1. Opening of Meeting:
Deputy Mayor Hough assumed the Chair and called the meeting to order.

a) Minutes of Development Services Committee meeting held on Wednesday, October 5,
2016.

It is recommended that the draft minutes of the Development Services Committee
meeting held on Wednesday, October 5, 2016 be received and approved as printed and
circulated.

a) Report No. DS2016-99, Andy Karaiskakis, Senior Planner re: Consent Application 2016-
6-10 by 1574826 Ontario Inc., 57 & 49B Maplewood Parkway, Part of Lots 20 and 21,
Concession 1, and Part of Block D, Plan M22, Township of Oro-Medonte.
The following correspondence was received: Hiawatha First Nation dated October 18,
2016; Township of Oro-Medonte, Building Division dated October 18, 2016; Simcoe
County District School Board dated October 18, 2016; Township of Oro-Medonte; Dave
Saunders dated October 19, 2016; Lake Simcoe Region Conservation Authority dated
October 25, 2016; John and Connie McDermot dated October 29, 2016; Andrew and
Anna Gemza dated October 31, 2016.
Andy Karaiskakis, Senior Planner, explained the purpose and effect of the application
A PowerPoint presentation was presented.
Stan Faynberg, on behalf of the applicant was present.
Connie McDermott provided comments with respect to address clarification for 57
Maplewood Parkway; previous zoning in the former Township of Orillia and in the
1990s; lot access, shared driveway concerns, additional dwellings and traffic; proposal
not in accordance with area and type of application setting a precedence.
Andrew Gemza provided comments with respect to requirements of character of
neighbourwood and community to remain the same; previous OMB decisions; other
waterfront lot frontage widths; interpretation of Official Plan and Lake Simcoe Protection

Plan; septic/driveway locations; lots are too small for proposal; building of accessory
building and deck and type of application setting a precedence.

It is recommended
1. That Report No. DS2016-99, Andy Karaiskakis, Senior Planner re: Consent
Application 2016-B-10 by 1574826 Ontario Inc., Part of Lots 20 and 21, Concession
1, and Part of Block D, Plan M22, Township of Oro-Medonte be received and
adopted.
2. That the Development Services Committee grant provisional consent to Application
2016-B-10 (1574826 Ontario Inc.) to permit a boundary adjustment of a 0.4 hectare
(1 acre) parcel of land and to create an easement for vehicular/pedestrian access
purposes, subject to the following conditions:
a) That one copy of a Registered Reference Plan for the subject land indicating the
severed parcel and the easement be prepared by an Ontario Land Surveyor be
submitted to the Secretary -Treasurer;
b) That the severed lands, with an area of approximately 0.4 hectare (1.0 acre) be
merged in title with the abutting property to the north, and that the provisions of
Section 50(3) and 50(5) of The Planning Act apply to any subsequent
conveyance or transaction involving the subject land. Therefore, once the subject
parcel of land has been conveyed to the owner of the abutting parcel, the subject
parcel, and the said abutting parcel shall merge in title and become one parcel of
land. A solicitor's written undertaking shall be provided to the Secretary -
Treasurer indicating that the necessary steps will be taken to implement the
conveyance and to consolidate the parcels to one Property Identification
Number.
c) That the applicant's solicitor prepare and submit a copy of the proposed
conveyance for the parcel severed including the easement, for review by the
Municipality;
d) That the applicant's solicitor provide an undertaking that the severed lands and
the lands to be enhanced will merge in title;
e) That the applicant applies for and obtain Site Plan approval for both the Granting
Lands and the Benefitting Lands with respect to the construction of a single
detached dwelling on each parcel;
f) That all municipal taxes be paid to the Township of Oro-Medonte;
g) That the Certificate of Consent be issued utilizing Form 4, Section 53 (42) of the
Planning Act, R.S.O. 1990, to merge the parcels; and
h) That the conditions of consent imposed by the Committee be fulfilled within one
year from the date of the giving of the notice.
3. And that the applicant be advised of the Development Services Committee's
decision under the Secretary -Treasurer's signature.

b) Report No. DS2016-100, Derek Witlib, Manager, Planning Services re: Minor Variance
Application 2014-A-36 (Johnston) 145 Moon Point Drive.
The following correspondence was received: Simcoe County District School Board
dated October 18, 2016; Township of Oro-Medonte; Dave Saunders dated October 19,
2016; Hiawatha First Nation dated October 20, 2016; Lake Simcoe Region
Conservation Authority dated October 25, 2016; Township of Oro-Medonte;
Transportation Division dated November 2, 2016.
Derek Witlib, Manager, Planning Services, explained the purpose and effect of the
application. A PowerPoint presentation was presented.
Steve Johnston, applicant, was present.

It is recommended
1. That Report No. DS2016-100, Derek Witlib, Manager, Planning Services re: Minor
Variance Application 2014-A-36 (Johnston) 145 Moon Point Drive be received.
2. That Minor Variance Application 2014-A-36 by Ruth and Steve Johnston, specifically
to permit construction of a two-story single detached dwelling with a first storey floor
area of 75.65 square metres (814 square feet) and a minimum setback of 1.3 metres
(4.3 feet) from the Average High Water Mark of Lake Simcoe to the south-west
corner of the structure, on lands located at 145 Moon Point Drive, described as Lot
28, Plan 940, Township of Oro-Medonte, be approved, subject to the following
conditions:
That the applicant satisfy the following requirements of the Lake Simcoe Region
Conservation Authority (LSRCA) and the Township:
a) That the development be subject to Site Plan Control under Section 41 of the
Planning Act.
b) The applicant shall submit a coastal engineering study, completed to the
satisfaction of the LSRCA, to demonstrate that the proposed development is
outside ofall erosion, wind setup, wave uprush and ice piling hazards associated
with the shoreline of Lake Simcoe;
c) The applicant shall submit a Restoration Plan for the shoreline of the subject
lands, completed to the satisfaction of the LSRCA;
d) The applicant shall obtain a permit from the LSRCA through Ontario Regulation
170/06 for any proposed site alteration and development on the subject lands;
e) That prior to the issuance of any Township or LSRCA permits, a construction
staging plan be provided to the satisfaction of the LSRCA to demonstrate the

means to develop the site as it relates to the protection of the wetlands, creek,
riparian area and Lake Simcoe; and
f) That the applicant provides payment of the appropriate minor variance review fee
($300) to the LSRCA.
4. And that the applicant be advised of the Committee's decision under the Secretary -
Treasurer's signature.

West Halves of Lots 2 and 3, Concession 9, and Lots 1 to 59, Registered Paln 51 M-
1070, Township of Oro-Medonte.
The Committee consented to allow Eldon Theodore, MHBC Planning Urban Design &
Landscape Architecture to provide comments.

the East and West Halves of Lots 2 and 3, Concession 9, and Lots 1 to 59,
Registered Plan 51 M-1070, Township of Oro-Medonte be received.
2. That staff prepare a report for Council's consideration regarding the requirements for
the Conditional Permit, Removal of the Holding Provision, and Engineered Lot
Grading Approval.
3. And That the applicant be advised of the Committee's decision under the Director,
Development Services' signature.
