Councillor Jermey declared a pecuniary interest on Item 8b) Report No. DS2016-102,
Andy Karaiskakis, Senior Planner re: Zoning By-law Amendment Application - 2016-
ZBA-06 (Lalande) - Part of the East Half of Lot 22, Concession 11 (Oro) Township of
Oro-Medonte as he harvests the hay crop on the subject property. Councillor Jermey
left the table and did not participate in the discussion or vote on this item.

area of Edgar, Part West Half of Lot 11, Concession 5 (Oro), 2006 -SUB -02,
2479283 Ontario Inc.
Deputy Mayor Hough called the meeting to order at 5:33 p.m. and explained the public
meeting is being held in accordance with Section 51, of the Planning Act, to obtain
public comment with respect to a proposed Development Application. The purpose of
Application 2006 -SUB -02 is to consider a proposal to create a subdivision for the
purpose of constructing 14 single detached dwellings. This application was originally
submitted and approved in 2006, however, the application has since lapsed and
therefore, the applicant has resubmitted a "new" application.
Notice of the Public Meeting was mailed to landowners within 120 metres of the
specified site on November 8, 2016 and a notice sign was posted on the subject
property on or before November 8, 2016.

b) Notice of Public Meeting for Proposed Amendments to the Zoning By-law of the
Township of Oro-Medonte, Keeping of Backyard Chickens, 2016-ZBA-08, Township
of Oro-Medonte, General Amendment.
Deputy Mayor Hough called the meeting to order at 8:22 p.m. and explained the public
meeting is being held in accordance with Section 34, of the Planning Act, to obtain
public comment with respect to a proposed Zoning Amendment Application. The
purpose of Application 2016-ZBA-08 is to consider a proposal to amend Zoning By-law
97-95, to permit backyard chickens in site specific areas.
Notice of the Public Meeting Notice of the Public Meeting was circulated to the
appropriate Agencies, posted on the Township's website and posted in the surrounding
newspapers on or before November 17, 2016.
The following correspondence was received: Robert C. McKeown dated October 25,
2016; Simcoe County District School Board dated November 15, 2016; Severn Sound
Environmental Association dated November 16, 2016; Nottawasaga Valley
Conservation Authority dated November 17, 2016; Township of Oro-Medonte;

Andria Leigh, Director, Development Services explained the purpose and effect of the
proposed amendment. A PowerPoint presentation was presented.
The following public persons offered verbal comments with respect to the proposed amendment:
Jen Kunej provided comments in favour of the amendment, preference to an increase in
the flock size, yearly inspection questions, possibly allow flexibility in a case by case
basis, and the possibility of a limited number of permits in the first year of
implementation.
Sheila Craig provided comments with respect to concerns of bird flu contamination, and
having a contingency plan in place for those driving their chickens to market.
Spencer Robertson provided comments in favour, concerns of coop structure area,
comments if coops could be allowed behind the dwelling but to the side of the yard
depending on the lot area and size of flock too restrictive.
Chris McCaskie provided comments against the permit and annual inspection process,
property owner's responsibilities/obligations, concerns that by-law is too restrictive and
size of flock restrictions.

Warren Clark provided concerns with respect to the garage if a commercial operation
commenced or the buildings become a living accommodation. He provided concerns
with the size and height of the boathouse.
Glenn Stringer provided concerns if property was sold and potentially future use of
workshop, traffic flow, concerns if buildings became a living accommodation;
water/sewage going into the garage, concerns of garage being the same size as his
dwelling, setting a precedence of having two story boathouse and affecting the views.

2. That Minor Variance Application 2016-A-34 by Dupuis and Ouellette on behalf of
Yuri Mykolyk, specifically to permit the construction of a boathouse with a maximum
height of 6.1 metres (20.0 feet) on lands located in Concession 11, East Part Lot 11,
municipally known as 77 Pugsley Lane, Township of Oro-Medonte, be deferred.
3. That Minor Variance Application 2016-A-34 by Dupuis and Ouellette on behalf of
Yuri Mykolyk, specifically to permit the construction of a detached garage with a
maximum floor area of 127.36 square metres (1,371.0 sq. ft.) on lands located in
Concession 11, East Part Lot 11, municipally known as 77 Pugsley Lane, Township
of Oro-Medonte, be approved:
4. That the following conditions be imposed on the Committee's decision:
a) That notwithstanding Section 5.1.6 of Zoning By-law 97-95, the proposed
detached garage shall otherwise comply with all other applicable provisions of
the Zoning By-law;
b) That the proposed detached garage be substantially and proportionally in
conformity with the dimensions as set out on the application and sketches
submitted and approved by the Committee;
c) That an Ontario Land Surveyor verify by pinning the foundation wall of the
detached garage and verifying in writing by way of survey/real property report,
prior to the pouring of the footing and if no footing, the foundation, that the
detached garage is located no closer than 2.0 metres (6.56 feet) from the interior
lot line;
d) That the applicant satisfy any permits and/or approvals required from Lake
Simcoe Region Conservation Authority;
e) That the appropriate Zoning Certificate and Building Permit be obtained from the
Township only after the Committee's decision becomes final and binding, as
provided for within the Planning Act R.S.O. 1990, c.P. 13.
5. And that the applicant be advised of the Development Services Committee's
decision under the Secretary -Treasurer's signature.

