Take notice that the Township of Oro-Medonte deemed the following application to amend
Zoning By-law No. 97-95, as amended, a Complete Application pursuant to the Planning
th
Act on the 28day of February, 2017.
And take noticethat the Development Services Committee of the Corporation of the
Township of Oro-Medonte will hold a Public Meeting on Wednesday,May 3, 2017, at
5:30 p.m.in the Municipal Council Chambers. The purpose of the Public Meeting is to
notify the publicand to obtain publiccomments on a proposed Amendment to the Zoning
By-law.
Location:
The subject landsare located at 3679 Line 8 North and are described as being in the
South Part of Lot 3, Concession 9, formerly in the Township of Medonte, now in the
Township of Oro-Medonte. A key mapillustrating the location of the subject landsand a
copy of the applicants site plan are included with this Notice.
Purpose:
The purposeand effect of the proposed Zoning By-law Amendment is topermit an
accessory apartment dwelling unit to be located in a detached accessory building on the
same lot on which there is an existing single detached dwelling. Specifically, the
application proposes to:
1.Rezone the subject lands from the Agricultural/Rural (A/RU) Zone to an
Agricultural/Rural Exception (A/RU*##) Zone; and
2.Establish the following provisions in the Agricultural/Rural Exception (A/RU*##)
Zone:
a)Only one accessory apartment dwelling unit is permitted on the lot;
b)The accessory apartment dwelling unit shall be permitted in an accessory
building;
c)The accessory apartment dwelling unit shall have a maximum ground floor area
of 65square metres;
d)The accessory apartment dwelling unit shall a maximum loft area of 32 square
metres;
e)The accessory building shall have a maximum ground floor area of 220 square
metres;
f)The accessory building shall have a maximum height of 6.7 metres; and
g)The minimum lot size shall be the lot size as existed on the date of passing of the
By-law.

Any personmay attend the public meeting and/or make written or verbal representation
either in support of, or in opposition to, the proposed Zoning By-law Amendment. Written
comments by any person unable to attend the meeting should be mailed/faxed/e-mailed to
the Secretary-Treasurer, The Corporation of the Township of Oro-Medonte. The Townhip
would appreciate comments by April 24, 2017. Please ensure that you include your name
and address so that you may be contacted if necessary.

If a person or public body does not make oral submissions at the public meeting or make
written submissions to the Secretary-Treasurer, The Corporation of the Township of Oro-
Medonte before the proposed Zoning By-law Amendment is passed or refused, the person
or public body is not entitled to appeal the decision of the Council of the Township of Oro-
Medonte to the Ontario Municipal Board and may not be added as a party to the hearing of
an appeal before the OntarioMunicipal Board unless, in the opinion of the Board, there
are reasonable grounds to do so.
The application is part of the public record and is available to the public for
viewing/inspection between 8:30 a.m. and 4:30 p.m., Monday Friday,at the Township
of Oro-Medonte Administration Buildingand available on the Townships website
www.oro-medonte.ca. Any person wishing further information or clarification with regard
to the application or to arrange to inspect the application should contact the Planning
Division at 705-487-2171. Individuals who submit letters and other information to
Council and its advisory bodies should be aware that all information, including contact
information, contained within their communications may become part of the public
record and may be made available through the agenda process which includes
publication on the Townships website.
If you wish to be notified of the decision of the Township of Oro-Medonte in respect to
the proposed Zoning By-law Amendment, you must make a written request.

information for the above-noted property to this office. The application will permit

Background:
The subject lands are located just south of Highway 11 on Line 14 South.ALocation Map is included
as Schedule 1 to this report.Surrounding land uses consist of agricultural uses, residential uses
and some commercial uses along Highway 11.
The lands to be severed consistof single detached dwellingson both the severed lands and retained
lands.The subject property was originally two properties that have since merged on title. All relevant
parties have always treated the subject lands as separate parcels. Each parcel maintains an
independent tax roll, as well as a single detacheddwelling.As a result of the inadvertent merger,
there are now two existing dwellingson one lot.
The originalproperties were approximately 10.5 hectares (26 acres) and 36.8 hectares (91 acres)
in size. The proposed application is to maintain the majority of the merged lot, whichwill be
approximately 46.9 hectares (116.0 acres) while severing off a smaller lot of 0.4 hectares (1.0 acre)
that will contain one of the two dwellingsthat are currently located on the lands.

