The Corporation of the Township of Oro-Medonte DRAFT By-law No. 2016-___ A By-law to Regulate the keeping of Backyard Chickens within the Township of Oro-Medonte Whereas Section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that powers of every Council are to be exercised by by-law unless specifically authorized to do otherwise; and And Whereas Section 8(3) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides Municipalities with broad authority to govern affairs as it considered And Whereas Sections 11(1) and (2) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a lower-tier municipality may provide any service of thing that the Municipality considered necessary or desirable for the public in respect to the economic, social, and environmental well-being of the municipality and the health, safety, and well-being of persons; and And Whereas Sections 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a lower-tier municipality may pass by-laws respecting matters within the following spheres of jurisdiction: animals, and And Whereas Council endorsed Staff Report DS2016-087 Proposed Amendment to -law 97-95, as amended for Backyard Chickens and deems it expedient, necessary and in the public interest to regulate the keeping of backyard chickens in accordance with the Zoning By-law for the purpose of public health and safety; Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. and attached hereto shall form part of this By-law. 2. Appendix By-law 2016 - 1.0 DEFINITIONS: this By-law but has not yet been issued a Permit pursuant to this By-law. means the accessory keeping of hens for the purposes of companionship as a pet or of providing food for personal consumption of occupants of the dwelling on the same lot; and does not include accessory livestock, or agricultural uses otherwise defined by the Township of Oro-- law. The Corporation of the Township of Oro-Medonte. means a fully enclosed weatherproof building where hens are kept and which the interior of includes nest boxes for egg laying, perches for the hens to sleep on and food and water containers. The Corporation of the Township of Oro- Medonte. means a domesticated female chicken that is at least four months old. the purposes of carrying out the enforcement of Municipal By-laws. the backyard chickens within the Township. Where the owner is a minor, the person responsible for the custody of the minor is deemed to be the owner of the backyard chickens. "Owner" shall also mean the owner of the property on which the backyards chickens are kept. -Medonte upon compliance to this by-law permitting an owner to have backyard chickens. t. administering the provisions of the Zoning By-law. The Corporation of the Township of Oro-Medonte. 2.0 PERMITTING 2.1 No person shall own, operate, manage, control, supervise, or have on any property, any Backyard Chickens unless a permit has been issued for such backyard chickens by the Township. 2.2 Every application shall be approved by the Planner in accordance with the oning By-law prior to issuance of said permit. 2.3 Every owner who applies for a permit, shall do so on the form prescribed in B-law. 2.4 Prior to issuance of a Permit, the applicant shall pay a fee as provided for in By-law. 2.5 All applications for a permit and renewal of a permit require an inspection by the Municipal Law Enforcement Officer to ensure compliance with all applicable legislative requirements. 2.6 In the event that the owner fails to renew a permit issued pursuant to this By- law before the expiry date, the owner shall make application for a new permit ESBGU QFSNJUUJOH!CZ.MBX!GPS!QVCMJD!NFFUJOH!QVSQPTFT Qsfqbsfe!Opwfncfs-!3127 Page 34 of 331 5.b) 7:00 p.m. Notice of Public Meeting for Proposed Amendme... and comply with all provisions of this By-law, in order to continue the keeping of Backyard Chickens. 2.7 The Township reserves the right to impose specific conditions on any permit issued pursuant to this By-law. 3.0 INSPECTIONS 3.1 For the purposes of ensuring compliance with this by-law, a Municipal Law Enforcement Officer may at any time, enter any land and/or building associated with the keeping of backyard chickens. 3.2 Every owner shall permit the Municipal Law Enforcement Officer to inspect any land and/or building for the purpose of determining compliance with this by-law. 3.3 Notwithstanding any provision of this by-law, a Municipal Law Enforcement Officer shall not enter any room or place actually being used as a dwelling, unless: a) The consent of the occupier is obtained, the occupier first having been informed that the right of entry may be refused and, if refused, may only be made under the authority of a warrant issued under the Provincial Offences Act. R.S.O. 1990, as amended; or b) A warrant issued under the Provincial Offences Act, R.S.O. 1990, as amended, is obtained. 