2016-181 Amend zoning provisions which apply to lands described as Plan 1, E Pt Lot 16, Pt Blk H and RP 51R-37843 (Mark Porter/Lover's Harbour)The Corporation of the Township of Oro-Medonte By -Law No. 2016-181 A By-law to amend the zoning provisions which apply to lands described as Plan 1, E Pt Lot 16, W Pt Lot 16, Pt Blk H and RP 51 R-37843, Part 1, and Pt Lots 15 and 16, Pt Blk H, Township of Oro-Medonte, County of Simcoe, by placing a Holding (H) Provision on the lands (Mark Porter/Lover's Harbour Inc.) Whereas the Council of the Corporation of the Township of Oro-Medonte is empowered to pass By-laws to regulate the use of land pursuant to Section 34 of the Planning Act, R.S.O. 1990, c.P.13. And Whereas the Council of the Corporation of the Township of Oro-Medonte is empowered to pass By-laws to impose a Holding Provision pursuant to Section 36 of the Planning Act, R.S.O. 1990, and c.P.13. And Whereas Council deems it appropriate to rezone the lands to permit the Holding Provision, in accordance with Section E1.3 of the Official Plan; Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Schedule `A1' to Zoning By-law No. 97-95 as amended, is hereby further amended by changing the zone symbol applying to the land described as Plan 1, E Pt Lot 16, W Pt Lot 16, Pt Blk H and RP 51 R-37843, Part 1, and Pt Lots 15 and 16, Pt Blk H, formerly in the geographic Township of Oro, Township of Oro- Medonte, County of Simcoe, from Residential One Exception 260 (R1 *260) and Residential One Exception 261 (R1 *261) Zones to Residential One Exception 260 Hold (R1 *260(H)) and Residential One Exception 261 Hold (R1 *261(H)) Zones as shown on Schedule `A' attached hereto and forming part of this By-law. 2. The lands zoned Residential One Exception 260 (R1 *260) and Residential One Exception 261 (131 *261) Zones shall be subject to a Holding (H) Provision in accordance with Section 2.5 of By-law 97-95, as amended. The Holding Provision shall not be removed until a Site Plan Agreement has been entered into with the Township of Oro-Medonte that implements the recommendations of the Pinestone Engineering Ltd. Stormwater Management and Construction Mitigation Plan dated November 8, 2016 to the satisfaction of the Lake Simcoe Region Conservation Authority and the Township prior to the development of the property for residential uses. 3. This By-law shall come into effect upon the final passing thereof, subject to the provisions of the Planning Act, as amended.
