Deputy Mayor Hough called the meeting to order at 5:31 p.m. and explained the public meeting is being held in in accordance with Section 34, of the Planning Act, to obtain public comment with respect to a proposed Zoning Amendment Application. The purpose of Application 2016-ZBA-10 is to comply with a condition imposed by the Township's Development Services Committee with respect to Consent Application 2016-B-18. Notice of the Public Meeting was circulated to the appropriate Agencies and posted on the Township's website on or before January 11, 2017. The following correspondence was received: Enbridge Gas Distribution dated January 6, 2017; Township of Oro-Medonte; Manager, Development Engineering dated January 6, 2017; Hiawatha First Nation dated January 12, 2017. Andria Leigh, Director, Development Services explained the purpose and effect of the proposed amendment. A PowerPoint presentation was presented. The following public persons offered verbal comments with respect to the proposed amendment: None. Deputy Mayor Hough advised that additional deputations to the Committee or Council regarding this application may be permitted, but only for the introduction to new information not already presented through the Public Meeting process. That Minor Variance Application 2016-A-37 by Caroline and Richard Joch specifically to permit the construction of a detached garage with a minimum side yard setback of 1.45 metres (4.75 feet) and the construction of a detached dwelling with a minimum 1.75 metres (5.74 feet) side yard setback on each side of lands located on Lot 12, Plan 653 (101 Robinson Street), Township of Oro-Medonte, be approved. 4. That the Development Services Committee delete Condition 1(e) from the Notice of Decision dated December 7, 2016 regarding Consent Application 2016-B-14 and replace it with the following condition: "e) That the applicant shall satisfy the following conditions of the County of Simcoe: i. That the Applicant will be required to close the existing entrance located on the east side of the abandoned structure on the retained portion of the property. The culvert shall be removed and ditch reinstated; ii. That the Applicant will be required to apply for an Entrance Permit for the existing farm entrance off of County Road 22, if one has not been issued previously; iii. That the Applicant shall enter into a Development Agreement with the County, to be registered on title, which prohibits the planting of trees or construction of buildings or structures (as such terms are defined in the County's Set -Back By -Law 5604) within 18.0 metres of the current right-of-way of County Road 22 along the entire frontage of the severed portion of the property abutting the County road; iv. That the applicant shall transfer to the Corporation of the County of Simcoe ("County'), at no cost, a fee simple, unencumbered interest in the following: ■ A road allowance widening along the entire frontage of the retained property adjacent to County Road 22 to provide an 18 metre right-of-way from the centre line of County Road 22. A buffer of 3.0 metres around the existing structure is not included in the road widening request; ■ A daylight (sight) triangle measuring 15 metres east -west x 15 metres north - south at the north-east corner of the retained property adjacent to County Road 22 and Line 11 North; ■ The County would accept a lesser widening or daylight (sight) triangle if the dedicated widening lands contain an existing structure such as a well or septic system; v. Any existing fences currently located within the requested road widening on County Road 22 must be moved to 0.3 metres inside the new property line." 3. That the Development Services Committee delete the Applicant's Sketch that was attached to the Notice of Decision dated December 7, 2016 and replace it with "Applicant's Sketch (Revised)" attached as Schedule 3 to Report DS2017-010. 4.