Policies, Legislation and Analysis:
Provincial Policy Statement 2014
The intent of the Provincial Policy Statement (PPS) is to build strong and healthy communities while
at the same time promoting efficient land use and development patterns. In rural areas, the PPS
does not restrict lot creation for agricultural purposes and permits limited residential development
and other rural land uses.
Policy 1.1.4.1(c) contains the policies that in rural areas that development that is compatible with
the rural landscape and can be sustained by rural service levels should be promoted. The
surrounding land uses consist of agriculturally related and rural residential land uses. Therefore, the
proposed lot creation would be in keepingwith therural landscape of the area.
Policy 2.1.8 states Development and site alteration shall not be permitted on adjacent lands to the
natural heritage features and areas identified in policies 2.1.4, 2.1.5, and 2.1.6 unless the ecological
function of the adjacent lands has been evaluated and it has been demonstrated that there will be
no negative Impacts on the natural features or on their ecological functions.There is a Provincial
Significant Wetland (PSW) located north of the existing dwelling that is located on the north portion
of the subjectlands. See Schedule 5 attached for PSW location.
Lake Simcoe Region Conservation Authority is requesting confirmationthrough an Environmental
Impact Study and topographic surveythat the proposed development will not have a negative impact
to the PSW.
The proposed Consent application, whichprovides for the severance to create aresidentiallot with
a lot area of 0.4 hectare,is not consistentwith the Provincial Policy Statement,as the proposed
application has not demonstrated that the PSW will not be negatively affected by the proposed
application.
Growth Plan for the Greater Golden Horseshoe
The application has been reviewed with reference to the Place to Grow policies that have been in
place since 2006. In Policy 2.2.9 -Rural Areas there are provisions that allow developmentto occur
outside of settlement areas in site-specificlocations with approved designations.
Section 2.2.9.2 of these policies state that \[development\] outside of settlement areas may be
permitted in rural areas in accordance with Policy 2.2.2.1(i), which states that \[population\]
growth will be accommodated by
directing development to settlement areas, except where
necessary for development related to
rural land uses that cannot be located in settlement areas.
The Places to Grow policies, however, do not prohibit severances in agricultural and rural areas
where such severances are consistent with the Provincial Policy Statement.

The subject lands are designated Rural and Greenlandsin the County of Simcoes Official Plan.
The proposed lot to be created is located within the Rural Designation.
Section 3.7.8 states Limitedresidential developmentmay be created by consent provided the
followingare satisfied:
a)Lots should be restricted in size in order to conserve other lands in larger blocks for
agricultural usesor environmental purposes. Consent lots should be developed to an
approximate maximum size of one hectare, except where larger sizes may be suitable
because of environmental constraints or design considerations; and
b)The number of lots on the grid roadsystem shall be restricted in order to maintain the rural
character and road function and to avoid stripdevelopment
Developmentin ruralareasshould wherever possible be designed and sited on a property to
minimize adverse impacts on agriculture and to minimize any negative impacton significantnatural
heritage features and areas and cultural features.
Township Official Plan
The subject property is designated Restricted Rural, Environmental Protection One and Two in the
Townships Official Plan.The proposed lot creation is located outside of the Environmental
Protection Designations. Section C6.3.1of the Townships Official Plan contains policies related to
the use and development of land in the Restricted Ruraldesignation. Specifically, Section C6.3.3
of the Official Plan states that:
The creation of new lots for residential purposes shall generallynot be permittedon lands in the
Restricted Rural designation, unless the lot is for a retiring bonafide farmerin accordance with the
policies ofSection C1.3.2.1. This policy and its reference to generally not be permitted does
preclude the creation of a residential lot if the circumstances are unique and merit lot creation.
The proposed lot creation is to rectify a situation where two lots have inadvertently merged on title
as well as to correct a non-conformity situation, as two dwellingsare not permittedon one parcel of
land. It is Planning staffs opinion that this scenario represents a rare and unique circumstance.
Approval of the consent would remedy the situation to the benefit of the applicants, because it
would correct the inadvertent merger. Approval would also benefit the Township by eliminating a
non-conforming situation, being two dwellings on one lot.
Subject to the applicants being able to satisfy the natural heritage matters identified by Lake Simcoe
Region Conservation Authority, staff is of the opinion that the consent conforms to the Official Plan.
Section D2.2.1 (New lots by Consent) should also be assessed,as the proposed lot will be different
in size as previously existed.
a)Fronts on and will be directly accessed by a public road that is maintained year round basis:
The proposed severed and retained lands would have frontage on Line 14South, which is a public
roadway maintained year-round by the Township of Oro-Medonte.