4.0 GENERAL CONDITIONS 4.1 The provisions of this section apply to the keeping of Backyard Chickens in accordance with the Townships Zoning By-law. 4.2 Nothing in this section shall be interpreted as reducing or eliminating the need for full compliance with the provisions of all applicable Federal and Provincial Statues and Regulations. 4.3 No person shall keep Backyard Chickens unless that person first registers with and receives a permit from the Township of Oro-Medonte. An application for such permit B must be signed by the landowner and shall include the following mandatory fields and declarations: (a) Date; (b) Name, address (mailing and physical), Postal Code and Telephone number; (c) Site Sketch illustrating the location and size of the coop and manure storage structures; (d) A declaration that the applicant has reviewed the following documents: (i) osecurity Recommendations for Small Flock Poultry Owners; (ii) distributed by the Ontario Ministry of Agricultural, Food, and Rural Affairs (OMAFRA); (iii) A declaration that the applicant will provide for suitable housing and shelter of chickens in their care and will maintain such housing in a clean and wholesome state, having regard for Biosecurity Recommendations for Small Flock Chicken Owners; (iv) A declaration that the applicant will provide the backyard chickens with appropriate food, water, space, and environmental conditions conducive to good health and the opportunity to socialize and engage in fundamental behaviours such as scratching, roosting and dust bathing; and (v) A declaration that the applicant has reviewed the relevant sections of the Township of Oro--law and will abide by the permissions and provisions therein. ESBGU QFSNJUUJOH!CZ.MBX!GPS!QVCMJD!NFFUJOH!QVSQPTFT Qsfqbsfe!Opwfncfs-!3127 Page 35 of 331 5.b) 7:00 p.m. Notice of Public Meeting for Proposed Amendme... 4.4 A person who keeps one or more hens as Backyard Chickens shall: a) Be permitted to keep a maximum of four (4) hens at any given time; unless directed by Council resolution to allow more. b) Be prohibited from keeping roosters. c) Provide each hen with at least 0.37 sq.m. of coop floor area; d) Provide each hen with at least 0.92 sq. m. of outdoor enclosure or fenced yard, having a floor of any combination of vegetated or bare earth in each outdoor enclosure. e) The coop and manure storage structure, exclusive of the outdoor enclosure, shall not cumulatively exceed an area of 10 sq. m. f) Provide and maintain, in each coop, at least one roost giving 15 cm of space per hen and also one next box per four hens. g) Keep each hen in an enclosed area at all times. h) Provide each hen with food, water, shelter, light, ventilation, veterinary care, and opportunities for essential behaviours, all sufficient to maintain the hen in good health. i) Maintain each hen enclosure in good repair and sanitary condition; and free from vermin and obnoxious smells and substances. j) Construct and maintain the coop to prevent any rodent from harbouring underneath or within its walls, and to prevent entrance by any other animal. k) Keep a food container and water in each coop. l) Keep each coop locked from sunset to sunrise. m) Remove leftover feed, trash, and manure in a timely manner. n) Store manure within an enclosed structure, and store no more than 0.85 sq.m of manure at a time. o) Remove all other manure not use for composting or fertilizing. Follow biosecurity procedures recommended by the Canadian Food Inspection agency. p) Keep hens for personal use only. q) Not slaughter, or attempt to euthanize, a hen on the property. r) Not dispose of a hen except by delivering it to a farm, abattoir, veterinarian, mobile slaughter unit, or other facility that has the ability to dispose of hens lawfully. s) A tenant must obtain written permission from the property owner to keep Backyard Chickens. t) The owner of hens must reside on the property where hens are kept. u) Sale of eggs, manure, and other products associated with keeping hens is prohibited. 4.5 Once all provisions of Section 4.3 are satisfied and the permit fee is paid, a permit (Schedule B) may be issued to the owner/applicant. This permit shall st be renewed annually, expiring on December 31 of each calendar year. 5.0 REVOCATION 5.1 Any person who has been issued a permit under this by-law, shall at all times comply with the by-laws of the Township and any contravention of any by-law or any other Provincial or Federal law may be grounds for the refusal, suspension or revocation of the permit. 