1995-098 To provide for the numbering of buildings along highways and streets, and the keeping of a record of such highways and streets and the numbers allocated to buildings thereon and to repeal By-law 91-71 . THE CORPORAT:ION OF THE TOWNSH:IP OF ORO-MEDONTE BY-LAW NO. 95-98 A By-law of the corporation of the Township of Oro-Medonte to provide for the numberinq of buildinqs alonq highways and streets, and the keepinq of a record of such hiqhways and streets and the numbers allocated to buildinqs thereon and to repeal By-Law No. 91- 71 of the former Township of Oro WHEREAS section 210, Subsection 112 of the Municipal Act, R.S.O. 1990, Chapter M.45, provides that by-laws may be passed for numbering the buildings and lots along any highway, beach, park, reserve or any other property in the municipality that is considered necessary to number by the Council, and for affixing numbers to the buildings and for charging the owner or occupant with the expenses incident to the numbering of the lot or property, and WHEREAS it is further provided that such expense may be collected in the same manner as taxes; and if paid by the occupant, subject to any agreement between him and the owner, may be deducted from the rent payable to the owner; and WHEREAS subsection 210 Subsection 113 of the Municipal Act, R.S.O. 1990, Chapter M.45, provides that by-laws may be passed for the keeping of a record by Council, of the highways, beaches, parks, reserves and of the numbers of the buildings, lots and other property, and for entering therein, a division of the streets with boundaries with distances, for public inspection; and WHEREAS it is deemed expedient by the Council of the Corporation of the Township of Oro-Medonte to provide for the numbering of buildings and lots along highways, beaches, parks or other properties within the municipal boundary, and to provide for the keeping of a record of such highways, beaches, parks or other properties and the numbers allocated to building thereon. NOW THEREFORE the Council of The Corporation of the Township of Oro-Medonte enacts as follows: il ! I II !I !I II il 2. 3. II 4. Ii .. 11 I, II II i! il li II Ii II 5. 6. " , :! ;! 'i :1 1. For the purposes of the By-law, "street" includes but is not limited to mean a public highway, unassumed, private road or any street which affords the principal means of access to an abutting lot. Every highway or street within the Corporation of the Township of Oro-Medonte shall be divided into increments and a number shall be affixed to every building and lot corresponding to the established increment on the said street. A record, known as the Municipal Addressing System for the Township of Oro-Medonte, shall be maintained by the Planning Department and setting out the names of streets and numbers affixed to every building which shall be the official street numbers for all buildings within the said Township. The Zoning Administrator is authorized to assign to any building along any street the number appearing in the Municipal Addressing System for the Township of oro- Medonte as the proper number for such building. Whenever a new building is erected along any street, the zoning Administrator shall assign a number to each new principal building erected along any street. Every owner or occupant of a building for which an official street number has been assigned shall, no later than thirty days from the date of notification of such assignment, or in the case of a new building before occupation, affix the official street number in a manner set out in this By-law. Any official street number not affixed in accordance with section 6, may be affixed by the Chief Building Official or designate, and all expenses incurred in connection with the numbering of the building shall be collected in the same manner as taxes. ~ ii 8. No person shall affix to any building or premises or, being the owner or occupant, shall allow to be affixed or to remain affixed thereto any number except that appearing in the Municipal Addressing System as the number of such building or premises. , I , , II I 9. Every number assigned to a building or premise shall be of sufficient size and located in a manner, so as to be clearly legible from the street. The minimum size for every number shall be four (4) inches in height and shall be three quarters (3/4) of an inch in width and shall be luminous in nature. , I i, 11 il il II , II ii Ii Ii ,i II I ii II II II Ii II :1 Ii ii , 'i :1 11 II ,I Ii Ii Ii II Ii Ii II I I 'I 10. The numbered sign shall be erected upon the same side of the highway or street as the building or premise is situated, and placed at an appropriate height and distance in order to ensure visibility from both directions. Whenever it becomes necessary to have the numbers changed on any street or portion of a street, the zoning Administrator shall report to council and, if so directed, shall thereafter renumber the buildings along the said street or portion of the street and shall cause the owners of property on the said street or portion of the street to be notified and directed to remove the previous numbers and affix new numbers to the building. The Municipal Addressing System will be amended accordingly. 11. Should a section or provision of this by-law be declared by a court of competent jurisdiction to be invalid, the same shall not effect the validity of the By-law as a whole or any part thereof, other than the section or provision so declared to be invalid. 12. Every person who violates any provision of this By-law, upon conviction, is guilty of an offence and shall be liable to a fine in an amount to be determined pursuant to the Provincial Offences Act, R.S.O. 1990, Chapter P.33. 13. That By-Law No. 91-71 of the former Township of Oro is hereby repealed. 14. This By-law shall take effect and come into force on the date it is passed by Council BY-LAW READ A FIRST AND SECOND T:IME THIS 1st DAY OF November, 1995.
