for the above-noted property to this office. The applicant has applied to amend the
current zoning to permit specific development standards for attached and detached
garages and accessory structures to be located within the front yard. The proposed
Zoning By-law Amendment will apply to the entire Braestone Development subdivision.
Planning staff have no objection to the proposed zoning by-law amendment. Elementary
students residing in this area may attend Guthrie Public School and secondary students
will be bussed to Orillia Secondary School.

the above noted application to amend the Township of Oro-Medonte Zoning By-law.
The NVCA has reviewed the materials that accompanied the circulation memo and
understands that the amendment proposes to permit site specific development
standards to attached and detached garages, and accessory structures to be
located within the front yard.Upon review of these circulated materials, and based
upon our mandate and policies under the Conservation Authorities Act, NVCA
staff have no objection to the approval of the proposed zoning by-law amendment.

I am writing in regards to theminor variance application submitted for 9 Myrtle ave.
I am absolutely in opposition to this request, and would like to see the request for the
variance denied.
My wife and I decided to move to Oro-Medonte in 2006. The beauty of the lake, the proximity
to skiing and biking trails, and small community atmosphere were all factors that lead us to this
area. We looked at properties in the Sugar Bush area, several homes in Shanty Bay and
numerous properties between the 3rd line and the 7th line (which was originally the furthest
away from Barrie we wanted to be), before finding the perfect home for our growing family on
Myrtle ave in Hawkestone. It was a little further north than we planned, but the space it
provided us, and the privacy we could enjoy, far outweighed the extra commute time. When
we bought, we were comforted by the fact that our space and privacy were safe-guarded by
the fact that our neighbors would never be able to build closer than 3 meters from our property
line, ensuring that there would always be at least a 20 foot buffer between our houses.
Over the past 5 years, we have seen a lot of changes in our community, and on our street in
particular. The roomy spacious landscape we fell in love with has been dwindling, and the
houses are becoming crammed together, much like they are in the city. For example, the small
home next to us (11 myrtle) burnt down a week or 2 after being purchased. (the purchaser was
a builder) The home was rebuilt 3 times the size of the one that burnt down. The new home
was built 1 meter from the property line on either side. This same builder also built a home on
the neighboring property ( 13 myrtle), and again built 1 meter from the property lines. If the
variance is granted for 9 Myrtle, there will be 4 homes in a row that are only separated by a 6
foot space. a far cry from the spacious rural property we envisioned raising our family on.
As the houses get bigger, and crammed closer and closer than ever intended, I am
concerned for the water in my well, the integrity of the lake, and the very lifestyle that we have
built for ourselves in this wonderful township. I fear that the mature trees that are planted
along the lot line will be damaged, as the proposed new house will be built less than a meter
from them, and I worry that the developer from Toronto who bought the property of 9 myrtle,
to build upon, and sell to the highest bidder, does not have any interest in maintaining the
integrity of the area, or safeguarding its future, instead only wanting to make a buck and move
on.
I hope you take my concerns to heart and agree that our community does not benefit from
building over-sized homes on lots that are not big enough to house them. Please deny the
request for a variance in regards to 9 Myrtle.

Thank you for circulating the Lake Simcoe Region Conservation Authority (LSRCA) on the above-noted
Application for Minor Variance. It is our understanding that the purpose and effect of this application
is to allow for relief from Table B1 within Zoning By-law 97-95 to allow a 1.0 metre interior sideyard
setback whereby the by-law requires a minimum 3 metres to facilitate the construction of a single
detached dwelling.
The LSRCA has reviewed this application in the context of the Provincial Policy Statement (PPS), the
Lake Simcoe Protection Plan (LSPP), and Ontario Regulation 179/06 under the Conservation
Authorities Act. The subject lands are located in the vicinity of the shoreline of Lake Simcoe and are in
part subject to its associated flooding and erosion hazards.
Based on our review of the submitted materials we are satisfied from a watershed management
perspective that this application is consistent with the Natural Heritage and Natural Hazard Policies of
the Provincial Policy Statement (PPS), conforms with the requirements of the Lake Simcoe Protection
Plan (LSPP), and Ontario Regulation 179/06 of the Conservation Authorities Act. As such, the LSRCA
has no further requirements as they relate to this Application for Minor Variance.
Please note that a permit from our offices will be required for any development or site alteration
within the lands regulated under Ontario Regulation 179/06 of the Conservation Authorities Act.

Thank you and Oro-Medonte staff for your consideration of the Nottawasaga Valley
Conservation Authority (NVCA) in the circulation of notices for the upcoming
development services committee meeting. Please find the NVCA comments below:
-2016-B-11 (Piotriwski); The NVCA has no objection to the proposed consent
application. The residence surplus to a farm operation application is at the
watershed boundary ofthe NVCA, and is not affected by conservation
regulations. Consultation with Lake Simcoe Region Conservation Authority
staff is recommended to ensure there comments may be included within this
decision. Based upon our mandate and policies under the Conservation
Authorities Actwe have no objection to its approval.

Hi Darren and Derek,
Further to my conversation with Darren earlier today, please note that the County staff planning
opinion has no new or further comment on the McGill consent application. As discussed and
Statement is clear in
stating that no new residential lots may be created in the prime agricultural area, but consents
may be permitted for surplus farm dwellings that result from farm consolidations (subject to
various provisions). It is our understanding that there is currently no dwelling to be considered
surplus at this time. Darren advised that his client may likely pursue the construction of a
dwelling first before following through with the deferred consent application. If this were to occur
and the owner were to consolidate the agricultural holdings and deem the dwelling surplus, we
believe it would meet the applicable policies of today.
On a related note, County staff have received the attached OMB decision. The context of the
application dealt with in the decisions may not be completely identical to the McGill application,
but I thought I would provide it for your reference. It reflects an OMB interpretation (albeit a
strict interpretation) of the PPS2014 lot creation policies. While County staff may not
necessarily adopt the same interpretation, it is worthwhile information to consider as planners in
the future.