b)Does not have direct access to a Provincial Highway or County Road, unless the Province
or the County supports the request;
The properties will not have access to a Provincial Highway or County Road.
c)Will not cause a traffic hazard;
Significant traffic volume will not be generated by any agricultural or residential use,as the
properties exist with a dwelling located on each lot proposed.
d)Has adequate size and frontage for the proposed use in accordance with the Comprehensive
Zoning By-law and is compatible with adjacent uses;
The lands proposed to be severedwould have a frontage of approximately60.96metres (200.0
feet) of frontage, a lot depth of approximately 67.05 metres (220.0 feet), and a lot area of
approximately 0.4hectares (1.0acres) which would be considered adequate for a residential use
and would be compatible with other adjacent residential uses that are located on Line 14 South.
e)Can be serviced with an appropriate water supply and means of sewage disposal;
Both dwellingsare currently serviced by an appropriate water supply and sewage system.
f)Will not have a negative impact on the drainage patterns in the area;
The dwellings currently exist and there is no expectedadditionaldevelopment on the lands. Any
future development will be reviewed by the Township EngineeringDepartment.
g)Will not restrict the development of the retained lands or other parcels of land, particularly
as it relates to the provision of access, if they are designated for development by this Plan;
No development applications are active adjacent to the subject lands, and as such no negative
impacts with respect to access are anticipated as a result of this consent as the driveways currently
exist.
h)Will not have a negative impact on the features and functions of any ecological feature in
the area;
It is noted that any future development on the subject lands would require appropriate approvals
for a well, which would ensure that it would not negatively affectthe quality and quantity of
groundwater.
i)Will not have a negative impact on the quality and quantity of groundwater available for
other uses in the area;

The proposed lot creation by way of severance is in keeping with the general intent of the Restricted
Ruralpolicies stated in the Official Plangiven the unique situation on this property with two dwellings

on one parcel of land. For the purpose of this application, it is noted that the creation of new lotby
way of severance is permitted, where the tests of severance listed in Section D2.2.1 of the Official
Plan are met.

Thank you for circulating the Lake Simcoe Region Conservation Authority (LSRCA) on the above-noted
application for Consent. It is our understanding that the purpose and effect of this application is to sever
one residential lot from the lands known as 51 and 55 Line 14 South. It is our understanding that 51
and 55 Line 14 South have been merged on title.
The subject lands contain 2 tributaries of Bluffs Creek and their associated floodplain and erosion hazards.
The property also contains parts of provincially significant Bluffs Creek Wetland Complex and significant
woodland.
The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the
Lake Simcoe Protection Plan (LSPP), and Ontario Regulation 179/06 under the Conservation
Authorities Act. Given the information provided, there is a lack of detail related to the location and
configuration of the proposed lot. The proposed lot appears to be within or in close proximity to the
provincially significant wetland to the north. It is also surrounded by the regulated floodplain of Bluffs
Creek.
The Provincial Policy Statement states that development and site alteration shall not be permitted in
significant wetlands or a floodway, and Designated Policy 6.23 of the LSPP states that development,
which includes the creation of a lot, is not permitted within a key natural heritage feature and within a
related vegetation protection zone. As such, we recommend deferral of this application until the
following matters are addressed to our satisfaction:
1.That the applicant demonstrates through the completion of a topographic survey that the retained
and severed lots contain appropriate building envelopes outside of the regulatory floodplain of
Bluffs Creek.

At this time the MTO will not grant an access from Hwy 11 or Line 14 S to the proposed
severed lands. As noted below, the entire frontage (along Hwy 11 and Line 14S) is
designated CAH.
MTO Comments are as follows:
2017-B-14 /5315 Highway 11 North
The ministry does not support this application.Based on the current Highway
Access Management Guidelines, The MTO will notgrant access from Hwy 11
nor Line 14S and therefore the proposed severed parcel will be
landlocked.Please advise the applicant accordingly.