2. That Minor Variance Application 2016-A-35 by Grace St. Clements, specifically to
permit the construction of a one -storey addition to an existing single detached
dwelling for an attached garage with a north west corner interior side yard setback of
0.72 metres (2.36 feet), and a south west corner interior side yard setback of 1.59
metres (5.21 feet), on lands located on Concession 9, Lot 23 of Plan 875, Township
of Oro-Medonte, known as 18 Parkside Drive, be approved.
3. That the following conditions be imposed on the Committee's decision:
a) That notwithstanding Table B1 of Zoning By-law 97-95, the proposed addition,
shall otherwise comply with all other applicable provisions of the Zoning By-law;
b) That the proposed buildings/structures and landscaping on the property be
substantially and proportionally in conformity with the dimensions as set out on
the application and approved by the Committee;
c) That an OLS verify by pinning the foundation wall and verifying in writing by way
of survey/real property report, prior to the pouring of the footing and if no footing,

closer than 0.72 metres (2.36 feet) and the south west corner is located no closer

Application 2016-B-12 (Beard) - Concession 11, West Part Lot 1, RP 51 R-38849, Pt.
1 (Medonte) be received.
2. That the Development Services Committee approve Consent Application 2016-B-12,
specifically for a boundary adjustment of a 0.29 hectare (0.74 acre) parcel from
lands located at Concession 11, West Part Lot 1, municipally known as 872
Horseshoe Valley Road (Medonte), subject to the following conditions:
a) That the severed lands, be merged in title with the abutting property to the east;
b) That Section 50(3) and 50(5) shall apply to any subsequent conveyance of, or
other transaction involving, the identical subject parcel of land. Therefore, once
the subject parcel of land has been conveyed to the owner of the abutting parcel
to the east, the subject parcel and the said abutting parcel shall merge in title and
become one parcel of land. A solicitor's written undertaking shall be provided to
the Secretary -Treasurer indicating that the necessary steps will be taken to
implement the conveyance and to consolidate the parcels to one Property
Identifier Number;

c) That the applicant shall satisfy the following conditions of the County of Simcoe:
(i) That the applicant shall transfer to the Corporation of the County of Simcoe
("County'), at no cost, a fee simple, unencumbered interest in the following:
A road allowance widening along the entire frontage of the subject property
adjacent to County Road 22 to provide an 18.0 metre right-of-way from the
centre line of County Road 22;
(ii) That the applicant shall submit to the satisfaction of the County's
Transportation and Engineering Department a preliminary reference plan (1
copy and 1 electronic copy) which sets out the road widening to be
transferred to the County. Upon approval, the County will instruct the
surveyor to deposit the reference plan in the Land Registry Office for
Simcoe County and request the surveyor provide the County with 1 copy anc
1 electronic copy of the deposited reference plan;
(iii) All costs associated with the land transfer, including costs relating to
surveying, legal fees, and disbursements, agreements, HST, etc. shall be
fully borne by the applicant;
(iv) All legal documentation is to be negotiated, prepared and registered by the
Legal Services Department of the County and to be executed where
required by the Applicant. The Applicant shall submit to the Legal Services
Department of the County a deposit in the amount of $1000.00 prior to the
services being rendered. Invoices will be submitted on a cost recovery basis
and applied against the deposit. Additional deposits may be required, and
any excess over the total invoices will be refunded;
(v) Prior to stamping of the deed by the Township of Oro-Medonte, the
Applicant shall obtain written clearance from the County for the above -noted
conditions;
(vi) That the County of Simcoe is requesting the road widening pursuant to
section 53(12) of the Planning Act and such land will form part of the
highway to the extent of the designated widening in accordance with section
31 (6) of the Municipal Act, 2001. The widening of County Road 22 is
required pursuant to the County's standards for construction and is
consistent with proper safety standards;
(vii) All fences must be moved 0.3 metres inside of the new property line;
(viii) That the County of Simcoe Setback By-law No. 5604 regulates the location
of buildings and other structures on lands adjacent to County Roads. Any
new buildings and other structures must be located 15 metres from any
requested road allowance widening;
d) That one copy of a Registered Reference Plan of the subject lands prepared by
an Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer;
e) That the applicant's solicitor prepares and submit a copy of the proposed
conveyance for the parcel severed, for review by the Municipality;
f) That all municipal taxes be paid to the Township of Oro-Medonte;
g) That the Certificate of Consent be issued utilizing Form 4, Section 53 (42) of the
Planning Act, R.S.O. 1990, to merge the parcels; and
h) That the conditions of consent imposed by the Committee be fulfilled within one
year from the date of the giving of the notice.

