A By-law to Appoint Municipal InvestigatorsNaluers
and to Repeal By -Law No. 2011-133
Whereas the Ontario Wildlife Damage Compensation Program created by Order In
Council 1313/2011 came into effect July 1, 2011;
And Whereas Section 4(1) of the Protection of Livestock and Poultry from Dogs Act
provides that the council of every local municipality shall appoint one or more persons
as valuers of livestock and poultry for the purposes of this Act;
And Whereas Section 9 of Order In Council 1313/2011 provides that municipalities are
responsible for appointing valuers for the purposes of this Program;
And Whereas the Municipal Act 2001, S.O. 2001, c. 25, Section 224, as amended,
provides that the role of Council is to ensure that administrative practices are in place to
implement the decisions of Council.
And Whereas the Ontario Wildlife Damage Compensation Program released updated
guidelines effective January 1, 2017, wherein "valuers" are now referred to as
"municipal investigators".
And Whereas the Council of the Corporation of the Township of Oro-Medonte does
now find it expedient to repeal By -Law 2011-133 to reflect the current program
specifications and Provincial legislation.
Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows:
That the individuals outlined on Schedule "A", attached hereto and forming part
of this by-laws, be appointed "Municipal Investigators"/"Valuers" for the purposes
of the Protection of Livestock and Poultry from Dogs Act and Ontario Wildlife
Damage Compensation Program created by Order In Council 1313/2011.
2. That the remuneration paid to Municipal Investigators shall be $60.00 per claim
plus the current rate of mileage as paid by the Township.
3. That By-law No. 2011-133 is hereby repealed in its entirety.
4. This by-law shall take effect on January 1, 2017.