5.2 Any person who has been issued a permit under this by-law, shall at all times comply with the declarations made within an application for permit under this by-law. Non-compliance may be grounds for the refusal, suspension or revocation of the permit. 5.3 A permit that has been suspended or revoked, as issued under this by-law, shall be returned to the Clerk and the Township will provide written notice reasons for the refusal, suspension or revocation of the permit. 6.0 OFFENCES 6.1 Any person who contravenes any of the provisions of this by-law is guilty of an offence and upon conviction is liable to a fine as proved for in the Provincial Offences Act R.S.O. 1990, Chapter P33, as amended. ESBGU QFSNJUUJOH!CZ.MBX!GPS!QVCMJD!NFFUJOH!QVSQPTFT Qsfqbsfe!Opwfncfs-!3127 Page 36 of 331 5.b) 7:00 p.m. Notice of Public Meeting for Proposed Amendme... 6.2 Notwithstanding Section 6.1 of this by-law, every person who contravenes any provision of this by-law, and every director or officer of a corporation who concurs in such contravention by the corporation, is guilty of an offence and on conviction is liable to a fine not exceeding $ 25,000, exclusive of costs. 6.3 A corporation that contravenes any provision of this by-law is guilty of an offence and, upon conviction, is liable to a fine not exceeding $ 50,000. 6.4 The court in which a conviction has been entered, and any court of competent jurisdiction thereafter, may make an order prohibiting the continuation or repetition of the offence by the person convicted, and such order shall be in addition to any other remedy and to any penalty imposed on the person convicted. 6.5 If any part of a fine for a contravention of this by-law remains unpaid after the fine becomes due and payable under Section 66 of the Provincial Offences Act, R.S.O. 1990, c.P. 33, as amended, including any extension of time for payment order under that section, the Treasurer for the Township, or agent, may give the person against whom the fine was imposed a written notice specifying the amount of the fine payable and the final date of the notice, by delivering the notice or causing it to be delivered to that person at the perso 6.6 If the fine referred to in Section 6.5 of this by-law remains unpaid after the final date specified in the notice, the fine shall be deemed to have prioritylien status for the purposes of Sections 1(2.1) and (3) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended. 7.0 VALIDITY AND SEVERABILITY 7.1 Should any section, subsection, clause, paragraph or provision of this by-law be declared by a Court of competent jurisdiction to be invalid, the same shall not affect the validity of this by-law as a whole or any part thereof; other than the part so declared to be invalid. We have reviewed the Draft By-law regarding the keeping of chickens on residential and rural residential properties. The By-law itself is generally well drafted. However, we have serious concerns with respect to the principle of permitting an agricultural use (chickens), even at a limited scale, as-of-right on residential properties. There was a period in history where livestock, and poultry were found in settlement areas and on residential properties. However, due to land use compatibility issues such as nuisances related to noise, odour and disease, these agricultural uses were restricted rural and agricultural areas. We understand there may be pressure in some circles for more local food options, but the permission to permit chickens as-of-right in residential areas has the potential to cause land use and health and safety issues that far outweigh the self- rationale associated with permitting chickens on residential properties. In summary, there is a much greater public interest in maintaining the current zoning approach of restricting agricultural uses on residential properties. It is entirely reasonable for an individual that would like the convenience of having a chicken coop on their residential property to have to undertake a Zoning By-law Amendment. On this basis, at any scale, the keeping of chickens is an agricultural use and agricultural uses should occur on the numerous rural and agricultural areas of our Township. From an administrative perspective, we also have concerns that the cost to administer and implement such a zoning and permit system would be far greater than the fees that are identified to be collected. While we appreciate Council to have to foresight to direct staff to review emerging planning issues, this is one issue where the status quo should be maintained. If staff could make sure we are provided with notice of any future meetings or decisions on this matter, it would be greatly appreciated.
