2017-047 Certificate of Substantial Completion and Acceptance (Municipal Underground Services) Diamon Valley Estates Phase 4The Corporation of the Township of Oro-Medonte By-law No. 2017-047 A By-law to Authorize the Issuance of the Certificate of Substantial Completion and Acceptance (Municipal Underground Services) for 2008628 Ontario Ltd. (Diamond Valley Estates Phase 4), Plan 51 M-957 Whereas Section 51, Subsection (26) of the Planning Act, R.S.O. 1990, Chapter P. 13, as amended, provides that municipalities may enter into agreements imposed as a condition to the approval of a plan of subdivision and such agreements may be registered against the land to which the subdivision plan applies; And Whereas Council for the Corporation of the Township of Oro-Medonte entered into a Subdivision Agreement with 2008628 Ontario Ltd. (Diamond Valley Estates Subdivision) in March 2010 for one hundred and twenty eight (128) residential lots on Diamond Valley Drive, Emerald Terrace, Topaz Court, Opal Court, Ruby Ridge, and Sapphire Way. And Whereas the requirements of this Subdivision Agreement with respect to the underground works for Phase 4 comprised of 32 residential lots (Lots 27-32, 45-64, and 79-84 (Diamond Valley Drive) have now been met; Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: That the Certificate of Substantial Completion and Acceptance (Municipal Underground Services) for Diamond Valley Estates (2008628 Ontario Ltd.), Plan 51 M-957 Phase 4 may now be issued by the Township Engineers (AECOM) in compliance with the Subdivision Agreement between the Corporation of the Township of Oro-Medonte and 2008628 Ontario Ltd.. 2. That the attached Schedule "A", Certificate of Substantial Completion and Acceptance (Municipal Underground Services) shall form part of this By -Law. 3. This by-law shall take effect on the final passing thereof. By-law read a First, Second and Third time, and Passed this 12th day of April, 2017. FILE NO. 60118278 r43 -T-930191 Description of the Works: • Watermain Works in the Diamond Valley Estates Phase 4 on Diamond Valley Drive from the intersection of Opal Drive easterly to 7"' Line North (920 metres); • Drainage Works consisting of road crossing culvert and ditches in the Diamond Valley Estates Phase 4 on Diamond Valley Drive from the intersection of Opal Drive easterly to 7t' Line North • SWM Pond and Access at Block 139 consisting of the Stormwater Management Pond and Inlet channel and access road, complete with site fencing and access gate. We, AECDM, notify the Municipality that the above mentioned works were inspected on February 22, 2017 and to the best of our knowledge and judgement, are complete in accordance with the Subdivision Agreement except for the deficiencies below: • Items listed in AECOM Construction Status Report dated February 22, 2017. • Note that the street lights are now operational effective February 22, 2017. We hereby accept these works for use and operation by the Municipality subject to the rectification of the above noted deficiencies and to the rectification of any further deficiencies that may become apparent during the maintenance period and to the maintenance that is require by the Subdivision Agreement and its Amendment.
