Public Meetings: a) Notice of Receipt of a Complete Application, Notice of Particulars and Public Access, Notice of Public Meeting for a Proposed Amendment to the Zoning By -Law, Part of Lot 12, Concession 4 (Oro), Township of Oro-Medonte, 2017-ZBA-01 (Mike McGill) [Refer to Items 8a) and 5a) 03 01 2017 Council agenda]. Deputy Mayor Hough called the meeting to order at 5:31 p.m. and explained the public meeting is being held in in accordance with Section 34, of the Planning Act, to obtain public comment with respect to a proposed Zoning Amendment Application. The purpose of Application 2017-ZBA-01 is to comply with a condition imposed by the Township's Development Services Committee with respect to Consent Application 2016-B-06. Notice of the Public Meeting was circulated to the appropriate Agencies and posted on the Township's website on or before February 7, 2017. The following correspondence was received: Township of Oro-Medonte Manager, Development Engineering dated February 1, 2017; Nottawasaga Valley Conservation Authority dated February 2, 2017; Township of Oro-Medonte Operations Division dated February 2, 2017; Township of Oro-Medonte Environmental Services dated February 16, 2017. Derek Witlib, Manager, Planning Services explained the purpose and effect of the proposed amendment. A PowerPoint presentation was presented. The following public persons offered verbal comments with respect to the proposed amendment: None. Deputy Mayor Hough advised that additional deputations to the Committee or Council regarding this application may be permitted, but only for the introduction to new information not already presented through the Public Meeting process. That Report No. DS2017-017, Deborah -Ann Liske, Planner, re: Minor Variance Application 2017-A-03, Gregory & Margarita Nilevsky, 13 McLean Crescent, Lot 17, Plan 1151 be received and adopted. 2. That Minor Variance Application 2017-A-03 by Gregory & Margarita Nilevsky, specifically to permit construction of a swimming pool with a decreased setback from the average high water mark of Lake Simcoe of 9 metres, on lands located on Lot 17, Plan 1151 Township of Oro-Medonte, known as 13 McLean Crescent, be approved. 3. That the following conditions be imposed on the Committee's decision: a) That notwithstanding Section 5.34 of Zoning By-law 97-95, the proposed swimming pool shall otherwise comply with all other applicable provisions of the Zoning By-law; b) That the proposed buildings/structures and landscaping on the property be substantially and proportionally in conformity with the dimensions as set out on the application and approved by the Committee; c) That the applicant satisfy the requirements of the Lake Simcoe Region Conservation Authority as identified in the letter dated February 17th, 2017; d) That the applicant provide to the Township's Planning Department verification from an Ontario Land Surveyor by way of survey/real property report, that the installed swimming pool is located no closer than 9 metres from the average high water mark of Lake Simcoe; and, e) That the appropriate Zoning Certificate, Pool Fence Permit be obtained from the Township only after the Committee's decision becomes final and binding, as provided for within the Planning Act R.S.O. 1990, c.P. 13. 4. That Minor Variance Application 2017-A-04 by Randall Roe, specifically to permit a dwelling and an agricultural building (driveshed) with a reduced setback of 1 metre from an Environmental Protection (EP) Zone, on lands located in the East Part of Lot 14, Concession 11 (Oro), Township of Oro-Medonte, known as 1050 Line 11 North, be approved. 3. That Minor Variance Application 2017-A-05 by Michael Fox, specifically to permit the construction of an addition to a single detached dwelling with a new front porch, back screened porch and a deck with a reduced setback from the limits of the Environmental Protection Zone of 1.53 metres (5 feet), the construction of a deck within the Environmental Protection Zone and a reduced setback from the watercourse of 12 metres (39.3 feet) on lands located on CON 7 S PT LOT 25, (Oro) Township of Oro-Medonte, known as 349 Ridge Road West, be approved. 3.
