1995-030 To Rezone Part of Lot 14, Concession 1, Reference Plan 51R-10913, Part 1 (former Township of Orillia) and to amend the general text of By-law 1993-50, as amended THE CORPORATION OF THE TOWNSHIP QF ORO-MEDONTE BY-LAW NO. 95- 30 Being a By-law to rezone Part of Lot 14, Concession l, Reference plan 51R-I0913, Part 1 (former Township of Orillia) and to amend the general text of By-law 1993-50, as amended. WHEREAS Zoning By-law No. 1993-50 was enacted to regulate the use of land and the character, location and use of buildings and structures within the Township of Orillia; , AND WHEREAS though the County of Simcoe Act which came into force and effect on January 1, 1994, the Council of the Corporation of the Township of Oro-Medonte is responsible for the administration of zoning matters through adopting amendments to the Township of Orillia zoning by-law 1993-50, as amended, which remains in effect within the area subject to this amendment; i I I , II AND WHEREAS the Council of the Corporation of the Township of Oro- Medonte deems it appropriate to further amend By-law No. 1993-50, as amended; AND WHEREAS this By-law is in conformity with the Official plan of the Township of Orillia as now administered by the Township of Oro- Medonte through the County of Simcoe Act; AND WHEREAS authority is granted pursuant to Section 34 of the Planning Act, R.S.O. 1990 to the Council of the Corporation of the Township of Oro-Medonte to exercise such powers. That By-law 1993-50, as amended, of the Township of Orillia is hereby further amended, by rezoning those lands shown on Schedule "A", attached hereto, from the Urban Fringe (UF) Zone to the Highway Commercial (C2) Zone. That Section 4.2.l (a) (i) Rural (RU) Zone, Section 4.3.1 (a)(i) Agricultural (AG) Zone, and Section 4.9.l (a) (i) Shoreline Residential (SR) and Shoreline Residential Limited Service Area (SR-LS) Zones be amended by replacing "a single- family dwelling house; and" with "a single-family dwelling house; or". That Section 4.7. 1 (a) (ii) Residential Type Two (R2 ) Zone Permitted Uses be amended by replacing "a converted dwelling; and" with "a converted dwelling; or". That Section 4.8.1. (a)(iv) Residential Type Three (R3) Zone Permitted Uses be amended by replacing "a triplex dwelling house; and" with" a triplex dwelling house; or". That Section 4 . 10.1 (a) (i) Mobile Home Park (MHP) Zone Permitted Uses be amended by replacing ..... and family, as is employed on the lot on which such dwelling is located: and" with "...and family, as is employed on the lot on which such dwelling is located; or". 6 . That Section 4.l8.1 (a)(i) Extractive Industrial (M3) Zone Permitted Uses be amended by replacing .....exclusive of lot frontage hereof, are complied with; and" with".. . exclusive of lot frontage hereof, are complied with; or". That Section 4.10.4 (e) provisions for Individual Mobile Home Sites Within a Mobile Home Park be amending by replacing "Maximum Mobile Home Dwelling Unit Area" with "Minimum Mobile Home Dwelling Unit Area". 7 . II 8. That Section 4.20.2 ReQUlations for Permitted Uses be amended by adding "Refer to Section 4.2.2 and 4.2.3 .". 9. That Section 4.22 be amended by adding "and SR-LS" under the zone "SR" category. lO. That Section 5.6.2 Special provisions - Shoreline Residential - Limited Service Area (SR-LS) Zone be amended by replacing "Notwithstanding the provisions of Section 5.7.1" with "Notwithstanding the provisions of Section 5.6.1". That Section l.40 Council be amended by deleting "... the Municipal Council of the Corporation of the Township of Orillia" and replacing it with "the Corporation of the Township of Oro-Medonte". 12. That Section l.192 Council be amended by deleting "... the Corporation of the Township of Orillia" wi th " . . . the Corporation of the Township of Oro-Medonte". l3. That Sections 4.9.3 (iii) and (iv) be amended by deleting "...the Corporation of the Township of Orillia" and replacing it with "...the Corporation of the Township of Oro-Medonte". 14. That Section 1.51 Dwellinq House. Converted be amended by replacing "Shall mean a residential building..." with "Shall mean a residential dwelling house ...". 15. That Section l.79 Forestrv be amended by adding ".... This shall not include any cutting of wood which was not harvested from the lot.". 16. II II 'I , I That Section l.92 Home Occupation should be deleted in its entirety and replaced with the following: "shall mean any occupation which is carried on, in accordance with the provisions of this By-law, more specifically Section 5.9 Home Occupation, as an accessory use". That Section 5.9 Home Occupation be amended by adding the following: "ix. the home occupation is to be carried out only by members of the one family residing within the dwelling unit". That Section 5.23.1 be renumbered to Section l.4. That Section 1.4 is hereby renumbered to l.5 and all subsequent sections are to be renumbered accordingly. That Section 4.8.1 (a) Residential Type Three (R3) Zone - Permitted Uses is hereby amended by adding the following: "i. a single-family dwelling house; a duplex dwelling house; a semi-detached dwelling house; a converted dwelling house;" ii. Hi. iv. and that Section 4.8.l (a) (i) is hereby renumbered to 4.8.1 (a) (v) and all subsequent sections are to be renumbered accordingly. The following subsections be deleted in their entirety and all subsequent sections are to be renumbered accordingly: Section 4.l.2 (c) Section 4.2.3 (e) Section 4.3.3 (c) Section 4.4.2.1 (c) Section 4.4.3 (c) Section 4.10.2.1(d) Section 4.1l.2 (e) Section 4.l2.3 (e). This By-law shall take effect and come into force pursuant to the provisions of and regulations made under the Planning Act, R.S.O., 1990.