2016-B-14 (Estate of Donald Whibley) - 893 Horseshoe Valley Road East and 3000
Line 11 North be received.
2. That the Development Services Committee grant provisional consent to Application
2016-B-14 being to permit a severance of an agricultural lot having an area of
approximately 30.9 hectares (76.35 acres) located at 3265 Line 10 North,
Concession 11, Part Lot 1, known as 893 Horseshoe Valley Road East, subject to
the following conditions:

a) That one copy of a Registered Reference Plan for the subject lands indicating the
severed parcel be prepared by an Ontario Land Surveyor and be submitted to
the Secretary -Treasurer;
b) That the applicant's solicitor prepares and submit a copy of the proposed
conveyance for the parcel severed, for review by the Municipality;
c) That the applicant pays $ 2,000.00 to the Township for the retained lot created as
cash -in -lieu of a parkland contribution;
d) That the applicant transfer to The Corporation of the Township of Oro-Medonte
("Township"), at no cost, fee simple, unencumbered interest a 3 metre road
allowance widening along the entire frontage of the subject lands along Line 10
North and Line 11 North. The Township is requesting the road widening pursuant
to Section 53(12) of the Planning Act and such land will form part of the highway
to the extent of the designated widening in accordance with Section 31(6) of the
Municipal Act, 2001. The applicant's solicitor shall be responsible to register an
Application under The Land Tiles Act, R.S.O. 1990, as amended, to consolidate
the 3 metre widening with Line 10 North and Line 11 North as one Property
Identifier Number, at the applicant's expense, to the satisfaction of the Township;
e) That the applicant shall satisfy the following conditions of the County of Simcoe:
i. That the Applicant will be required to close the existing entrance located on
the east side of the abandoned structure on the severed portion of the
property. The culvert shall be removed and ditch reinstated;
ii. That the Applicant will be required to apply for an Entrance Permit for the
existing farm entrance off of County Road 22, if one has not been issued
previously;
iii. That the Applicant shall enter into a Development Agreement with the County,
to be registered on title, which prohibits the planting of trees of construction of
buildings or structures (as such terms are defined in the County's Set -Back
By -Law 5604) within 18.0 metres of the current right-of-way of County Road
22 along the entire frontage of the retained portion of the property abutting the
County road;
iv. That the applicant shall transfer to the Corporation of the County of Simcoe
("County'), at no cost, a fee simple, unencumbered interest in the following:
■ A road allowance widening along the entire frontage of the severed
property adjacent to County Road 22 to provide an 18 metre right-of-way
from the centre line of County Road 22. A buffer of 3.0 metres around the
existing structure is not included in the road widening request;
■ A daylight (sight) triangle measuring 15 metres east -west x 15 metres
north -south at the south-east corner of the severed property adjacent to
County Road 22 and Line 11 North;
■ The County would accept a lesser widening or daylight (sight) triangle if
the dedicated widening lands contain an existing structure such as a well
or septic system;
v. Any existing fences currently located within the requested road widening on
County Road 22 must be moved to 0.3 metres inside the new property line;
f) That all municipal taxes be paid to the Township of Oro-Medonte;

g) That the Certificate of Consent be issued utilizing Form 2, Section 53 (42) of the
Planning Act, R.S.O. 1990, and;
h) That the conditions of consent imposed by the Committee be fulfilled within one

a) That the severed lands, be merged in title with the abutting property to the south;
b) That Section 50(3) and 50(5) shall apply to any subsequent conveyance of, or
other transaction involving, the identical subject parcel of land. Therefore, once
