Public Meetings: a) Notice of Receipt of a Complete Application, Notice of Particulars and Public Access, Notice of a Public Meeting for a Proposed Amendment to the Zoning By - Law, Part of the East and West Halves of Lots 2 and 3, Concession 9 and Lots 1 to 59 inclusive, Registered Plan 51 M-1070, 2016-ZBA-07 (Braestone Development Corporation). Deputy Mayor Hough called the meeting to order at 5:36 p.m. and explained the public meeting is being held in accordance with Section 34 of the Planning Act, to obtain public comment with respect to a proposed Development Application. The purpose of Application 2016-ZBA-07 is to consider a proposal to amend the Zoning By-law to permit site specific development standards for attached and detached garages and accessory structures within the front yard. Notice of the Public Meeting was mailed to landowners within 120 metres of the specified site on September 9, 2016 and a notice sign was posted on the subject property on or before September 9, 2016. The following public persons offered verbal comments: Christa Hutchins provided comments that the applicants will build and sell the property, it will affect her life as she is a full time resident and is not in favour of a deferral. Renee Rerup, and on behalf of Senem Ozkin submitted picture correspondence to members of the Committee and provided comments of the validity of changing the property fabric, does not fit into nature/appearance of the Promenade, contrary to Official Plan and vision, believes it is not minor, affects the other existing variances and sets a precedence for variances. Sandra Johnston provided comments of preference of lot consistency, tree removal and root disturbance, potential improper waterflow and potential flooding. That the Development Services Committee grant provisional consent to Application 2016-B-09 to permit a boundary adjustment of a 0.46 hectare (1.14 acre) parcel, having approximately 76.2 metres (250 feet) of frontage, subject to the following conditions: a) That one copy of a Registered Reference Plan for the subject land indicating the severed parcel be prepared by an Ontario Land Surveyor be submitted to the Secretary -Treasurer; b) That the severed lands, with an area of approximately 0.46 hectare (1.14 acre) be merged in title with the property at 911 Ridge Road East, and that the provisions of Section 50(3) and 50(5) of The Planning Act apply to any subsequent conveyance or transaction involving the subject land. Therefore, once the subject parcel of land has been conveyed to the owner of the abutting parcel, the subject parcel, and the said abutting parcel shall merge in title and become one parcel of land. A solicitor's written undertaking shall be provided to the Secretary -Treasurer indicating that the necessary steps will be taken to implement the conveyance and to consolidate the parcels to one Property Identification Number. That the applicant transfer to the Corporation of the County of Simcoe ("County"), at no cost, fee simple, unencumbered interest in the following: • a road allowance widening along the entire frontage of the subject properties adjacent to County Road 20 to provide a 15.25 metre right-of- way from the centre line of County Road 20; • a daylight (sight) triangle measuring 15 metres east -west x 15 metres north -south at the south east corner of the property adjacent to County Road 20 and Line 9 South. The applicant shall submit to the satisfaction of the County's Transportation and Engineering Department a preliminary reference plan (1 copy and 1 electronic copy) which sets out the road widening to be transferred to the County. Upon approval, the County will instruct the surveyor to deposit the reference plan in the Land Registry Office for Simcoe County and request the surveyor provide the County with 1 copy and 1 electronic copy of the deposited reference plan. All costs associated with the land transfer, including costs relating to surveying, legal fees and disbursements, agreements, HST, etc. shall be fully borne by the applicant. All legal documentation is to be negotiated, prepared and registered by the Legal Services Department of the County and to be executed where required by the Applicant. The Applicant shall submit to the Legal Services Department of the County a deposit in the amount of $1,000.00 prior to the services being rendered. Invoices will be submitted on a cost recovery basis and applied against the deposit. Additional deposits may be required, and any excess over the total invoices will be refunded. Prior to stamping of the deed by the Township of Oro-Medonte, the Applicant shall obtain written clearance from the County for the above -noted conditions. The County of Simcoe is requesting the road widening pursuant to Section 53(12) of the Planning Act and such land will form part of the highway to the extent of the designated widening in accordance with Section 31(6) of the Municipal Act, 2001. The widening of County Road 20 is required pursuant to the County's standards for the construction of roads and is consistent with proper safety standards. ii. Any fences must be moved 0.3 metres inside of the new property line. d) That the applicant's solicitor prepare and submit a copy of the proposed conveyance for the parcel severed, for review by the Municipality; e) That the applicant's solicitor provide an undertaking that the severed lands and the lands to be enhanced will merge in title; f) That all municipal taxes be paid to the Township of Oro-Medonte; g) That the Certificate of Consent be issued utilizing Form 4, Section 53 (42) of the Planning Act, R.S.O. 1990, to merge the parcels; and Page 10 of 14 Development Services Committee Minutes — Wednesday, October 5 2016. h) That the conditions of consent imposed by the Committee be fulfilled within one year from the date of the giving of the notice. 3.
