Take notice that the Township of Oro-Medonte deemed the following application to be a "Complete
Application" pursuant to the Planning Act on the 4t' day of November, 2016.
Take notice that the Development Services Committee of the Township of Oro-Medonte will hold a
Public Meeting on December 7th, 2016 at 5:30 p.m. in the Municipal Council Chambers. The
purpose of the Public Meeting is to obtain public comments on a proposed Draft Plan of
Subdivision that was previously approved but has since lapsed on September 5th, 2016. There
are no changes proposed from the previously approved plan.
The purpose of Application 2006 -SUB -02 is to consider a proposal for a Draft Plan of
Subdivision comprised of 14 residential lots located on the south side of Old Barrie Road
(County Road 11) in the settlement area of Edgar. Each of the 14 lots will have frontage onto a
new public road (Best Court) that extends south from Old Barrie Road and then turns west. A
location map is attached for reference. (Attachment #1). The subject lands are legally described
as Part West Half of Lot 11, Concession 5, (Oro), Township of Oro-Medonte.
The lot frontage for each the lots will be a minimum 32 metres (105 feet) and have minimum lot
area of approximately 0.25 hectares (0.62 acres). The draft plan also includes Block 15
(Stormwater Management Block), Block 16 (Emergency Access Block) and Block 17
(Environmental Protection Block). A copy of the draft plan is attached for reference (Attachment
#2).
Any person may attend the public meeting and/or make written or verbal representation either
in support of, or in opposition to, the proposed Draft Plan of Subdivision. Written comments by
any person unable to attend the meeting should be mailed/faxed/e-mailed to the Secretary -
Treasurer. Please ensure that you include your name and address so that you may be contacted
if necessary.
If a person or public body does not make oral submissions at the public meeting or make
written submissions to the Secretary -Treasurer, The Corporation of the Township of Oro-
Medonte before the proposed Draft Plan of Subdivision is approved or refused, the person or
public body is not entitled to appeal the decision of the Council of the Township of Oro-
Medonte to the Ontario Municipal Board and may not be added as a parry to the hearing of an
appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are
reasonable grounds to do so.
The application are part of the public record and is available to the public for viewinglinspection
between 8:30 a.m. and 4:30 p.m. at the Township of Oro-Medonte Administration Building and
available on the Township's website www.oro-medonte.ca. Any person wishing further information
or clarification with regard to the application or to arrange to inspect the applications should
contact the Planning Division at 705-487-2171. Individuals who submit letters and other
information to Council and its advisory bodies should be aware that all information, including
contact information, contained within their communications may become part of the public record
and may be made available through the agenda process which includes publication on the
Township's website.
If you wish to be notified of the decision of the Township of Oro-Medonte in respect to the
proposed Draft Plan of Subdivision, you must make a written request.

Thank you for circulating the above -noted application to the County of Simcoe for comment. County
staff respectfully requests that the following conditions be included in the conditions of draft plan
approval:
That prior to final approval, the Owner shall submit a Stormwater Management Report to the
satisfaction of the County of Simcoe in accordance with current Provincial and County policies
and standards. The report shall demonstrate that post -development drainage flow rates to the
County road allowance do not exceed the pre -development condition and that the water quality
levels are maintained or improved.
2. That prior to final approval, the Owner shall submit a Grading and Drainage Plan to the
satisfaction of the County of Simcoe.
I That prior to final approval, the Owner shall submit an Erosion and Sedimentation Control Plan
to the satisfaction of the County of Simcoe prior to any site grading, alteration or construction
occurring on the site.
4. That prior to final approval, the Owner shall construct a 60 metre eastbound right -turn taper lane
at the proposed access to the subdivision to the satisfaction of the County of Simcoe.
5. That prior to final approval, the Owner shall enter into a legal agreement with the County of
Simcoe whereby the Owner agrees to assume financial and other responsibility for the design
and construction of the right -turn taper lane.
6. The Owner shall transfer to the County of Simcoe at no cost, a fee simple, unencumbered
interest in the following:
a) 15 metre by 15 metre daylight triangle blocks at each limit of the proposed road
intersection with County Road 11, and

b) 0.3 metre reserves across the frontage of the property adjacent to County Road 11
including the daylight triangle blocks.
7. That prior to final approval, the Owner shall submit to the satisfaction of the County of Simcoe a
preliminary M -Plan which sets out the daylight triangle and reserve blocks to be transferred to
the County.
8. The Owner shall agree in the Subdivision Agreement to insert the following warning clauses
within all Offers of Purchase and Sale Agreements for prospective purchasers of the Lots
abutting County Road 11 (Old Barrie Road West):
'The County uses a 0.3 metre reserve to restrict access to the County Road. Purchasers of lots
abutting County Road 11 are hereby advised that these lots are subject to the 0.3 metre reserve
and access to County Road 11 across the reserve will not be permitted by the County'.
"County of Simcoe Road Setback By-law No. 5604 regulates the location of buildings and other
structures on lands adjacent to County Roads. All lot development adjacent to County Road 11
is subject to the requirements of the County Road Setback By-law, or its successor:"
9. County of Simcoe Road Setback By-law No. 5604 regulates the location of buildings and other
structures on lands adjacent to County Roads. That prior to final approval, the Owner shall
ensure that the toe of the front slope of the earth berm abutting County Road 11 is located 6.0
metres from the limit of the County Road as approved in the County of Simcoe Variance No.
D13-1102 and that all fences abutting County Road 11 are located 0.3 metres inside the private
property line.

Regarding the "Complete Application" for 2006 -SUB -02.
The previous Approvals are acceptable considering this was an Approved Draft Plan
with Approved Engineering Design.
The only notable changes to consider would be that the Streetlighting Standard of LED /
Dark Sky Friendly should be applied to the Approval.

The subject property is located in the existing Rural Settlement of Edgar in the
Township of Oro-Medonte.
* The site is currently designated as Rural Residential.
* The site is zoned Residential One.
Both the designation and the zoning of the property permit single family
detached residential development.
* There is a small swath of land zoned Environmental Protection which is being
appropriately protected from development.
DRAFT APPROVAL (2006 -SUB -02)
• A draft plan of subdivision, prepared by CDN Land Surveyors Inc. and dated May
10, 2011, was approved for the subject property by the Township of Oro Medonte
in 2011.
• On August 13, 2015 Council approved an extension to draft plan approval for a
period of one year to September 5, 2016.
• Under the Planning Act if a Draft Plan is not extended by the appropriate date, as
indicated in the draft conditions, the Draft Plan Approval lapses.
• While focusing on the servicing of the site through the executed Pre -servicing
Agreement, the current owner of the property neglected to request an extension
of the draft plan and the draft plan therefore lapsed as of September 5, 2016.
STATUS OF PROJECT
The subject property has been serviced through a Pre -servicing Agreement.
Several of the lots have been sold to home buyers.
The lands are ready for the building of a Model Home.
The developer is currently working through all of the draft conditions to
register the subdivision as soon as possible.
DRAFT PLAN OF APPLICATION REQUEST
The Draft Plan Approval requested has not been revised since its original approval.
