/or were approved through the Temporary Use By-law by the Ontario Municipal Board, conditional upon: • obtaining the approvals as set forth in Section 2.11 of the Township's Special Event By-law; • adherence with the Special Events By-law, including the conditions in Section 2.12, and such conditions as may be deemed appropriate in accordance with the Special Events By-law; • adherence to the 2017 Memorandum of Understanding; • execution and registration of the Adaptive Management Plan; • compliance with all operational plans as required under the Special Events By-law. And that the CAO be authorized to prepare and issue the Special Events Permits in accordance with the above direction from Council. Carried. Confirmation By -Law: a) By -Law No. 2017-110: Being a by-law to confirm the proceedings of the Special Council meeting held on Friday, July 21, 2017.
