Thank you for circulating the Nottawasaga Valley Conservation Authority \[NVCA\] on
omplete Application and Notice of Public
\[2017-ZBA-04\] for the Braestone Development located on part of the
Lots 2 and 3, Concession 9 and Lots 1 to 59 inclusive Registered Plan 51M-1070.
We understand that the purpose and effect of the proposed Zoning by-law
Amendment is to amend the Residential one Exception 75 (R1*75) zone to include
provisions that would permit detached accessory buildings and structures to be
constructed to a maximum floor area of 150 square metres (1,615 square feet).
Please accept this email as confirmation that the NVCA has no objection to the
proposed zoning by-law amendment.
We note that portions of the subject property are partially regulated pursuant to
nce with Wetlands
and Alterations to Shorelines and Watercourses Regulation. Permits are required from
NVCA prior to construction or grading on regulated portions of this property.

Thank you for circulating the Lake Simcoe Region Conservation Authority on the above-noted Application for
Minor Variance.
The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the Lake
Simcoe Protection Plan (LSPP), and Ontario Regulation 179/06 under the Conservation Authorities Act. The
subject lands are located on the shore of Lake Simcoe and are subject to its associated erosion hazards.
Based on our review of the submitted materials we are satisfied from a watershed management perspective
that this application is consistent with the Natural Heritage and Natural Hazard Policies of the PPS, conforms
with the requirements of the LSPP, and Ontario Regulation 179/06 of the Conservation Authorities Act. As
such, we recommend that any approval of this application be subject to the following conditions:
1. The applicant shall obtain a permit from the LSRCA for any development or site alteration within the
lands regulated under Ontario Regulation 179/06 of the Conservation Authorities Act.

Thank you for circulating the Lake Simcoe Region Conservation Authority (LSRCA) on the above-noted
application for Minor Variance.
The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the Lake
Simcoe Protection Plan (LSPP), and Ontario Regulation 179/06 under the Conservation Authorities Act. The
property is subject to Ontario Regulation 179/06 due to the presence of floodplain and erosion hazards
associated with Bradens Creek. As such, a permit from our office will be required prior to any development or
site alteration on the property.
Based on our review of the submitted materials we recommend that any approval of this application be
deferred until the following matters have been addressed to our satisfaction:
1) A topographic survey completed by an Ontario Land Surveyor to confirm the extent of flooding on the
property.
2) An Erosion Hazard Study identifying a site specific erosion hazard setback to Bradens Creek. This study
must use accepted geotechnical and engineering principles and be completed in accordance with the
The Ministry of Natural Resources and Forestrys Technical Guide River Stream Systems: Erosion Hazard
Limit.

We strongly recommend the topographic survey is completed and submitted into our office for review before
the Erosion Hazard Study is commenced. The propose of the topographic survey is to confirm the depth of
flooding on the property and to determine if a permit can be issued under Ontario Regulation 179/06. The
intent of the Erosion Hazard Study is to ensure the proposed development and existing dwelling will be safe as
it relates to erosion associated with Bradens Creek.

Dear Mr. Witlib,
I am writing with reference to the above application: Severance of the lot located at 4 Black Forest Lane.
Black Forest Lane is an old established street created over 25 years ago. All of the houses sit on 2 or
more acre parcels of land.
I chose this street to raise my children because of the low density, the distance between the homes, and
the privacy. After all, Oro Township prides itself in its rural character and farming roots.
Unfortunately, adding another home would greatly impact the nature and character of this
street. Furthermore and of even greater implications, allowing this severance may set an adverse
precedent of owners chopping off tennis courts or swimming pools or extra land for the creation of
building lots. This would impact all of us who live in the vicinity. We chose this street because of its
unique identity.
With all due respect to John and Marilyn Birch who are lovely neighbours, I would ask that the Oro-
Medonte Council not allow this application to proceed.

RE: Severance Application, 4 Black Forest Lane
I am writing to respectfully request that your Committee decline the application for the
severance of 4 Black Forest Lane. As the owner of 9 Black Forest Lane, I have several concerns
with this application.Although I like John and Marilyn Birch (the owners of 4 Black Forest Lane)
very much, I feel it necessary to express these concerns.
Firstly, I do not believe that the proposal for the Severance is in accordance with the Official
Plan. The Official Plan for the Township of Oro-Medonte recognizes, amongst other things, the
unique character of the area. In fact, it explicitly states that the:
excellent quality of life is what makes the Township a desirable place to live
and that the
quality of life is created, in large part, by the rural character of the
community
the Township has an open, relatively natural and rural character.
These are the qualities that taken together, contribute to the identity of the
community that is of the greatest importance to the residents.(pg. 4)
In addition, one of the specific objectives in the Official Plan as it relates to the Shoreline
zoning designation is:
To maintain the existing character of this predominantly residential area (pg.

Sinceall the lots on Black Forest Lane are at least 1.75 acres, with most being between 1.8 and
2.06 acres, if this application is approved, the newly-created lots would only be approximately
half the size of the existing lots. This would impact both the density and character of the street,
and maintaining that character is one of the specifically listed objectives for Shoreline zoned
properties.
While I plan on retiring in Barrie, I currently live in Toronto with 9 Black Forest Lane being a
weekend, holiday and summer retreat that my family and I have enjoyed for almost 20 years.
As soon as I arrive in Oro-Medonte, I feel the difference. I understand completely how the
openness and rural character make Oro-Medonte such a desirable place to live. Severing
4 Black Forest Lane and allowing another house to be built on the severed lot would
dramatically and irrevocably change the character of the street, the openness and grandness of
it, the rural feeling, and those are the reasons we chose Black Forest Lane in the first place (and
paid a heavy premium). Those are also the reasons why this particular street is so desirable.
Secondly, and potentially more importantly, any decision made on this property has far-
reaching consequences. There are other properties in the vicinity that are large enough to allow
the owners to request a severance. The financial interest in doing so is great and allowing this
application to proceed opens the door for others to follow. This decision has consequences that
we might not be fully aware of or appreciate at this time and if this application is allowed to
proceed, we may be wondering in a few years time where we went wrong.
Based on the foregoing, I respectfully urge the Committee to decline this application.

RE: The Proposed Building Better Communities and Conserving Watersheds Act
We are pleased to announce that the government introduced the proposed Building
Better Communities and Conserving Watersheds Act, 2017 in the legislature. These
proposed changes follow extensive public consultations.
Ontario is taking this action in order to overhaul the provincial land use planning appeal
system to give communities a stronger voice and ensure people have access to faster,
fairer and more affordable hearings.
